Clarification to Application for REVISION TO TOWN OF VAIL BUILDING
PERMIT # B06 -0258
DETAILED DESCRIPTION OF WORK ADDED TO SCOPE OF WORK PERMITTED
BY PERMIT # B06 -0258
RA Nelson proposes to patch drywall at the Basement and 1 St floor corridors and units of
Building E (8 units, 1 corridor and Mechanical /Electrical Room) after installation of fire
alarm and fire sprinkler upgrades . 16" — 24" wide troughs will be cut through the
corridors and in the units under the Manor Vail asbestos permit. These troughs will be
cut per the attached plans. Fire alarm and fire sprinkler upgrades will be installed,
inspected and then drywall patching will take place. New telephone and cables lines will
also be within the units as shown on the attached plans.
We anticipate cutting drywall through the center of the corridors for the entire length of
the corridor. We do not plan to do any work near the unit walls. If we do need to come
into contact with the unit wall, the appropriate 1 hour rating (1 layers of drywall on each
side of the wall and all penetrations properly firecaulked) will be installed in this area.
There will be no occupants in Building E during this work. The existing fire alarm and
fire sprinkler system will stay active. Above described work in E building is exactly the
same as the work permitted in building D. Installation of new fire alarm and sprinkler
system will improve Fire /Life Safety of the facility.

Based on the information provided, it appears that a level 1 renovation will occur per the 2003
International Existing Building Code. This level of renovation requires that all new material installed
must comply with the current 2003 International Building Code. Please amend the plans to show the
location of existing fire - resistive ratings and wall /ceiling types that will be affected.
2. Provide assembly details to show the materials and assemblies used to reconstruct the fire - resistive
ratings.
Please refer to the cover sheet for information and instructions for resubmitting plans. The recheck of
plans usually occurs within 3 -5 working days of plan resubmittal. In order to avoid delays please check

The document you sent for review is represented as an MOU. This needs to be revised to be an Administrative
Modification Request (AMR) per section 104.10 of the IBC which states the following:
IBC: 104.10 Modifications. Wherever there are practical difficulties involved in carrying out the provisions of this code, the
building official shall have the authority to grant modifications for individual cases, upon application of the owner or owner's
representative, provided the building official shall first find that special individual reason makes the strict letter of this code
impractical and the modification is in compliance with the intent and purpose of this code and that such modification does not
lessen health, accessibility, life and fire safety, or structural requirements. The details of action granting modifications shall
be recorded and entered in the files of the department of building safety.
The code section in question here is:
IBC: IF] 903.3.1.2.1 Balconies. Sprinkler protection shall be provided for exterior balconies and ground -floor patios of
dwelling units where the building is of Type V construction. Sidewall sprinklers that are used to protect such areas shall be
permitted to be located such that their deflectors are within 1 inch (25 mm) to 6 inches (152 mm) below the structural
members, and a maximum distance of 14 inches (356 mm) below the deck of the exterior balconies that are constructed of
open wood joist construction.
Based on the code requirements, please submit to sprinkler the balconies or provide an equal construction
design, material or method and justification for granting approval of an AMR to not sprinkler the decks.
Please let me know if this does not give you the direction you need.

I understand that you wish to resolve the issue of the need to sprinkle the existing Manor Vail balconies prior to
issuing the minor renovation permit. That is completely understandable. We are proposing an administrative
modification to provide a performance based improvement to these balconies in lieu of the exterior sprinkler
heads as we discussed when we visited the site with you and Mike McGee. Attached is a letter format for that
Administrative Modification. If this is acceptable we will also include this same language in the overall
Administrative Modification that will be included for the master full plan check response.

We have also printed 5 hard copies of the original building section sheet that I emailed yesterday with the plan
check response letter. I understand that it was hard to read. Someone from RA Nelson will pick these up from us
and deliver them to you.
One final item, I have copied an email I sent out earlier that discusses the exterior wall construction in the
existing D, E and F buildings. We have asked the contractor to confirm these original details as they may affect
our exterior wall assembly. Just want to keep you in the loop about what we are doing and what we are finding.

Dear Matt,
We understand from the Contractor that you would like information relative to the sprinklering of
the existing Manor Vail balconies. Following is language we are proposing for an Administrative
Modification for this issue:
MOCK Plan Check Review Comment Regarding Balcony Protection:
Perry Matthews, Brian Sipes. Tony Vangalis, Mat# Royer and Mike McGee met o11 site to review
the conditions of the existing Manor Vail balconies and to discuss possible remedial solutions to
improve the code compliance for these balconies relative to the intent of the code that they be
protected. At this site meeting it was determined that the existing exterior wall had fire blocking
(wood 2x construction) separating the exterior balcony from the interior floor ceiling space
everywhere except for the space representing the physical width of the actual open web trusses.
It was also discussed and determined that an equivalent protection (for not providing sprinkler
protection below the balcony) would be to extend the non- combustible 1- hour fire rated exterior
finish up over the faire blocking and providing 1- hour rated penetration fire stops at locations
where the open wood trusses penetrated the exterior wall fire blocking. The exterior balcony will
also be covered with a non - combustible finish. "fhe intent of this construction is to separate the
exterior balcony from the interior ceiling space and to provide a performance -based design that
will meet the intent of the exterior balcony protection without requiring exterior sprinkler heads.
Please let me know if this language and proposal is an acceptable solution.

