Box 57 Vaii, CO 81658 Re: wetland Investigation and Section 404 Permitting for "Lot ll" in East Vail, Colorado Dear Lynn: On May 25, 1995, Wright Water Engineers, Inc. (WWE) visited the "Lot I 1 " properfy in East Vail, Colorado to identifu and map any wetlands and other "waters of the U.S." (e.g., streams, springs, ponds) on the property. The property is located approximately three miles southeast of Vail in Eagle County and consists of approximately one-half acre. WWE used the criteria and methods in the U.S. Army Corps of Engineers' (USACE) Wetland Delineation Manual (1987) to determine if any wetlands are present on the subject property. This is the current manual used by the USACE for wetland delineations and requires the presence of three factors (hydrophytic vegetation, hydric soils, and wetland hydrology) for an area to be a wetland. The attached wetland data sheets document the site conditions. FINDINGS No wetlands were found on the subject property, with the exception of three very small (3x5 feet) wetlands associated with the active channel on the northwest comer of the property. These small wetland patches were field staked. The majority of the property is relatively flat, has fairly well- drained soil, and is dominated by pasture grasses. The cunently published Soil Suney by the Natural Resources Conservation Sen'icc (formerly the Soil Conservation Service) does not include the subject propertY. 'fhe active channel which traverses the northwest comer of the property is a "water of the U.S." and is subject to Section 404 permitting. According to the most recent U.S. Geological Survey topographic map of the area this charurel is tributary to an un-named tributary of Gore Creek, and does not appear as a channel on the map (due to its size and flow characteristics). Ms. Lynn Fritzlen May26,1995 PageZ Several "relic" willows also exist on the southem and westem ends of the properly. There appears to be an old drainageway through the center of the property. This drainageway is a vegetated swale with no defined bed and banks, and therefore, would not be a "water of the US" This swale has been permanently diverted at the southem end of the property into a roadside ditch. The water flows approximately 100 feet along the southem end of the property before its confluence with an active channel near the southwest comer of the property. A2- to 3-foot berm has been constructed immediately north of the roadside ditch which confines all flow within the ditch. Therefore, there is no source of hydrology to sustain wetlands on any portion of the property north of this berm. This explains why the majority of the willows on-site were mature and had an understory of pasture grasses (primarily Dactylus glomerata). The diversion of the historic drainageway reportedly occurred during construction of Meadow Drive, which has been estimated to have been constructed in the late 1960s. CONCLUSIONS Ai\D RECOMMENDATIONS WWE recommends that written notification be obtained from the USACE in order to conlirm this wetland delineation. If the USACE agrees that there are no jurisdictional wetlands on site and/or that there will be no impacts to wetlands or other "waters of the U.S." from the proposed development, then no Section 404 permit will be required to develop the property. If a Section 404 permit is required, it is likely that a nationwide permit may be used rather than an individual permit. For example, a Nationwide #26 permit for headwaters or a Nationwide # I 8 for minor fill activities may be used. The permitting process for nationwide permits is typically less time-consuming and involved than an individual permit. We hope that this information is suitable for your needs. (wwE) visited the "Lot I 1" property in East vail' Colorado to identifu and map any wetlands and other "waters of the U.S." (e'g'. streams, springl' ponds) on the property. rn. p.op..ry is located approximately three miles southeast of Vail in Lagle County and consists of approximately one-half acre' WWL used the criteria and methods in the U.S. Army Corps of Engineers' (USACE) Wetland Delineation Manuau 1987) to determine if any wetlands are present on the subject property' This is the current manual ur"i by the USACE for wetland delineations and requires the presence of three factors (hydrophytic vegetation, hydric soils, and wetland hydrology) for an area to be a wetland. The attached wetland data sheets document the site conditions. FINDINGS No wetlands were found on the subject ploperfy, with the exception of three very small (3x5 feet) wetlands associated with thc active channel on the northwest comer of the property' These small wetland patches were field staked. The majority of the property is relatively flat, has fairly well- drained soil, and is dominated by pasture grasses. The cunently published soil survey by the Natural Resources conservation Service (formerly the Soil conservation Service) does not include the subject Property. The activc channel which traverses the northwest comer of the property is a "water of the U'S'" and is subjcct to Section 404 permitting. According to the most recenl u.S. Geological Survey ,opogiupfri. map of the *"o, thi, channel is tributary to an un-nafited tributary of Gore Creek, and docs noi appear as a channel on the map (due to its size and flow characteristics)' Re: I Ms. Lynn Fritzlen May26,1995 Page2 Several "relic" willows also exist on the southem and western ends of the proPerty. There appears to be an old drainageway through the center of the property. This drainageway is a vegetated swale with no defined bed and banks, and therefore, would not be a "water of the US" This swale has been permanently diverted at the southem end of the property into a roadside ditch. The water flows approximately 100 feet along the southem end of the property before its confluence with an active channel near the southwest comer of the property. A2- to 3-foot berm has been constructed immediately north of the roadside ditch which confines all flow within the ditch. Therefore, there is no source of hydrology to sustain wetlands on any portion of the property north of this berm. This explains why the majority of the willows on-site were mature and had an gnderstory of pasture grasses (primarily Dactylus glomerata). The diversion of the historic drainageway reportedly occurred during construction of Meadow Drive, which has been estimated to have been constructed in the late 1960s. CONCLUSIONS AIID RECOMMENDATIONS WWE recommends that written notification be obtained from the USACE in order to confirm this wetland delineation. If the USACts agrees that there are no jurisdictional wetlands on site and/or that there will be no impacts to wetlands or other "waters of the U.S." from the proposed development, then no Section 404 permit will be required to develop the property. If a Section 404 permit is required, it is likely that a nationwide permit may be used rather than an individual permit. For examplc, a Nationwide #26 permit for headwaters or a Nationwide #18 for minor fill activities may be uscd. The permitting process for nationwide permits is typically less time-consuming and involved than an individual permit. We hope that this information is suitable for your needs. Meadow Drive Culvert - The culvert that runs under the Meadow Drive and spills into the ditch on our side of the property is blocked by silt and is not usable at this time. The majority of drainage coming from the south side ofthe road has been directed into the active channel on the west side of the property. I do not believe that any regrading is necessary to the ditch to maintain proper drainage based upon review of the Wetlands Investigation Report prepared by Wright Water Engineers. Roof Framing We have not made a frnal decision on whether to lower the ceilings in the upstairs bedrooms.
