I am writing to follow up our telephone conversation of Friday aftemoon May 19, 2006.
As you mentioned we (Remberts Unit l) did apply to the TOV for building permits in the
late 1990's and then again in 2000 for deck reconstruction. These jobs were completed in
a timely manor and the permits have since expired. We are neither seeking any new
permits at this time nor are we involved in any building projects.
As we also discussed, it has come to our attention that the Nichols residence Unit 2 is
curently engaged in a reconshuction project on their deck and possibly an interior
remodeling project.
According to your records, the Design Review Board has not approved the deck
reconstuction and a building permit has not been issued for any interior remodeling. At
this point it is uncertain whether these approvals have been sought by the Nichols.
Further as a condominium owner, we have not been notified ofany ongoing projects by
the Nichols. Given the characteristics of the real property sunounding the decks of both
Unit I and Unit 2 and their proximity to each other, we have a strong interest in the
stnrctural integrity of the Nichols deck. It is our understanding that in 1985 damage was
sustained to both decks by a mudslide. In light of this history the TOV required us to add
several additional piers to our deck reconstuction.

In order to approve the landscape lighting at the Rembert residence, the Town of Vail staffneeds
additional information. Section 18.54.050(D lists the following standards:
I . Light sources cannot exceed a ratio of I : 125 based on the following equation:

luminous area
2. The number of liglrt sources cau not exceed one per thousand square feet of lot area. In
addition to providing the area for the lot, please document the number of liglts sources on
both sides of the dupler
3. Noue ofthe light sources can be mounted on a heigbt exceeding eight feet.
Please submit a site plan verifying that these tbree standards have been met by the proposal. Staff
will then be able to proceed with the review of ttre project. Call me if you have any questions,
particularly in determining the luminons output of the liglts.

This past February your Department granted approval of the remodeling plans for my
home located at 1547-A Springhill Lane. Unfortunately, due to the construction boom
throughout the valley, we were unable to secure a suitable contractor to begin that project
either during the Spring or more recently.
It was my understanding that the approval of the plans was good for one year. At this
point I would like to request an extension of the approval such that we could begin
construction either in March or September, 1995, again depending on availability of a
contractor. We plan to submit the project to about three contractors in December of this
year and should have bids available for our review in January or February.

on my home at L547A springhitl Lane was denied. Several months earlier my architect, Steven Riden, had apparently received

improvements. Had we known then that approval of a variance ldas
necessary or was likely to be denied, we would not have proceeded
with obtaining expensive architectural plans and specifications.
I feel to some extent that f was urisled in this process, and I do
not fully understand the reasons for the initial approval and then
the denial of the variance. Therefore, I would like to request
information that nay help ne to better understand the reasoning

Allison Lassoe stated that she would like to see building envelopes on each lot so that the
PEC would be assured of tuture building locations.
Jeff Bowen stated that he was concerned with the wetlands, trees and the excessive slope
on this site. He stated that he felt that the wetland issue pertained to what was
considered buildable area.
Jim Curnutte pointed out that the definition of buildable area was that portion of the lot
which did not include slopes in excess of 40%, red hazard avalanche or designated flood
plain.
Kristan Pritz stated that weflands enforcement was a federal issue but that the Town
attempts to minimize wetland impacts whenever possible and to inform applicants of
wetlands issues.
Greg Amsden slated that more site analysis needs to be done on this site with regard to
building envelopes and trees. He said that he felt that four units on the site might be
excessive. He felt that the additional GRFA that would be allowed by splitting the lot was
not appropriate as it increased the actual square footage buildable by approximately 50%.
Kathy Langenwalter stated that an access easement between the two sites needs to be
studied.
Nancy Byers, an adjacent property owner, stated that she was concerned with the
potential loss of trees on the site. She added that she did not want lo see this lot turn into
"all house".
Craig Snowdon stated that they were trying to save as many lrees as possible and that
it was their intent to leave as many trees as possible along the front property lines to
screen the future buildings.
Kathy Langenwalter stated that the PEC would like to see this item tabled so that the
applicant could obtain a wetlands study as well as information concerning building
envelooes.
Craig Snowden requested that this item be tabled until September 27, 1993 in order lo get
the additional information that the PEC had requested.
Dalton Williams made a motion to table this item until September 27, 1993 with Jeff
Bowen seconding the motion. A 7-0 vote tabled this request until September 27,'1993.

find any unusual circumstances on this site that would justify granting the requested site
coverage variance. He said that statf was recommending denial of this request for a site

Kristan Pritz made a presentation per the staff memo and stated that the applicants have
made several modifications to this proposal since it was last presented to the PEC in
December of 1992 and January of 1993. She stated that most of the above grade floor
area had been removed from the easement area. However, she stated that there was 71
square feet that was still located in Tract C. She said that the fifth floor condominium had
been reduced in size and the building had been pulled back approximately 9 to 12 feet
in this area on the north. She said that Streetscape improvements are now a part of the
proposal (i.e. pavers, additional landscaping to Seibert Circle). She said that the
applicants felt that two additional employees would be needed as a result of this project.
She stated that this request included essentially five components: an SDD request, a
request for an exlerior alteration in the CCl, a request to encroach into View Corridor #1 ,
a request to rezone a portion of Tract E, and a request for a minor subdivision. She
stated that the staff lelt that there are many positive aspects of this project but that staff
still felt that the view corridor encroachment, sun/shade, employee housing, loading and
delivery, streetscape improvements and architectural detailing on the east, north and west
elevalions, are still issues. Kristan summarized by saying that the main concerns that
stafl still had with this proiect pertained to the bulk and mass of the proposal, particularly
the view corridor encroachment and shade on Seibert Circle.