Dear Matt,
We have received and reviewed your Plan Review Comments Sept. 5, 2006 and submit the
following response addressed by comment below.
1. The portions of the existing assembly that will be cut for the remedial fire sprinkler and alarm
work will be patched with construction matching that of the existing assembly. Since all of
the work will involve the cutting and patching of the lowest surface of the ceiling assembly
we believe all that will be affected will be Gypsum Wallboard.
2. I have attached portions of the original construction documents for the D, E and F buildings
that show what we believe to be the original construction. As you can see, the GWB was
originally 5/8" with a fire rating, but entire floor ceiling assemblies were not identified. This
assembly will be used to patch the existing construction unless a different assembly is
observed in the field. It is unknown, but likely that some remodeling has been done in the
last 40 years and that we will uncover some discrepancies. We will address these in the field,

If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works) review and approval,
a Planning Department review or Health Department review, and a review by the Building Department, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multi - family permits will have to follow the above mentioned maximum
requirements. Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS

How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application
If yes was answered to any of the questions then a "Public Way" permit is required. You can pick up an
application at either Community Development, located at 75 South Frontage Road or Public Works, located at
1309 Elkhorn Drive.
Notice sign -offs for utility companies. ALL utilities must field verify (locate) respective utilities prior to signing
application. Some utility companies require up to 48 hours notice to schedule a locate.
A construction traffic control /staging plan must be prepared on a separate sheet of paper. An approved site plan
may also be used. This plan will show locations of all traffic control devices (signs, cones, etc.) and the work
zone, (area of construction, staging, etc.). This plan will expire on November 1S and will need to be resubmitted
for consideration for approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width and depth of work).
This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Works office for review. If required, locates will be scheduled for the
Town of Vail electricians and irrigation crew. The locates take place in the morning, but may require up to 48
hours to perform.
The Public Works Construction Inspector will review the application and approve or deny the permit. You will be
contacted as to the status and any requirements that may be needed. Most permits are released 48 hours of
being received, but please allow up to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the "Building Permit" to be
released. Please do not confuse the "Public Way Permit" with the "Building Permit ".
NOTE: The above process is for work in a public way ONLY. Public Way Permits are valid only until
November 15 A new Public Way Permit is required each year if work is not complete. Re-
application each November 15 does not mean an automatic renewal.

The Town of Vail Building Department has developed the following procedures to ensure that new construction
sites have adequately established proper drainage from building sites along and adjacent to Town of Vail roads or
streets.
- The Town of Vail Public Works Department will be required to inspect and approve drainage adjacent to Town of
Vail roads or streets and the installation of temporary or permanent culverts at access points from the road or
street onto the construction site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other inspection. Please call Leonard
Sandoval at 970 - 479 -2198 to request an inspection from the Public Works Department. Allow minimum of 24
hour notice.
Also, the Town of Vail Public Works Department will be approving all final drainage and culvert installation with
resulting road patching as necessary. Such approval must be obtained prior to any Final Certificate of Occupancy
Issuance.

CODE 5 -2 -10: DEPOSITS ON PUBLIC WAYS PROHIBITED
❑ Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or deposit, or cause to
be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any other debris or material upon any
street, sidewalk, alley or public place, or any portion thereof.
❑ Notice; Abatement: The Director of Public Works may notify and require any person who violates or causes another
to violate the provision of subsection A hereof, or who has in the Director's employment a person who violates or
causes another to violate the same, top remove such sand, gravel, rocks, mud, dirt, snow, ice or any other debris or
material within twenty four (24) hours after receipt of said notice by the Director of Public Works. In the event the
person so notified does not comply with the notice within the period of time herein specified, the Director of Public
Works, or other authorized agent, may cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other
material to be removed from any street or alley at the expense of the notified.
❑ Summons and Penalty: As an alternative to the notice for removal provided in subsection B above, any person
who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of
the Town for said violations, and upon being found guilty of a violation hereunder be punished as provided in Section
1 -4 -1 of this code.
❑ Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the Director of Public
Works as provided in subsection B hereof, and any such person shall, in addition to payment of the expense of removal
incurred by the Director of Public Works, as provided in subsection B hereof, upon being found guilty of a violation
hereunder, be punishable as provided in Section 1 -4 -1 of this Code. (1997 Code: Ordinance 6 (1979).
CODES 7 -3A -1 AND 7 -3A -3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
❑ No person shall park any vehicle upon a street or at any other place within this Municipality in such a manner or under
such conditions as to interfere with the free movement of vehicular traffic or proper street or highway maintenance.

