if this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Departmenf the estimated time for a total review will take as long as three (3)
weel(s.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMTT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Aoolication.
If yes was answered to any of the questions then a "Public Way" permit is required. you
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some uUlity companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter, Be aware that your resubmission ior winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for reuie*. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building PermiY'.
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKS!
Please read and check off each of the items below:
a The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Depaftment for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2798 to request an inspection from
the Public Works Depaftment. Allow a minimum of 24 hour notice.
n Also, the Town of Vail Public Works Department will be approving all final drainage
and culveft installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Cedificate of Occupancy issuance.

Unlawful deposits: Subject to subsection C thereof, it is unlawful for any pe!'son to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
Notice; Abatement: The Director of Public Works may noilry and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or cruses another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rock, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
D Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).

amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

EXECUTIVE SUMMARY
l. Due to a higb ground water table within the proposed
building fooprint, ground water dewatering must be
done fint, to provide firm, and suitable base for the
foundation.

Eagle county, colorado. The purpose of the subsurface soil and for:ndation investigation was to
determine the engineering characteristics of the foundation soil and to provide recommendations
for the foundation design, grading, and drainage'
SITE DESCRIPTION
Lot 14 is on the north side of the road, at 5133 Kel-Gar Lane, offBlack Gore Drive in
EastVail,EagleCounty,Colorado.Thetopographyofthesiteismoderatetoflat.Drainageisto
the north and northwest. Vegetation on the lot consisted ofpine, aspens' bushes, and shrubs'
Gore creek runs througb the rear of the lot, and two ditches run along the properly line between
Lot 14 and 15. Lot 14 is vacant'
PROPOSED CONSTRUCTION
We have assrrmed that the proposed residence will consist of two stories, wood frame
construction, with a concrete foundation' and without abasement' We anticipate loads to be
light, typical of residential construction'
If the finalized plans differ significantly from the above understanding' they should noti!
us to reevaluate the recommendations of this riport'
tr.IELD INVESTIGATION
The field investigation conducted on June 13,2000, consisted ofexcavating' logging and
sampliag turo test pits. Excavations of the test pits were done with a case 580 Super K rubber-
tirc backboe. The test pits, locations are shown on Drawing No. l. We show the soil profile of
thetestpitsontheSubzurfaceExplorationLogs,FigureNo'sland2.Soilsamplesfor
laboratory soil analysis and observation werc taken at sel€cted intervals'

SUBST'RFACE SOIL AND GROIJNDWATER CONDITION
The soil profiles encountered in the test pits were fairly uniform' Test Pit No'l had 3 feet
of topsoil over 2 feet of brown, sandy gravel with cobbles and boulders' Test Pit No'2 had 2 feet
of topsoil, over 3 feet of reddish-brown, silty sand with cobbles over 3 feet of light brown'
gravelly-sand with cobbles and boulders over one foot oflight reddish-brown, fine, silty-sand'
Ground water was encountered in both test pits at 3 feet and 7 feet respectively'
we sampled the soil in the test pits at random intervals. The soil samples were tested in
our laboratory for swell-consolidation, natural moisture content, natural dry density and grain-
size distribution' The test results are shown on Figure No's 3 and 4'
FOI]NDATION RECOMMENDATIONS
Due to the high grouud water elevationexteme care should be taken during the design,
and the constnrction stages on this lot, The first step should be to dewater the site by constructing
a drain, as shown on Figrue No. 6. The drain should be corstructed from the uphill part of the
proposed residence, around the building, and to a daylight location on the downhill side ofthe
lot. The invert of the drain in the interceptor drain should be a minimum of two feet below the
lowest footing elevation. The drain pipe shoutd be sloped to a dayligbt location away from the
foundation and the backfill.

foundation stepped with the slope of.the lot. The proposed residence should be supported with

the gravel fill will depend on the size of the footings, as shown on Figure No' 7' The part of the
foundation on the upper part of the lot, can also, be supported with helical or strait shaft piers' To
provide recommendations for the strait shaft piers, additional sol investigation with a drill rig
will be necessary.

