BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Depaftment Approval, Enginee/s (Public Works) review and approval,
a Planning Department review or Health Department review, and a review by the Building Department, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multi-family permits will have to follow the above mentioned maximum
requirements. Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand that if the permit
is not picked up by the expiration date, that I must still pay the plan check fee and that if I fail to do so it may
affect future permits that I apply for.

Our Town of Vail Registration # is 123-8.
Also find attached two stamped copies of the details from the structural engineer for the removal
ofthe wall in the garage as noted on the plans. This also includes the specifications for the
lintels needed at the two door openings that were cut in the concrete wall, also noted on the
plans.

o You must obtain Design Review Board (DRB) approval if any of the mechanical work will involve
ANY exterior work. This includes and is not limited to removal and replacement of driveway snow
meft systems. Please oontact the Development Review Coordinator at 479-2128 for additional
information.
r The Town of Vail has adopted the 2003 International Mechanical Code and the 2003 International
Fuel Gas Code,
r All new construction within the Town of Vail is considered to be of unusually tight construction,
thus all combustion air is required to be. drawn from outside the structure for mechanical
equipment.
Town of Vail Fireolace Ordinance
In Sefiember of 1991, the VailTown Council adopted an ordinance which restrictste @nstruction and
use of open heafth fireplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes and revisions, striving for compromise, yet effectiveness in addressing
the air quality issue. Therefore the following criteria has been adopted:
o Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
o Dwellino Units - Each new dwelling unit may contain:
One (1) EPA Phase II certified solid fuel burning device and no more than two (2) gas appliances
(B vent)
OR
Two (2) gas log fireplaces and no more than turo (2) gas appliance fireplaces (B bent).
o @- Each new restricted dwelling unit may contain:
One (1) gas log fireplace and not more than one (l) gas appliance fireplace.
. @- Each new accommodation unit maycontain:
One (1) gas log fireplace or one (1) gas appliance fireplace.
I If two or more separate dwelling units or accommodaUon units are combined to form one larger
unit, the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may @nyert up to two existing fireplaces to gas.
o If during the course of a remodel an existing woodburning fireplace is altered or moved' the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be converted to
natural gas or rpplaced by an EPA Phase II certified unit.

Employee Housing in Lionsridge 4th Filing
The Ouestion
Tom Braun, representing Carol Orrison, would like to know if the caretakers units
constructed in the Lionsridge 4th Filing should be deed restricted as Type I, II, IIl, IV, or
V Employee Housing Units.
Background
Carol Orrison is the owner of Lot 10. Block 4. Lionsridge Filing No. 4. There is currently
a single family home and a two-car garage on the property. The property has less than
100 sq. ft. of GRFA available for future development. He would like to build a two-car
garage and a caretaker on the propeffy.
Lionsridge 4th Filing is zoned Single Family. However, Ordinance 15 of Series 1989
allows a caretaker to be constructed on each lot. As a result, each lot has the potential to
support a Primary/Secondary type of structure. Per Ordinance 15 of Series 1989. the
caretaker cannot exceed one third of the total GRFA allowed on the lot. The Ordinance
specifies that the employee unit "shall be permitted on each lot." The defirnition of the
employee unit is provided in Section I 8. I 3, which is tbe Primary/Secondary section of the
code. That citation has since been removed and transferred to the Type I portion of the
Employee Hbusing Ordinance.
The Emplolree Housing Ordinance
The Ernployee Houiing Ordinance provides for five different types of employee housing.
There are different atu'ibutes of each type that match the Lionsridge 4th Filing standards,
but there is not a clean match between any of the types and the sifuation in the 4th Filing.
Staffbelieves that it is a closer match to the Type I, as there are six attributes of the
Ernployee Housing Ordinance which match the situation under a Type I scenario. The
Type II has only one attribute that matches this situation; however staffunderstands that
the one is significant. Staffbelieves that all of the attributes are important and would like
your interpretation as to which restriction, a Type I or Type II is appropriate.

CONDITIONS AND STIPULATIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or
other security instrument.
lf the proposed lnsured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or
mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in
writing, the Company shall be relieved from liability for any loss or damage
resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. lf the proposed Insured shall disclose cJch
knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any zuch defect, lien. encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability
prwiously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
Liability of the Company under this Commitment shall be only to the named
proposed Insrred and such parties included under the definition of Inzured in the
form -of policy or policies committed for and only for actual loss incured in
reliance hereon in underaking in good faith (al to comply with the requirements
hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or
create the estate or int€rest or mortgage thereon covered by this Commitment. In
no event shall such liability exceed the amount stated in Schedule A for the policy
or policies committed for and such liability is subject to the insuring provisions and
the Conditions and Stipulations and the exclusions from coverage of the form of
policy or policies committed for in favor of the proposed Insured which are hereby
incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. Any claim of loss or damage, whether or not based on negligence, and which arises
out of the status of the title to the estate or interest or the lien of the insured
mortgage covered hereby or any action asserting such claim, shall be restricted to
the provisions and Conditions and Stipulations of this Commitment.