❑ Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a street or upon any
place within this Municipality in such a manner as to constitute a violation of any section of this Article, or left

prescribed by Colorado Revised Statutes section 42 -4 -1102, as amended, the officer shall require the vehicle to be
removed or cause it to be removed and placed in storage in the nearest garage or other place of safety designated or
maintained by this Municipality, and the charges for towing and storage of such vehicle shall be charged to the owner

1.0 INTRODUCTION
Tetra Tech, Inc. (Tetra Tech) performed background sampling for asbestos in public areas of
Manor Vail Resort to evaluate potential pre- existing asbestos contamination in public areas
(such as corridors, lobbies and stairwells) of the six on -site buildings. Mr. Alex Orolin, senior
industrial hygienist for Tetra Tech, performed the visual inspection and sampling on May 21,
2005. Mr. Orolin is a Colorado - certified asbestos building inspector /management planner, air
monitoring specialist, project designer, and project manager.
2.0 METHODS
Tetra Tech's sampling strategy consisted of visual inspection, phase contrast microscopy (PCM)
air sampling, and microvac sampling of settled dusts in order to accurately confirm or deny the
presence of pre- existing asbestos contamination.
2.1 Visual Inspection
Mr. Alex Orolin visually inspected public areas of the six buildings per Asbestos Hazard
Emergency Response Act ( AHERA) evaluation protocol. The AHERA evaluation protocol
focuses on the physical condition (damage) of asbestos - containing materials (AGMs) and
assumed ACMs. Since it was unknown whether the various building materials (such as
gypsumboard, joint compound, wall texture, and ceiling texture) used in public areas contained
asbestos, all materials were assumed to be ACMs until bulk sample analysis proved otherwise.
The inspected public areas included corridors, lobbies, and stairwells.
2.2 PCM Air Sampling
Airborne microscopic asbestos fibers from disturbed ACMs usually disperse inside a building
and therefore can be evaluated by phase contrast microscopy (PCM) air sampling. The
presence of excessive airborne fibers would indicate asbestos contamination in the sampled
areas. Please note that PCM analysis measures all airborne fibers and is not specific for
asbestos fibers. In the event that differentiation of asbestos fibers is required, transmission
electron microscopy (TEM) analysis is used.
Tetra Tech performed background PCM air sampling throughout public areas of the six
buildings to determine whether airborne asbestos existed in these areas. Sampling was
conducted using the National Institute of Occupational Safety and Health (NIOSH) 7400
method. Tetra Tech collected 20 samples (18 samples, 2 blanks) from public areas. with one
PCM air sample taken from each level of each building. PCM air sampling train airflow was
calibrated to 15 liters per minute (Ipm) prior to and following individual sample collection events.
Air sample volumes ranged from 1155 - 1590 liters of air. Reservoirs Environmental, Inc.
analyzed the air samples.
The Colorado Department of Public health and Environment (CDPHE) maximum allowable
asbestos level (MAAL) is 0.010 F /cc for PCM analysis. In the event that a PCM air sample
exceeds the MAAL, CDPHE requires sample analysis by TEM. The CDPHE TEM clearance
standard is 70 asbestos structures per square millimeter (s /mmz).

3.3 Microvac Sampling of Settled Dusts
Tetra Tech collected seven composite microvac samples (6 samples, 1 media blank) from
public areas of the six buildings. All seven composite microvac samples were determined to be
"none detected" for asbestos by PLM analysis. Table 2 summarizes the microvac sample
results.

4.0 CONCLUSIONS /RECOMMENDATIONS
Tetra Tech concludes that pre - existing asbestos contamination is not likely present in the public
areas (corridors, lobbies, stairwells) of the Manor Vail Resort.
No further action is required at this time; however, Tetra Tech recommends archival of this
report in the facility asbestos Operations and Maintenance Plan (O &M Plan) as documentation
of this response action and for future reference.

DETAILED DESCRIPTION OF WORK CONTINUED FROM PERMIT
APPLICATION:
RA Nelson proposes to patch drywall at the 1 St and 2 " floor corridors and units of
Building D (16 units and 2 corridors total). 16" — 24" wide troughs will be cut through
the corridors and in the units under the Manor Vail asbestos permit. These troughs will
be cut per the attached plans. Fire alarm and fire sprinkler upgrades will be installed and
then drywall patching will take place. New telephone and cables lines will also be within
the units as shown on the attached plans.
We anticipate cutting drywall through the center of the corridors for the entire length of
the corridor. We do not plan to do any work near the unit walls. If we do need to come
into contact with the unit wall, the appropriate 1 hour rating (2 layers of drywall on each
side of the wall and all penetrations properly firecaulked) will be installed in this area.
There will be no occupants in Building D during this work. The fire alarm and fire
sprinkler system will stay active.

originally 518" with a fire rating, but entire floor ceiling assemblies were not identified. This
assembly will be used to patch the c.xisting construction unless a different assembly is
observed in the field. It is unknown, but likely that sonic remodeling has been done in the