The ground water elevation can vary, and it is possible it will rise as high as the proposed
foundation.Aminimrrmoftwofeetofseparationshouldbemaintainedbetweentheground
water and the bottom of the footings. The high ground water elevation can iinpact the
foundation bearing soils. After the c6nstruction of the inte'rceptor drain, it will take time to drain
the water out of the foundation soils. Improvement of the foundation soils might still be
necessary, before the gravel frll can be constucted. The proposed foundation gfade might be too
yielding for the placement of the footings. The.yielding bearing soils can be improved by
placement of cobble size rocks into the soil and running over with light equipment until firm
base is achieved. If this method does not improve the bearing subgrade, the helical per
alternativeshouldbeused,orweshouldbecontactedforadditionaltestingand
recommendations. we recommend an underdrain behind every step in the foundation' we also
recommend two feet of gravel under the slab on gmde areas. The gravel should be connected
with the perimeter drains. More detailed recommendations for the underdrain system can be
provided once the foundation and grading plans are completed'
Abasementisnotrecomrnendedforthissiteduetothehighgroundwatertableandsoft
soils. We recommend minimum widttr of 16 inches for the continuous footings and 2 feet for the
isolated footing pads. Continuous foundation walls should be reinforced top and bottom to span
an unsupported length ofat least l0 feet'
We recommend aminimum of 48 inches of backfill cover for fiost protection of the
footing subsoils. The foundation excsvation should be obsemed by the undersigned engineer to
verify that the soil conditiora encountered during construction are as anticipated in this report'
The foundation excavation should be free from excavation spoils, frost, organics and standing
water. we recommend proof-rolling of the foundation excavation with light equipment on
tracks. Heavy equipment can bring up the moisture from the underlaying soils and create soft and
unsuitable base for the foundation. soft spots detected during the proof-rolling, should be
removed by overexcavation. Any overexcavation within the proposed foundation' should be
backfilled, with clean, crushed rock'

depth to suitable bearing soil for the piers'
SLAB CONSTRUCTION
crawl space is recommended for this sitc' If slab-on-grade is constructed, it should also'
be consEucted over a bed of clean gravel, with minimum thickness of 2 feet' The concrete slab
should be constructed over a 2-foot layer ofclean gravel consistingof'314 inch gravel with at
least 50Zo retained on the No. 4 sieve and tess than 3 percent passing the No- 200 sieve' The
underslabgravelshouldbeconnectedwiththegravelfortheperimeterdrain.'
They should reinforce the concrete slab-on'grade and score conholjoints according to 'the
American Concrete Institute requirements and per the recommendations of the designer to reduce
damage due to shrinkage. The concrete slab should be separated from the foundation walls and
columns with expansion joints to allow for independent movement without causing damage'
RETAINING WALLS
Foundation walls retaining eartfr and retaining structures that are laterally supported
should be designed to resist an equivalent fluid density of60 pcffor an "at-rest" condition'
Laterally unrestrained structures, retaining the on-sitc earth, should be desigrred to resist an
equivalent fluid density of40 pcf for the "active" case'
The above design recommendations arisume drained backfill conditions and a horizontal
backfill surface. Surcharge loading due to adjacent structures, weight oftemporary stored
construction materials and equipment, inclined bsckfill arrd hydrostatic pressure due to
undrained backfill should be incorporated in the design' They sbould try to prevent the buildup
ofhydrostatic pressure behind the retaining wall'

LAWNIRRICATION
It is not recommended to introduce exc€ss water to the foundation soils by installing
sprinkler systems next to the building, The installation of the sprinkler heads should insure that
the spray from the heads witl not fall within l0 feet of formdation walls, porches or patio slabs.
Lawn irrigation must be controlled.

Engineering standards for similar methods of testing and soil conditions at this time. There is no
other warranty either expressed or implied.
The findings and recommen{ations of this report are based on field exploration,
laboratory testing of samples obtained at the specific locations shown on the Location Sketch,
Drawing No.l and on assrunptions stated in the report. Soil conditions at other locations may
vary, which may not become evident until the foundation excavation is completed' If soil or
water conditions seem different from those described in this report we should be contacted
immediately to reevaluate the recommendations of this report.

