The rock wall on the north side, which was to high, now has a planter at its foot. This is in compliance with the original drawings and all Town regulations. lhave provided a sketch and letter from LKP engineering regarding the structural integrit',, of this wall. ft was also discovered that a 10 foot section of the concrete drive was in excess of 12o/o. Depending on the angles and radii used the results varied lrom 12.9o/o to 15%. I was able to get Peak Land Surveying out yesterday afternoon to reshoot the area in question and they have provided a more accurate drawing showing the area in question to be 11.77o/o. I believe these items should satisfy the concerns of the public works department. Thank you for your time. DESCRIPTION OF THE REQUEST Special Development District #34 was approved by the Town Council in February of 'l997, allowing for the subdivision of Lots 3 and 4 of The Valley Phase 5 into 3 lots (Lots A, B, and C.) Due to a computer error, the building envelope was placed incorrectly on Lot B. To correct the siluation, the applicant is requesting a resubdivision of Lot B. The only change is the location of the building envelope. The corrected plat corresponds with all previous approvals of the ForkeniLindstrom Residence. II. DEVELOPMENT STANDARDS Below are the development standards prescribed by Special Development District #34: Development Standard Maximum Allowance or Limitation Number of Lots 3 sinqlejamily lots Dwellinq Units 3 dwelling units Density 1.66 dwellino units per acre Employee Housing Unit 1 type ll required prior to, dwellinq EHU per lot allowed. MINOR SUBDIVISION CRITERIA A basic premise of subdivision regulations is that the minimum standards for the creation of a new lot must be met. This subdivision will be reviewed under Title 13, Subdivision Regulations, of the Town of Vail Municipal Code. A. The first set of criteria to be considered by the Planning and Environmental Commission for a Minor Subdivision application is: Lot Area: The lot size standards as prescribed by SDD #34 Staff Response: As proposed, this minor subdivision meets this requirement. Frontage: The Subdivision Regulations require a minimum Street Frontage of 30'. Staff Response: As proposed, this minor subdivision meets this requirement. B. The second set of criteria to be considered with a Minor Subdivision application, as outlined in the subdivision regulations, is: "The burden of proof shall rest with the applicant to show that the application is in compliance with the intent and purposes of this Chapter, the Zoning Ordinance and other pertinent regulations that the Planning and Environmental Commission deems applicable. Due consideration shall be given to the recommendations made by public agencies, utility companies and other agencies consulted under subsection 13-3-3C. The Planning and Environmental Commission shall review the application and consider its appropriateness in regard to Town policies relating to subdivision control, densities proposed, regulations, ordinances and resolutions and other applicable documents, environmental integrity and compatibility with the surrounding land uses and other applicable documents, effects on the aesthetics of the Town." The Specific Purpose of the Subdivision Regulations is as tollows: 1. To inform each subdivider of the standards and criteria by which development proposals will be evaluated, and lo provide information as to the type and extent ol improvements required. Staff Response: The review of this request has followed the regulations prescribed for minor subdivision in the Municipal Code. 2. To provide for the subdivision of property in the future without conflict with development on adjacent land. Staft Response: Staff believes that this resubdivision will not conflict with development on adjacent properties. 3. To protect and conserve the value of land throughout the Municipality and the value of buildings and improvements on the land. SfaffPesponse: Staff does not believe that the request will have a negative impact of the value of land in the Town of Vail generally, nor in the immediate area. 4. To ensure that subdivision of property is in compliance with the Town's zoning ordinances, to achieve a harmonious, convenient, workable relationship among land uses, consistent with Town development objectives. Staff Responre: The resubdivision meets the minimum zoning requirements of SDD #34. 5. To guide public and private policy and action in order to provide adequate and efficient transportation, water, sewage, schools, parks, playgrounds, recreation, and other public requirements and facilities and generally to provide that public facilities will have sufficient capacity to serve the proposed subdivision. Staff Response: The resubdivision will have no additional effects on the above criterion. 