This letter is being provided in response to a request to confirm an analysis of the GRFA
remaining for 3964 Bighorn Road. For this analysis I am utilizing information provide to
me by Jeff Manley in a letter dated September 30, 2009. My analysis assumes that Mr.
Manley as performed the GRFA analysis based upon an accurate lot size and from floor
plans which represent existing conditions on the site. Mr. Manley's letter assumes the
splitting of all allowable development potential in half for each side. lt should be noted
that there is no requirement to split development potential in half for a duplex. lt is up to
the owners of the duplex structure to determine how development potential will be split.
Within the Town of Vail development potential for a duplex property is based upon the
entirety of the duplex property. Any application to utilize development potential requires
they approval of both property owners on all applications. Please be aware that a site
specific survey and a complete set of plan would be required in conjunction with any
development application to confirm this analysis.

Land Use Plan Designation: Low Density Residential
Current Land Use; Residential Duplex
Development Site Size: 23,337 sq. ft. (0.535 acres)Hazards: 100-year Floodplain on rear of lot per Town of Vail GIS and

Density, GRFA (max):7,583.8 sq. ft. plus up to a 600 s.f. garage per unit and any
subterranean basement per Section 12-15-3(6), Definition,
Calculation, and Exclusions, vail Town Code
Per Mr. Manley's letter it appears that 5,092 square feet of
GRFA are constructed on the property. This would result
in 2,491.8 square feet remaining. This GRFA can be split
however ihe property owners see fit.

It appears that there is GRFA available for the expansion of the structure on the lot. Any
expansion will need to conform to all requirements of Title 12, Zoning, Vail Town Code. I

A. Unlawfrrl deposits: Subject to subsection C thereof, it is unlawful for any person to litter,
track or deposit, or cause to be littered, tracked or deposite4 san4 gravel, rocks, mu{ dirt,
snow, ice, or any other debris or material upon .ny street, sidewalk, alley or public place, or
any portion thereof.g. l.lotite; Abatement: The Director of Public Works may notifu and require any person who
violates or c:r$es another to violate the provision of subsection A hereof, or who has in the
Director's employment a person who violates or c{luses another to violate the same, top
remove such sand, gravel, rocks, mud, dirt snow, ice or any other debris or material within
twenty fow (24) hours after receip of said notice by the Direclor of Public Works. In the
event the person so notified does not comply with the notice within the period of time herein
specified, the Director of Public Worj<s, or other authorized agent, nrry cause any such sand,
gravel, rocks, mud, dir! snow, ice, debris or any other material to be removed from any street
or alley at the expense ofthe notified.
C. Exceptions: The provisions of subsection A hereof shall not be applicable :
l. withh the immediate area of any construction, maintenance or repair project of any
street or alley or of any water main, sewer main, electricity line, gas line, telephone line
or any apputenance thereto;
2. To deposits of san4 dirt or materials necessary for the protection ofthe public safety; and
3. To public areas designaied for the dumping or depositing of said matErials.
D. Summons; Penalty: As an altemative to the notice for removal provided in subsection B
above, any
person who violates or'causes another to viOlate the same, may be issued a summons to
appear before the Municipal Court of the Town for said violations, and upon being found
guilty ofa violation hereunder be punished as provided in Section 1-4-l ofthis code.
E. Notiie; Penalty: It is unlawful for any person to fril or refuse to comPly with the notice of
the
Director of Public Works as provided in subsection B hereof, and any such person shall, in
addition to payment of the expense of removal incurred by the Director of Public Works, as
provided in subsection B hereo{ upon being found guilty ofa violation hereunder, be
punishable as provided in Section l-4-l ofthis Code. (1997 Code: Ordinance 6 (1979)

If this permit requires a Town of Vail Fire Departrnent Approval, Engineer's (Public Works)
review and approval, a Planniug Depar[nent rwiew of Health Deparhnent review, and a reyiew
by the Building Deparbnent, the estimated time for a total review may take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lcsscr amount of
time. However, if residential or smaller projects impact the various above mentioned
deparhnents with regard to necessaxy review, these projects may also take the three (3) week
period.
Every attempt will be made by this deparbnent to expedite this permit as soon as possible.
I, the undersigned, understand the Plan Check procedure and time frame. I also understand that if
the permit is not picked up by the expiration date, that I must still pay the Plan Check Fee and
that if I fail to do so it may affect future permits that I apply for.

SCOPE
. This report presents the results of a soils and Foundation
Investlgatlon for the proposed duplex located on Lot 5, Gore
Creek Park, Vail, Colorado. The Investigation was prepared
by means of test pits and laboratory testing of samples obtained
from these pits.
This investigation presents a description of surface
and subsurface conditions encountered at the site, recommended
foundation systems, al lowable design pressures, and groundwater
conditlons as well as design and construction crlteria lnfluenced
by the subsoils.
The site is located on Lot 5, Gore Creek park
Vail, Eagle County, Colorado. The site drains to
toward Gore Creek. The property had been cleared
at the time of the field investigation. Adjacent

SITE I1{VESTIGATIOI{
The field lnvestigation performed on Aprll 15' 1983'
consisted of excavating, logglng, and sampling two test pits.
The locations of the test plts are shown on Drawing No. 1.
Summaries of the test pit logs are detailed on Figures l{o. I
and 2. A sunmary of the test results is shown on Flgure No. 3.
The test pits rere excavated with a conventional backhoe.
SUBSURFACE AND GROUNDXATER CONDITIONS
Refer to the summary of test pits ' Figures l'lo. 1 and 2.
Subsurface conditlons are fairly uniform, with very organic
topsoil to a depth of 1 to 3 feet, underlain by sand, grave'l ,
cobbl es and boul ders .
Free groundwater was encountered in both test pits.
Depths of the groundwater range from 3.5 to 4 feet below the
exi sting ground surface.
PROPOSED CONSTRUCTION
lle understand that the proposed duplex will consist of
a two-story structure, uti lizing wood frame type of construction.