At its June 26th meeting, the Town ol Vail Planning and Environmental Commission
(PEC) approved the application for a variance at the above-referenced property to allow
lor the construclion of a single{amily residence within required front and side setbacks.
At its June 21"tmeeting, the Town of Vail Design Review Board (DRB) conceptually
reviewed the design review application for this property. The design was well received
by the DRB and their only request was to see a detailed landscape plan at final DRB
review on July 5th.
The following items are necessary for staff review prior to tinal DRB approval:

DESCRIPTION OF THE REOUEST
The subject property is a non-conforming lot (platted in 1969) containing a signilicant
amount of wetlands. Earlier this year, the U.S. Army Corps of Engineers approved a permit
to allow for the construction of a single-family residence on Lot 14. This permit
acknowledges lhe residence will permanently impact 4'14 square feet of wetlands and will
lemporarily impact (due to construction) 1,396 square feet of wetlands. However, the Corps
of Engineers found the applicant has "worked to reduce wetland impacts to the maximum
extent possible." This reduction involves the location of the house on the upland portion of
the property with an encroachment into required lront and side setbacks. Therefore,
pursuant to Chapter 12-17,Yail Town Code, a variance has been requested.
STAFF RECOMMENDATION
The Community Development Department recommends approval of the requested setback
variances subject to the following findings:
1. That the granting of the setback variances does not constitute a grant of special
privilege inconsistent with the limitations on other properties in the Two{amily
Residential Zone District.
2. That the strict literal interpretation or enforcemenl of the setback regulations results
in a practical difficulty or unnecessary physical hardship inconsistent with the
development objectives of the Municipal Code or the Two-family Residential Zone
District.
3. There are exceptions or extraordinary circumstances or conditions applicable to the
applicant's property that do not apply generally to other properties in the Two{amily
Residential Zone District.
Should the PEC choose to approve this request, the Community Development Department
recommends the following condilion:
1. Wetland and stream bank mitigation shall occur In accordance with the
requiremenls by the U.S. Army Corps of Engineers outlined in the Department of
Army letter dated May 26, 2000.
III. REVIEWING BOARD ROLES
The PEC is resoonsible for evaluatino a oroposal for:
1. The relationship of the requested variance to other existing or potential uses and
slructures in the vicinity.
2. The degree to which relief from the strict or literal interpretation and enforcement of a
specified regulation is necessary to achieve compatibility and uniformity of treatment
among sites in the vicinity, or lo attain the objectives of this Title without grant of special
privilege.
3. The effect ol the requesled variance on light and air, distribution of population,
transportation and tratfic facililies, public facilities and utilities, and public safety.
4. Such other factors and criteria as the Commission deems applicable to the proposed
variance.

Consideration of Factors Reoardino the Setback Variances:
The relationship of the requested variance to other existing or potential
uses and structures in the vicinity.
The proposal is for the construction of a single-family residence. Adjacent
struclures include single{amily, two{amily and multi-family residences.
Staff believes the proposed use and structure are consislent with adjacent
uses and slructures as well as lhe objectives outlined for the Two{amily
Residential zone district. The bulk and mass proposed for this structure is
less than the existing bulk and mass presenl on adjacent structures. The
applicant has pulled all upper-level GRFA out of the side setback.
Therefore, only the proposed main-level garage would encroach into the
required side setback (above grade).
The degree to which relief from the strict and literal interpretalion and
enforcement of a specified regulatlon is necessary to achieve
compatibility and uniformity of treatment among sites in the vicinity or
to attain the obiectives of this tltle without a grant of special prlvilege.
This particular lot is constrained by a number of factors. Development is
being pushed towards the upland portion of the lot by the presence of
wetlands, the 100-year floodplain and the required Gore Creek setback.
Although this lot measures 12,451 .9 square feet in size, there is only about
850 square feet of buildable area within the required setbacks. Staff believes
these issues constitute a significant hardship for the owner and that
development of the lot by the strict interpretation of the code would be

impossible. Staff believes some relief is necessary in order to achieve
compatibility and uniformity of treatment among sites in the vicinity. Staff
believes the applicant has requested a reasonable (not excessive) deviation
from the Zoning Regulations. A number of adjacent properties in the
neighborhood are non-conforming with regard to setbacks.
3. The effect of the requested variance on light and air, distribution of
population, transportation and traffic facilities, public facilities and
utilities, and public safety.
Staff does not believe that there will be any negative impacts associated with
this proposal on the above-listed criteria.
The Plannino and Environmental Commission shall make the followino findinos before
orantino a variance:
1. That the granting of the variance will not constitute a grant of special privilege
inconsistent with the limitalions on other properties classified in the same
districl.
2- That the granting of the variance will not be detrimental 1o the public health,
safety or welfare, or materially injurious to properties or improvements in the
vicinity.
3. That the variance is warranted for one or more of the following reasons:

regulation would result in practical difficulty or unnecessary physical
hardship inconsistent with the objectives of this title.
There are exceptions or extraordinary circumstances or conditions
applicable lo the same site of the variance that do not apply generally