6. To provide for accurate legal descriptions of newly subdivided land and to establish reasonable and desirable construction design standards and procedures. Statf Response: Because this resubdivision is necessary to correct a mistake on an existing plat, the resuMivision will provide for a more accurate legal description of the subdivided land. 7. To prevent the pollution of air, streams and ponds, to assure adequacy of drainage facilities, to safeguard the water table and to encourage the wise use and management of natural resources throughout the Town in order to preserve the integrity, stability and beauty of the community and the value of the land. Staff Response: Staff does not believe that the resubdivision will have any adverse effects on the above criterion. lV. A description of all survey monuments, both found and set, which mark the boundaries of the subdivision, and a description of all monuments used in conducting the survey. Monument perimeter per Colorado statutes. Two perimeter monuments shall be established as major control monuments, the materials which shall be determined by the town engineer. A statement by the land surveyor explaining how bearing base was determined. A certificate by the registered land surveyor as outlined in Chapter 17.32 of this title as to the accuracy of the survey and plat, and that the survey was performed by him in accordance with Colorado Revised Statutes 1973, Title 38, Article 51 . A certificate by an attorney admitted to practice in the State of Colorado, or corporate title insurer, that the owner(s) of record dedicating to the public the public right-of-way, areas or facilities as shown thereon are the owners thereof in fee simple, free and clear of all liens and encumbrances except as noted. (See example in Chapter 17.32) The proper form for approval of the plat by the PEC chairman and acceptance of dedication and easements by the council with signature by the mayor and attestation by the town clerk. Operation: The Central Residential Optima Concealed Sprinkler absorbs heat through the ceiling cover plate which is soldered to the adjustable retainer ring with a fusible alloy. At the rated temperature, the alloy fuses, resulting in the plate dropping away from lhe sprinkler. For custom painted finishes, the customer must furnish a quick-drying paint, preferably lacquer-based, to ensure proper color duplication. One quart of paint is required for each 200 plates. c,f}lnstallation The Central Model ROC Residential OptimarM Concealed Sprinkler must be installed in conlormance with cunent NFPA 13, NFPA 13D and NFPA 13R Standards. Deviations from these requirements and stan- dards, or any alteration to the sprin- kler assembly itself will void any warranty made by Central Sprinkler Company. In addilion, installation must also meet local governmenl provisions, codes and standards, as applicable. The system piping must be prop- erly sized to ensure the minrmum required flow rate at the sprinkler. Check for the proper model, style, orifice size and temperature rating prior to installation. Install sprinklers after the piping is in place to avoid mechanical damage; replace any /^. damaged units. Wet pipe systems tt_ must be protected from freezing. Upon completion of the installation, the system must be tested per recognized standards. In the event of a thread leak, remove the unit, apply new pipe joint compound or tape, and reinstall. Installation Sequence Step 1. The unit must be installed in the pendent position. Step 2. The face of the sprinkler fitting should be installed a nominal 2" (x'/i') behind the finished ceiling line. Adjustments, to compensate for variations in fitting face to ceiling height, may be made by threading the cover plate retainer in and out of the unit's support cup. Step 3. Use only a non-hardening pipe joint compound, or Tellon- tape. Apply only to the male threads. Step 4. Hand tighten the sprinkler into the fitting. Avoid making contact with the deflector when using the Central Sprinkler OptimarM Con- cealed Wrench to tighten the unit into the fitting. The wrench is designed to mate with the body's wrench bosses. 'Tetlon is a tradomark ot the DuPont Corp. inside the threaded support cup. A leak tight joint requires a only 7 to 14 fl. lbs. of torque. Torque levels greater than 21 tt. lbs. may distort the orifice seal, resulting in leakage. Step 5. After initial installation and before the cover plate is installed, cover the sprinkler with the special plastic protective cap. The cap is specially designed to not only protect the sprinkler, but allow the ceiling installers to locate the sprinkler by pressing the ceiling board up against it. The end of the cap has a special tip. therefore leaving an impression in the ceiling board for the location of the sprinkler. Care should be taken to only press the ceiling lightly against the cap as excessive pressure will damage the sprinkler. This cap must be removed for the sorinkler to iunction correctly. Step 6. To install the ceiling cover plate, manually thread