SLAB CONSTRUCTION
The sand, gravel and cobble natural soils (not including
topsoil ) will provide adequate support for slab-on-grade
construction. If clean, granular soils are imported to be
used as select fill no problem with capillary rise of moisture
wi'l I occur. However, i f the sel ect f i'l I contai ns some cl ays
or fine materials there is always the possibility of capillary
rise of moisture.
l{e suggest that the plans and specifications be prepared
with a specified minimum of 4 inches of clean, washed gravel
immediately under the floor slabs. The purpose of this clean,
washed material is to break capillary rise of moisture to
avoid problems with bonding of asphalt tiles t'o floor slabs
and other problems associated with minor amounts of moisture.
lJe suggest densifying the surface of fi'll or natura'l
soils wlth a vibratory type compactor immediately prior to

placement of floor slabs. slabs should be constructed in accor-
dance with ACI recommendations to mlnl'mize the risk of shrinkage
problems. Slabs should be scored into maximum 200 square
foot areas to locallze and control any cracking.
GROUI{DI.'ATER AND DRAIN SYSTEM
Free water was found in both test pits at depths ranging
from 3.5 to 4 feet. Because of the re.ldively high.groundwater
level ' some difficulty during excavation and construction of
the proposed sha'llow foundations is anticipated.
An extensi ve gravi ty drai nage sys tem, wel I poi nts , or
other comprehensive dewatering procedures should be used to
dewater the site for construction, and to divert subsurface
flows from the building.
A peripheral drain system as detailed on Figure No. 4
shou'ld be installed.

SURFACE DRAINAGE
Surface yJater running toward the structure from upslope
areas should be diverted around and away from the building
by means of drainage svrales or other similar measures.
The final grade should have a positive slope away from
' the foundation wal'ls on all sides. A minimun of 12 inches
in the first ten feet is recommended. Downspouts and slll,
cocks should discharge into splash blocks that extend beyond
' the limits of the backflll. splash blocks should slope from
the foundation walls. The use of long downspout extensionst
in place of splash blocks is advisable.

porches or patio slabs. If sprinkler systens are instal led,
the sprinkler heads should be placed so that the spray from
the heads, under full pressure, does not fall wlthin five
feet of foundatlon walls, porches or patio slabs. Lawn irr.i-
gation must be control led.
If the future owners desine to plant next to foundation
walls, porches or patio slabs, and are wllling to assume the
risk of structural damage, etc., then it is advisable to p'l ant
on'l y flowers and shrubbery (no lawn) of varieties 'that require
very little moisture. These flowers and shrubs should be
hand-watered only.
I{ISCELLANEOUS
Some of the soils at the site are potentially consolidating
and the owners shou'l d be cautioned that there is some risk
of future damage. The contractor is directed to those items
covered under EAcKFILL AND suRFAcE DRAINAGE and LAl,tN IRRIGATIoN.
0ur experience has shown that damage due to swelling or conso-
lidating soi'ls usually resu'lts from saturation of the foundation
soils caused by improper drainage, excessive irrigatlon, and
poorly consolidated backfills. The elimination of the potential
sources of excessive water wi I I greatly mi nimi ze the risks
of construction of this site.

Fursuant to our telephone conversation on April 18, 19p3, we have
examined the location of the Gore Creek 100-year floodplain relativeto tln above referenced property. Reference materials included a
topographic survey map prepared by Johnson & Kunkel Associates dated
January 20, t982, an architectura'l site plan by Peel/Warren dated
March 21, 1983 and the "Gore Creek Floodplain Information" report
prepared by Hydro-Triad, Ltd. for the Colorado Water Conservation Board
and the Town of Vail, dated June, 1975. Elevations for both the flood-
pla'i n report and the site topography are based on United States 0eolo-g'ical Survey datum.
Corparison of the site topography and location with the floodplain
report indicates that the 100-year f'loodplain boundary shown on the
two site drawings corresponds relatively we1 I to the boundary shown in
the referenced floodplain report. Also, the 100-year floodplain e'leva-
tions shown on the two site drawings range from approximately 8370 feet +
to 8371 feet + which are consistent with those indicated in.the floodp'lain
report.
The proposed dwelling unit shown on the reference Peel/l'larren site
plan is'located outside of the identified Gore Creek 100-year floodplain
boundary. It should be noted however, that construction within the Gore
Creek floodplain subsequent to construction of this proJect may or may
not have altered the floodplain boundaries. This information could best
be obtained fron the Tovm of Vail.