Dear PEC Board,
I am applying for a Front setback variance and a Side setback variance for the building of
a single family home at 5133 Black Bear Lane in East Vail (Lot 14 Gore Creek
Subdivision).
This lot is heavily affected by the Army Corps of Engineers Wet Land restrictions. The
lot size is 12,451.9Osq.ft. or.286 acres and all of east side and lower portion ofthe lot are
considered Wet Lands. The Army Corps of Engineers is requiring building in what they
designate as the Uplands area, which includes the front and side building setback areas.
If I take into account the Town of Vail's guidelines of the 20 foot front setback and l5
foot side setback then this Upland area becomes to small to build even the garage on the
remaining square footage.
I have met with Public Works and the Planning Department discussing the Town guide
lines and concerns with building a home in the setbacks. This house design has taken
into account all the zoning regulations that come into play such as; building no closer
than24 feet from the edge ofstreet payment, 100 year flood plan, 50 foot from center of
creek, no GRIA in the side setback, 33 foot height maximum, drainage easement and the
Wet Lands issues. I've reduced the home size to a minimum and strategically placed it so
that is works structurally, flow patterns work, roof lines, height is at maximum based on
existing grade and the neighbor impact was reduced.
I am applying to P.E.C. for your approval of building within 24 feet from the edge of
Black Bear street pavement, which equates to a l8 foot front setback variance. This is
mainly for the one level garage. One the West side I am requesting a 5 foot set back
variance also for the one level garage only. The placement of the home here is critical
mainly because of the Army Corps does not want me to impact the Wetlands any further.
I also get into a height problem with the grade dropping off9 feet as I move back on the
lot.
After meeting with the Army Corps of Engineers twice (Mike Claffey) in Grand Junction
I find trlned a plan that works with them which is the plan now presented to you. Mr.
Claffey gave me a verbal acceptance ofthe Wetlands inpact, but had interest of allowing
any further impacts from the house foundation. In proposing Plan B where we build the
home with in the normal setbacks the Army Corps found this unacceptable. The only
conclusion I could come to is to build in the Uplands Area in order to receive a
Nationwide Permit. Other environmental company's have studied this lot and reviewed it
with the Army Corps and have come to the sameconclusions as I present to you.
Other lots in the neighborhood along Gore Creek corridor have not gone under the same
stringent regulations that are in place now. The Army Corps considers Gore Creek
Corridor a more restrictive area in comparison to lots inland that are considered
Wetlands.
When taking into account all the Governing bodies, rules and design guide lines, I've
designed a very sound, attractive home that fits both the lot and today's architecture of
East Vail.
With regards to the effect on impacts of light, air, distribution of population,
transportatiorL traffic, utilities and public safety, I see no adverse effects from setback
variances of this home. In talking to the neighbors to the west who are mainly effected,
they said they would rather see a quality home built here rather than a lot that is a
neighborhood dump site.
With so few remaining lots in Vail, most ofthese lots are restrictive and difficult to build
on. I've lived and working in Vail for 2l years and I am sensitive to the balance between
development and the beauty of nature. I will be sensitive here to the site and I feel the
home designed is beautiful and will nicely nettle in on this lot.

above-relerenced application. Pursuant to the Design Review Board's July 5h approval,
please complete these revisions prior to your buibing permit submittal.
. No retaining walls should be located in the drainage easemenl. The easement
requires 10', the site plan shows 9'. The flow line of the revised drainage easement
may need to start at the culvert and it may require approval from the lot owners to
lhe east (in order to get the drainage easement away from the proposed home).
. Please show a "limits of disturbance" fence and some form of erosion control along
the stream and Gore Creek on your site plan.
. A revocable right of way permit and public way permit will be required at building
permit submittal.

