PUBLIC WORKS PERI}IIT PROCESS How it relates to Building Permits Fill out our check list provided with a Building Permit Application. If yes was answered to any ofthe questions then a "Public Way" is required. You can pick up an application at either Community Development, located at 75 South Frontage Road or Public Works, located at 1309 Vail Valley Drive. Notice sign offs for utility companies. All utilities must field verify (lbcate) respective utilities prior to signing application. Some utility companies require up to 48 hours notice to schedule a locate. A construction traffic controUstaging plan must be prepared on a separate sheet of paper. An approved site plan may also be used. This plan will show locations of all traffic control devices (signs, cones, etc.) and the work zone, (area of Construction, Staging, etc.). This plan will expire on November lst and will need to be resubmitted for approval through the winter. Sketch of work being performed must be submitted indicating dimensions (lengttl width and depth of work). This may be drawn on the traffrc control plan or a site plan for the job. Submit completed application to the Public Work's office for review. If required, locates will be scheduled for the Town of Vail Electricians and Irrigation crew. The locates take place in the morning, but may require up to 48 hours to perform. The Public Work's Construction Inspector will review the application and approve or disapprove the permit. You will be contacted as to the status and any requirements that may be needed. Most permits are released within 48 hours of being received, but please allow up to one (1) week to process. As soon as the permit is processed, a copy will be faxed to Community Development allowing the "Building Permit" to be released. Please do not confuse the "Public Way Permit" with a "Building Permit" which is to do work on a project itself. NOTE: The above process is for work in a public way ONLY. Applicant: Weiss & Newberry MedicalAssociatesPlanner: Brent Wilson lt. BACKGROUND AND DESCFIPTION OF THE REOUEST The applicant, Dr. Gary Weiss, is a part-time Vail resident. He operates a year-round medical facility in Florida and is requesting PEC approval of this application in order to operate a seasonal medical/counseling lacility at a vacant 725 square-foot Pitkin Creek Park office space. The proposed business would be operated solely within this space. There will be no operation of medical/surgical equipment at this location. The applicant states he anticipates the treatment of six to ten patients per week for a period of four to six weeks per year. During the remainder of the year, Dr. Weiss will offer his services at one of his Florida otfices. He anticlpates the majority of business activity in Vail will take place within a two-week period in the summer and another two-week period in the winter. Special Development District #3 (Pitkin Creek Park) allows medical centers as a conditional use. The services offered by Weiss & Newberry Medical Associates include comprehensive medical and neurological evaluation, counseling and treatment. STAFF RECOMMENDATION The Community Development Department recommends approval of the request for a conditional use permit to allow for the operation of a medical facility, subject to the following tindings: 1. That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of Special Development District #3. 2. That the proposed location of the use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. That the proposed use would comply with each ot the applicable provisions of the conditional use permit section of the zoning code. il.ROLES AND RESPONSIBIL]TIES OF THE REVIEWING BOARDS The Planning and Environmental Commission is responsible for evaluating this conditional use permit application for: Relationship and impact ol the use on development objectives of the Town. Effect of lhe use on light and air, distribution of population, transportation facilities, ulilities, schools, parks and recreation facilities, and other public facilities and public facilities needs. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the streets and parking areas. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. Such other factors and criteria as the Commission deems applicable to the proposed use. The environmental impact report concerning the proposed use, if an environmental impact report is required by Chapter 12 of this Title. Conformance with develooment standards of the zone district. When Special Development District #3 was created (1978), a number ol potential uses were identified for "Development Area B" (includes Building #7). Medical lacilities were identified as an appropriate use, subject to the issuance of a conditional use permit. Given the existing mixed retail/otfice nature of the Pitkin Creek Park Development Area B, staff feels this is an appropriate location for this type of operation. Adjacent uses include a food market, liquor store, real estate/rental office, laundromat and multiple-family housing. The Pitkin Creek Park Condominium Association has approved the use of space 7DD as a medical office. The elfect ol the use on light and air, distribution ol population, transportation facilities, utilities, schools, parks and recreation facilities, and olher public facilities needs. Traflic: The applicant anticipates the arrival and treatmenUevaluation of between 6-1 0 patients per week. The Institute of Transportation Engineers (lTE) estimates a medical facility of this size will generate approximately 1 7.5 vehicle trips/day. Given the sh ort-term/seasonal nature of this proposed operation, staff believes traffic generated by this office will be substantially lower in number most of the year. Statf does not believe this facility would negatively impact traffic flow along Bighorn Road or Interstate 70. Parking: Given the high proportion ol lloor area devoted to residential uses within SDD 3# (93%), staff believes peak parking accumulation occurs during the evening hours and weekends at Pitkin Creek Park. The applicant states the proposed hours of operation would run between 9:00 a.m. to 2:00 p.m. on weekdays. A summary of parking accumulation for Pitkin Creek Park is as tollows: Parkinq Reouired at Development Plan Aporoval for SDD #3 (4/2/79) 156 units / 126,500 square feet GRFA = 9,000 square feet of commercial floor area = 199 spaces 34 spaces Minus 57" credit for mixed uses (oer Section '1 2-1 0-1 2) = - '1 2 soaces Total Required Parking at Development Plan Approval = 221 spaces Parking required lor medical facility @ 725 square feet = 4 spaces Total parking existing on site =259 spaces Although staff believes the previously-approved (1979) PEC allocation for residential parking at Pitkin Creek Park is insufficient, it is anticipated this proposed business will not impact residential parking during hours of peak accumulation. Additionally, based on reports from condo association members. it is estimated that 60% of the owners at Pitkin Creek Park are second homeowners. Staff does not believe this proposal will impact the other above-listed facilities. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. This proposed operation would take place within an existing retailioffice space at Pitkin Creek Park. Therefore, staff does not anticipate any impacts on the bulk and scale ol the proposed use with regard to adjacent properties. Businesses ol this nature were anticipated at this location during development plan and zoning approval of Pitkin Creek Park. B. CRITERIA AND FINDTNGS Upon review of Section 18.60, theDepartment recornmends approval ofbased upon the following factor: Consideration of Factors. II. East VaiI Rentals, Inc. offers a service to residents andguests to the Town of Vail. The previous location of thisbusiness, as a home occupation, did create some problems tothe residentiar character of the neighborhood in-which it waslocated. IVe feel that this is a positive step in that thiscommercial business is moving to a planned cornmerciallocation which was designed to acconmodate traffic flow,parking, and short-term visits. The Pitkin Creek Park commerciat building was designed toserve the east Vair area as a small commercial building. How are parklng spaces allocated? The Town of Vail does not dedicate certain areas of parking within a development for certain uses. The Town requires a certain number of parking spaces be provided on the site for the development, and does not regulate it further. Please see Section 18.44.200, Parking and Loading, of the SDD No.3 Ordinance. 2. Who has the rlghts to extra parklng? In this case, there are 261 parking spaces provided with a parking requirement of 332 spaces. Staff counted each space on September 20, 1991 and found that 95 spaces are located on he east portion ol the sile, 104 spaces are located on the west portion of the site, and 62 are located around the commercial building. As a result, there is no extra parking. The diflerence between the number of required spaces and the number of spaces provided may have been created when modifications where made during the construction process. As the Certificates of Occupancy have been issued for ths development, fie Town has accepted the parking lot configuration and supply. Does a homeowners' assoclatlon need to slgn on atl bulldlng permlF and DRB appllcatlons? After discussing this requirement with tre planning statf and he Town's attorney, the requirement tor homeowners' association signature only applies to work being done on property controlled by the Association. For example, exterior work would probably involve @mmon elements and would therefore require approval from the Association. Work that is limited to an interior space only would require the approval of the owner of that particular condominium space. Specifically, a sign proposal would require homeowner association approval, whib an interior finish of the restaurant would probably not. lf the homeowners' association refuses to approve a request for a sign at this location, the Town would not attempt to resolve this internal matter. The Town understands it would be a civil matter, and hat you would have to resolve this internally. You may want to cfieck the Condominium Declarations to see it lhere are internal rules which regulate the use of this space. How much slgnage would be allowed? Statl has revierrred the plans for the central commercial space, and determined that it has 56 linear feet of trontage. This frontage includes distances along both the major pedestrian and vehicular ways on the west and south sides of the commercialspace, respectively. Section 16.20.090 of the Sign Code would allow a 10 sq. ft. projecting or hanging sign for the building and section 16.20.190 of the Sign Code would allow 1 1.2 sq. ft. of wall signage for he building. Any existing signage for other tenants in the same space would be deducted lrom these totals. ls the use acoeptable and would any condltlonal use revlew be needed for a restaurant or bar? After a review of the odinanc€ establishing special Development District No. 3, it appears Srat Section 18.,+4.050(BX8) allows 'eating and drinking establishments, including the following: cocktail lounges, tiavems, and bars, as well as restaurants' as permitted uses. Based on this inlormation, a conditional use would not be needed. How many seats would be allowed In a restaurant or bar In thls locatlon? | understand that the totial commercial area in the project is 9,238 square teet. This 5. 6. commercial area has 31 parking spaces associated wiUt it, assuming there is one space for every 300 square feet of commercial area. The location you are developing (that has 2,409 square feet) is 260/o ol the total commercial area. Staff believes it is reasonable then to allocate 26T" ol the commercial parking spaces for your use. Note that these spaces are not physically allocated to you; instead, you simply have he right for the use of these spaces. Twenty six percent of tre total commercial supply is eignt spaces. The eight spacss would tanslate to 64 seats in a restauranl. This is based on he Town requirement that one pafting space be provided for every eight seats. Please see Section 18.52.100(C5) of the zoning code. Because of the location of the commercial units at Pitkin Creek Park and. the fact that our store location is not for pedestrian access, except for those owners living at the project, we feel a directory sign located on the front edge of the parking 1ot close to the Frontage Road would create more visibility for our store. At present, people driving by on the Frontage Road cannot readily see our business, so they drive the five miles into Vail to shop for groceries. We are a full-service grocery store and feel the inconvenience created to the visitor because of our lack of visibility is not in the best interest of that visitor. During the winter there is a great deal of snow along the front edge of the parking lot which fronts our business and that condition adds to the lack of visibility. Under our application for a variance, we are asking for a total of L2 square feet. not the 25 square feet as could be allowed.