the cover retainer into the support cup. Con- tinue threading until the cover retainers flange rests against the surface of the ceiling. Caution: Special care must be taken when installing wilh a CPVC system. Sprinklers must be installed aiter the manufacturer's recommended setting time for the primer and cement to ensure that neither accumulale within the sprinkler. Special care must be taken when installing with a copper system. These devices may be used as sectional f low indicators on large sprinkler systems and on smaller sprinkler systems such as mobile homes and residential dwellings. INSTALLATION: These devices may be mounted in horizontal or vertical pipe. On horizontal pipe they should be installed on the top side of the pipe where they will be accessible. The units should not be installed within 6" of a valve, drain or fitting which changes the direction ol the vraler flow. The unit has a 1" NPT bushing for threading into a non- corrosive TEE. See Fig.2 tor proper TEE size, type and installation. Screw the device into the TEE fitting as shown in Fig.2. Care must be taken to properly orienl the device tor the direction of waterflow. The vane must not rub the inside of the TEE or bind in any way. The slem should move freely when operated by hand. The Town shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or damage happening or occurring to the work specified in this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any officer or employee thereot, be liable for any persons or property injured by reason of the nature o{ said work, but all ot said liabilities shall and are hereby assumed by the Developer. The Developer hereby agrees to indemnify and hold harmless the Town, and any of its officers, agents and employees against any losses, claims, damages, or liabilities to which the Town or any ol its officers, agents or employees may become subject to, insofar as any such losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are based upon any performance by the Developer hereunder; and the Developer shall reimburse the Town for any and all legal or other expenses reasonably incurred by the Town in connection with investigating or defending any such loss, claim, damage, liability or action. This indemnity provision shall be in addition to any other liability which the Developer may nave. 5. lt is mutually agreed that the Developer may apply to the Town and the Town shall authorize lor partial release of the collateral deposited with the Town for each category of improvement at such time as such improvements are constructed in compliance with all plans and specilications as referenced hereunder and accepted by the Town. Under no condition will the amount of the collateral that is beino held be reduced below tne amount necessary to complete such improvements. 6. lf the Town determines that any of the improvements contemplated herein are not constructed in compliance with the plans and specilications set forth herein by the date set forth in paragraph 2, the Town may, but shall not be required to, withdraw from the cash deposit such funds as may be necessary to complete the unfinished improvements. The Town shall release such funds upon the written request of the staff of the Community Development Department stating that the improvements have not been completed as required by the agreement. The Town shall not require the concurrence of the developer prior to the release of the funds, nor shall the Town be required to verify independently that the improvements have not been completed as required by this Agreement, but shall release such funds solely upon the request of the Community Development Department. lf the costs of completing the work exceed the amount of the deposit, the excess, together with interest at twelve percent per annum, shall be a lien against the propefi and may be collected by civil suit or may be certified to the treasurer of Eagfe County to be collected in the same manner as delinquent ad valorem taxes levied against such property. lf the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this chapter, such failure or refusal shall be considered a violation of the Zoning Code. 7. The Developer warrants all work and material for a period of one year after acceptance of all work referred to in this Agreement by the Town pursuant to Section 17.16.250 if such work is located on Town of Vail property or within Town of Vail right-of-way. 8. During construction, when we bring water and sewer across, we will bury a conduit to provide cable service. lf this is not acceptable to TCI Cable, a satellite system will be used. Regarding ltem 5, we have submitted a stamped survey of this site but without spot elevations at 10' increments along the edge of pavement. We are proposing to update the survey with the 10' spot elevations at the same time as field work is done for the plat, which we estimate to occur sometime in the next two weeks.