The Corps of Engineers has issued a nationwide general permit authorizing minor discharges
of dredged or fill material into all waters of the United States provided that the activity
meets all of the following criteria:
a. The quantity of discharged material and the volume of excavated area does not
exceed 25 cubic yards below the plane of the ordinary high water mark or the high tide line;
b. The discharge, including any excavated area, will not cause the loss of more than
l/10 acre of a special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area and excavated area, plus special
aquatic sites that are adversely affected by flooding and special aquatic sites that are drained
so that they would no longer be a water of the United States as a result of the project;
c. If the discharge, including any excavated area, exceeds l0 cubic yards below the
plane of the ordinary high water mark or the high tide line, or the discharge is in a special
aquatic site, including wetlands, the permittee notifies the District engineer in accordance
with the "Notification" general condition. For discharges in special aquatic sites, including
wetlands, the notification must also include a delineation of affected special aquatic sites,
including wetlands. (AIso see 33 CFR 330.1(e)).
d. The discharge, including all attendant features, both temporary and permanent, is
part of a single and complete project and is not placed for the purpose of stream diversion.
e. This nationwide permit cannot be used in conjunction with NWP 26 for any
single and complete project.
A. GEI{ERAL CONDITIONS: The following general conditions must be met in order for
any authorization by a nationwide permit to Ue ialiO:
l. Navigation.' No activity may cause more than a minimal adverse effect on
navigation.
2. Proper Maintenance.' Any structure or fill authorized shall be properly
maintained, including maintenance to ensure public safety.
3. Erosion and Siltation Controls: Appropriate erosion and siltation controls must
be used and maintained in effective operating condition during construction, and all exposed
soil and other fills, as well as any work below the ordinary high water mark or high tide
line, must be permanently stabilized at the earliest practicable date.
4. Aquatic LiJe Movemenfs.' No activity may substantially disrupt the movement of
those species of aquatic life indigenous to the waterbody, including those species which
normally migrate through the area, unless the activity's primary purpose is to impound
water.
5. Equipmenf Heavy equipment working in wetlands must be placed on mats, or
other measures must be taken to minimize soil disturbance.
6. Regional anil Case-by-Case Conditions.' The activity must comply with any
regional conditions which may have been added by the Division Engineer (see 33 CFR
330.a(e)) and with any case-specific conditions added by the Corps or by the State or tribe
in its Section 401 water quality certification.
7. Wild and Scenic Riverc: No activity may occur in a component of the National
Wild and Scenic River System; or in a river officially designated by Congress as a "study
river" for possible inclusion in the system, while the river is in an official study status;
unless the appropriate Federal agency, with direct management responsibility for such river,
has determined in writing that the proposed activity will not adversely affect the Wild and
Scenic River designation, or study status. Information on Wild and Scenic Rivers may be
obtained from the appropriate Federal land management agency in the area (e.g. National
Park Service, U.S. Forest Service, Bureau of Land Management, U.S. Fish and Wildlife
Service).
8. Tribal Rights: No activity or its operation may impair reserved tribal rights,
including, but not limited to, reserved water rights and treaty fishing and hunting rights.
9. Water QuaIiE Ceftification: In certain states, an individual Section 401 water
quality certification must be obtained or waived. IN CALIFORNIA, CERTIFICATION
IS REQIIIRED. In Nevada, certification is required in Truckee and Carson River
Drainages. In Utah and Colorado, individual certification is NOT required (see 33 CFR
330.4(c)).
10. Coastal Zone Management: ln certain states, an individual state coastal zone
management consistency concuffence must be obtained or waived (see Section 330.4(d)).
lI. Endangered Species: (a) No activity is authorized under any nationwide permit
which is likely to jeopardize the continued existence of a threatened or endangered species
or a species proposed for such designation, as identified under the Federal Endangered
Species Act, or which is likely to destroy or adversely modify the critical habitat of such
species. Non-federal permittees shall notify the District Engineer if any listed species or
critical habitat might be affected or is in the vicinity of the project, and shall not begin work
on the activity until notified by the District Engineer that the requirements of the
Endangered Species Act have been satisfied and that the activity is authorized.
(b) Authorization of an activity by a nationwide permit does not authorize the "take"
of a threatened or endangered species as defined under the Federal Endangered Species Act.
In the absence of separate authorization (e .g. an ESA section 10 Permit, a Biological
Opinion with "incidental take" provisions, etc.) from the U.S. Fish and Wildlife Service or
the National Marine Fisheries Service, both lethal and non-lethal "takes" of protected species
are in violation of the Endangered Species Act. Information on the location of threatened
and endangered species can be obtained directly from the offices of the U.S. Fish and
Wildlife Service and National Marine Fisheries Service or thek world wide web pages at