The maximum allowable site coverage for the Two-Family Residential zone is 20%. For this
particular lot, 2Oo/" of the lot area would consist of 3,467 square feet. The existing property
currently has 3,646.3 square feet of building located upon the site, or 21 .O"/". The applicant's
request is to add an additional 175 square feet of site coverage, for a total of 3,821.3
square feet of site coverage or 22.Oo/".
The proposed addition would be an expansion to the living room, the entry, and two
bedrooms. There would be a28 square foot bay window added to the living room,
approximately 62 square feet added to two different bedrooms, and 138 square feet added to
the entry area. This would all occur on the western side of the home. One to three aspen
lrees would be removed if the addition is done.

During the review, the staff discussed the proposal with the architect and leamed that the ", rln'
primary argument for requesting this variance is that the codes have cnrng"J s-in;lne - [# v
structure was built. Staff evaluated the site coverage of the existing duplex under the old
regulations and found that the structure would have a site coverage of 20.0%. Under the new
regulations, it has a site coverage ol 21 .0o/". Thus, any addition, whether proposed earlier
under the former regulation or proposed now under the current regulation, would require a
variance.

IV. CRITERIA AND FINDINGS
Upon review of Criteria and Findings, Section 18.62.060 of the Vail Municipal Code,
the Community Development Department recommends denial ol the requested
variance based on the following factors:
A. Consideration of Factors:
1. The relationship of the requested variance to other existing or
potential uses and structures in the vicinity.
The surrounding properties adjacent to the site are also duplexes or
primary/secondary developments. The proposed addition is architecturally
compatible with the existing duplex and would fit in with the neighborhood well,
in staff's opinion. The proposal would have little negative impact on the
relationship between this structure and the surrounding sites in the vicinity
except lor removing the one to three aspen lrees. The applicant is not

proposing to provide any landscaping at this time.
B.
2. The degree to which relief from the strict and literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the vicinity
or to attain the obiectives of this title without grant of special
privilege.
Although the staff does not believe that there would be any significant impact to
adjacent properties as a result of the proposed aOOitiorU-lhe-€lellE una9le to
identifu a ohvsical hardshio which exists on this lot which would warrantTFd-
coverage variance. We could find nothing unusual about the
ffi2 to justify the variance, and we believe that it
would be a grant of special privilege to approve a site coverage variance for
this property. Nor could we find a reason to allow relief from the strict
enforcement of the site coverage regulation.
3. The effect of the requested variance on light and air, distribution of
population, transportation and traffic facilities, public facilities and
utilities, and public safetY.
It is the staff's opinion that the applicanfs request for a site coverage variance
will have no significant impacts upon any of the above criteria.
The Planninq and Environmental Commission shall make the followinq findinos
before qrantinq a variance:
1. That the granting of the variance will not constitute a grant of special
privilege inconsistent with the limitations on other properties classified in
the same district.
2. That the granting of the variance will not be detrimental to the public
health, safety or welfare, or materially injurious to properties or
improvemenls in the vicinity.
3. That the variance is warranted for one or more of the following reasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives ol this title.
b. There are exceptions or extraordinary circumstances or
conditions applicable to the same site of the variance that do not
apply generally to other properties in the same zone.
c. The strict interpretation or enforcement of the specilied regulation
would deprive the applicant of privileges enjoyed by the owners
of other properties in lhe same district.
V. STAFF RECOMMENDATION
The staff is recommending denial of the applicant's request for a site coverage variance. We
do not believe that it meets the criteria or the findings. Specifically, Finding Bl is not met as it
is our belief that a variance would be a grant of special privilege, inconsistent with the
limitations on the other properties in the Two-Family Residential zone district. Finding 83 is
not met in that there are no exceptions or extraordinary circumstances that would not apply
generally to other properties in the Two-Family Residential zone district. Additionally, the staff
has been unable to identify a physical hardship to support a site coverage variance request.
lf the Planning and Environmental Commission approves this request, staff recommends that
the applicant be required to plant three 2-inch caliper aspen trees to the west of the addition.
Please note that, under Section 18.62.080 of the Town of Vail Zoning Code, the approval shall
lapse if construction is not commenced within two years of the date of issuance and diligently
pursued to completion.

B. The review process for NEw BUILDINGS normally requires
two separat.e meetings of the Design Review Board: a
concepLual approval and a final approval . Applicants
should plan on presenting their development proposal at a minimum of two meetings before obtaining final
approval.
C. Applicants who fail to appear before the Design Review
Board on their scheduled meeting date and who have not
asked in advance that discussion on their iten be
postponed, will have their items removed from the DRB
docket until such time as the item has been
republished.
D. The fol-lowing items may, at the discretion of the
zoning administrator, be approved by lhe Community
Development Department staff (i.e. a formal hearing
before the DRB nay not be required):
a. Windows, skylights and sinilar exterior changes
which do not alter the existing plane of t,he
building; and
b. Building addition proposals not visible from any
other lot or public space, At the time such a proposal is submitted, applicants must include letters from adjacent property owners and/or from the agent for or manager of any adjacent
condominium association stating the association
approves of the addition
E. If a property is located in a napped hazard area (i.e.
snow avalanche, rockfall, flood plain, debris flow,
wetland, etc) r a hazard study must be submitted and the
owner must sign an affidavit recognizing the hazard
report prior to the issuance of a building permit.
Applicants are encouraged to check with a Tohtn Planner prior to DRB application to determine the relationship
of the property to afl mapped hazards.
F. For al-I residential construction:
a. Clearly indicate on the ffoor plans the inside
face of the exterior structural walls of the
building; and
b. Indicate with a dashed fine on the site plan a
four foot distance from the exterior face of the
building waLls or suPporting columns.
If DRB approves the application with conditions or
modlfications, all conditions of approval must be
resolved prior to Town issuance of a building permit.