12. Histoic Propefties: No activity which may affect historic properties listed, or
eligible for listing, in the National Register of Historic Places is authorized, until the District
Engineer has complied with the provisions of 33 CFR part 325, appendix C. The
prospective permittee must notify the District Engineer if the authorized activity may affect
any historic properties listed, determined to be eligible, or which the prospective permittee
has reason to believe may be eligible for listing on the National Register of Historic Places,
and shall not begin the activity until notified by the District Engineer that the requirements
of the National Historic Preservation Act have been satisfied and that the activity is
authorized. Information on the location and existence of historic resources can be obtained
from the State Historic Preservation Office and the National Reeister of Historic Places (see
33 CFR 330.4 (g)).
13. Notification:
(a) Timing: Where required by the terms of the NWP, the prospective permittee
must notify the District Engineer with a Pre-Construction Notification (PCN) as early as
possible and shall not begin the activity:
(1) Until notified by the District Engineer that the activity may proceed under
the NWP with any special conditions imposed by the District or Division Engineer; or
(2) If notified by the District or Division Engineer that an individual permit
is required; or
(3) Unless 30 days (or 45 days for NWP 26 orrly) have passed from the
District Engineer's receipt of the notification and the prospective permittee has not received
notice from the District or Division Engineer. Subsequently, the permittee's right to
proceed under the NWP may be modified, suspended, or revoked only in accordance with
the procedure set forth in 33 CFR 330.5(d)(2)).
(b) Contents of Notification.' The notification must be in writing and include the
following information:
(l) Name, address and telephone numbers of the prospective permittee;
(2) Location of the proposed project;
(3) Brief description of the proposed project; the project's purpose; direct and
indirect adverse environmental effects the project would cause; any other NWP(s), regional
general permit(s) or individual permit(s) used and intended to be used to authorize any part
of the proposed project or any related activity; and
(4) For NWP's 14, 18,21,26,29,34, and 38, the PCN must also include a
delineation of affected special aquatic sites, including wetlands (see paragraph 13(f));
(c) Form of Notiftcation.' The standard individual permit application form (Form
ENG 4345) may be used as the notification but must clearly indicate that it is a PCN and
must include all of the information required in (b) (l)-(a) of General Condition 13. A letter
mav also be used.
(d) District Engineer's Decision: In reviewing the pre-construction notification for
the plgposed. .activity, the District Engineer will determine whether the activity authorized by
the NWP will result in more than minimal individual or cumulative adverse environmental -
effects or may be contrary to the public interest. The prospective permittee may, optionally,
submit a proposed mitigation plan with the pre-construction notification to expedite ihe
proless and the District lngineer will consider any optional mitigation the applicant has
included in the proposal in determining whether the net adverse environmental effects of the
pr.oposed work are minimal. If the District Engineer determines that the activity complies
with the terms and conditions of the NWP and that the adverse effects are minimal, the
District Engineer will notify the permittee and include any conditions the DE deems
necessary.
Any mitigation proposal must be approved by the District Engineer prior to
commencing. work. . If the prospective permittee elects to submit a mitigatidn plan, the
District Engineer will expeilitiously review the proposed mitigation plan, but wilt not
cornmence a second 30-day (or 45-day for NWP 26) notification procedure. If the net
adverse effects of the project (with the mitigation proposal) are determined by the District
Eng-ineer to be minimal, the_District Engineer will provide a timely written response to the
applicant stating that the project can proceed under the terms and conditions of the
nationwide permit.
If the District Engineer determines that the adverse effects of the proposed work are
more-than minimal, then he will notify the applicant either: (l) That the project does not
qualify for authorization under the NWP and instruct the applicant on the froiedures to seek
authorization under an individual permit; (2) that the projeEf is authorized under the NWP
subject to the applicant's submitting a mitigation propbsal that would reduce the adverse
effects to the minimal level; or (3)-that the projeit id authorized under the NWp with
specific modifications or conditions
-(e) Agency Coordinotion: The District Engineer will consider any comments from
Federal and State agencies concerning the proposed-activity's compliance wittr ttre terms and
conditions of the NWPs and the need for mitigation to reduce the project's adverse
environmental effects to a minimal level.
_(D For NWP 14, ?1,26 (between one and three acres of impacr), 29,33,37,
and 38. The District Engineer will, upon receipt of a notification, provide imniediately,
e.g., facsimile_transmission, overnightmail or irther expeditious manner, a copy to the
appropriate gffi_""t o_f_the Fish and Wildlife Service, Stite natural resource or liater quality
3gen!Y, _EPA,.State Historic Preservation Officer (SHPO), and, if appropriate, ttre Nitionit
Marine Fisheries Service. With the exception of NWP j7, these agenciis wili then have
five.calendar.days from the date the mateiial is transmitted to telep-hone or fax the District
Engineer- notice that they intend to provide substantive, site-specifii comments. If so
contacted ty al aCJ-l!_y_, ^qe_qr-sl{icl Engineer will wait an additional 10 calendar days (16
galendar dayg !o1 NWP 26 PCNs) befort making a decision on the notification. Thi: District
Engineer will-fully comider agency comments rdceived within the specified time
tiame, but will provide no response to the resource agency. The District Engineer will
indicate in the administrative record associated with each notification that thelesource
agencies' concerns were considered. Applicants are encouraged to provide the Corpsmultiple copies of notifications to expeditt agency notificatioi.
- (ir)_ Optional Agency Coordination. For NWps 5, 7, 12, 13, I'7, lB, Zj, 31,
and.34, rvJrere a Regional Administrator of EPA, a Regional Director of USFWS, or a
Regional Director of NMFS has formally requested general notification from the District
Engineer for the activities covered by ariy of these Nwps the Corps will provide the
requesting agency with notification on the particular NWPs. How-ever, where the agencies
have a record- o_f__not _generally submitting substantive comments on activities coveret by
any. of these NWPs, the Corps district may discontinue providing notification to those '
regional agenc.y-offic9q.. The District Qrglrpgr will cooidinate iith the resources agencies
to identify which activitielinvgl_ving a PCN that the agencies will provide substanrivi
comm€nts to the Corps. The District Engineer may also request comments from the
agencies on a case-by-case basis when the District Engineer determines that such comments
would assist the Corps in reaching a decision whetheieffects are more than minimal either
individually or cumuiativelv.
.(iii) Optional Agency Coordination, 401 Denial. For NWp 26 only, where
the state has denied its 401 water quality certification for activities with less than irne acre of
wetland impact,.the EPA regional admiiristrator may request agency coordination of PCNs
between 1/3 and one acre. . The request may only ihclude acre-age iimitations within the 1/3t9 oll acre range for which the state has denied'water quality certification. In cases where
!!t:,Fpel$ requested co_or{ination of projects as described here, the Corps will forward thePCN to EPA only. The PCN will then be forwarded to the Fish and Wildlife Service andthe National Marine Fisherjqs--Seryi"-e b_y EPA under agreements among those agencies.
Any agency receivjng the PCN will be bound by the EPA timeframes ior provid'ing
comments to the corps.
(D Wetland Delineations: Wetland delineations must be prepared in accordancewith the current method required by_the Corps. For NWp 29 seti piragraph (b)(6)(iii) forparcels less than 0.5 acres in size. -Thepenirittee may ask the Corils tdOetindali itie ipecial
aquatic sitq. -T!e_re may-be some delay iTthe Corps does the delin6ation. Furthermore, the
30-day period (45 days for NWP 26) witl not stari until the wetland delineation has been
completed and submitted to the Corps, where appropriate.
. (g) -Mitigation: Factors that the District Engineer will consider when determining
the acceptability of appropriate and practicable mitifation include, but are not limited to:
(i) To be practicable-, the mitigation must be available and capable of being
done considering costs, existing technology, and logistics in tight of the oveiall project
purposes;
(ii) To the extent appropriate,.permittees should consider mitigation banking
and other. forms of mitigation includin! contributions to wetland trust funds, Yin lieu feei""toorganizations such as The Nature Conservancy, state or county nafural resource management
agencies, where such fees contribute to the reltoration, creatidn, replacement, enhanciment,or preservation of wetlands. Furthermore, examples of mitigation ihat may be appropriate '
and.practicable include, but are not limited to: Reducing thd size of the pioiect;^6sta'uiistrine
wetland or upland buffer zones to protect aquatic resourde values; ana reitading'ttt"lor*-oi"
3quatlc resource values by creating, restoring, and enhancing similar funitions -and values.In addition,. mitigation must.address wetlandimpacts, such a"s functions and values, and

cannot- be simply used to offset the acreage of rietland losses that would occur in order tomeet the acreage-limits of some of the NWps (e.g. for Nwp 26, five acres of wetlandscannot be created to change a six-acre loss of wet-lands to a one-acre loss; however, twocreated acres can be used to reduce the impacts of a three-acre loss).

not permanently restrict or impede the passage of normal or expected high flows or cause
the relocation of the water (unless the primary purpose of the fill is to impound waters).
7. Adverce Effects From Impoundments: If the discharge creates an impoundment
of water, adverse effects on the aquatic system caused by the accelerated passage of water
and/or the restriction of its flow shall be minimized to the maximum extent practicable.
8. Walerfowl Breeding Areas: Discharges into breeding areas for migratory
waterfowl must be avoided to the maximum extent practicable.
9. Removal of Temporary Fills: Any temporary fills must be removed in their
entirety and the affected areas returned to their preexisting elevation.
C. FI]RTHER INT'ORMATION:
1. District Engineers have the authority to determine if an activity complies with the
terms and conditions of a nationwide permit.
2. Nationwide permits do not obviate the need to obtain other Federal, State, or
local permits, approvals, or authorizations required by law.
3. Nationwide permits do not grant any property rights or exclusive privileges.
4. Nationwide permits do not authorize any injury to the property or rights of
others.
5. Nationwide permits do not authorize interference with any existing or proposed
Federal project.

Dear Bob,
After completing a site visit of Lot 14 on Blackbear Lane (just east of 5129 Blackbear Lane) |
find that the following regulations would apply to development on the lot:
1) No structure is permitted in the 100-year floodplain as per Section 18.69.040.
The Town of Vail participates in the Federal Flood Insurance Program and our current
flood insurance rating is predicated on the Town not allowing site disturbance in this
area. The Community Development Department can require an Environmental lmpact
Report in accordance with section 18.56 for significant regrading or other changes
such as cutting wetland vegetation on the site.
2) No structure is permitted within 50 feet of the center line of Gore Creek and or 30
feet ol a tributary as per Section 18.58.300. There appears to be two tributaries
running through the lot.
3) As per Seciion 18.56.020, the Town may require an Environmental lmpact Report
for any signilicant site disturbance on the lot since it appears that a significant portion
of the lot is a "categorical wstland".
4) As per Section 18.54.030 "No person shall commence removal of vegetafion, site
preparation, building construclion or demolition, dumping of material upon a site, sign
erection, exterior alteration or enlargement of an existing structure, paving, fencing or
other improvements ol open space within the corporate limits of the Town of Vail
unless design approval has been granted as prescribed in this chapter'.
5) The Town may confer with the Army Corps of Engineers on any proposed activity
that may take place in a wetland to ensure compliance with section 404 ol lhe Glean
Water Act. The U.S. Corps ol Engineers is responsible for enforcing this regulation.

ln summary, there appears to be three maior site constraints to dwelopment or significant
alteration of the site: 1) 100-year flood plain;2) stream setbacks; and 3) the presence of

boundary in 1993 and your agent lras prepared an accurate
representation of that boundary by neasuring from the center
line of the road to the setland boundary flags. The drawing
submitted and labeled as IIETLAND l{AP, Lot 14, Gore Creek
subdivision, Dated ilay 27, lgg4, Prepared by: l{artin ltiller'
Aztech Environnental, is an accurate representation of the
wetland boundary on your property.
Developrnent of this lot must concentrate construction on
the upland portions of the Property. The first step would be
to obtain a variance from the Toun of Vail for the setback
requirenent fron the front property line. You should request
a variance to be able to build sithin 10 feet of the front
property line. By copy of this letter to the Town of Vail,
ie -upport a favorable consideration of a variance request to
miniuize wetland inpacts. Approval of a variance request
will help maintain the water quality of Gore Creek and reduce
downstrelm flood danage that could result from the fitling of
wetlands on your lot.
Even with a variance, we realize that some portion of
the house would extend into the retlands. To acconplish
this, the rear portions of the house can be constructed onpitings or concrete piers or caissons. The uEe of pilings
would not reguire a Department of the Arny pernit. The use

of concrete posts or caissons poured in place would reguire apernit, but authorization for tbis nethod would be available
under nationwide general permit nunber 25 provided theconcrete is poured in tightly sealed forns. A uinor amountof fill placed in wetlands (less than 0.10 acre) sould beconsidered under nationwide general permit nunber 18 but onlyafter you have exhausted the possibtlity of using pilings orconcrete poste. The use of pilings or concrete posts shouldonly be rejected for structural engineering concerns with thesuitability of the soils present.
In sumnary, if you or your buyer builds as close to thefront of the lot as the town sill allow, concentrate thenajority of the lrouEe on the uplands and use an elevated
systen for the rear of the house, you wiII be able to buiLdwithout the need for a Departnent of the Arny permit orauthorization can be obtained under nationwide pernitauthority. If you have any further questlons, contact Dlr.llichael Claffey of this office at (303) 243-1199.
