I.SUMMARY

Theapplicant,theChildren's GardenofLearningisrequestingaconditional use
permittoallowforaprivate schooltobelocatedatthesite generallyknownas
theHudWirth property,locatedatParcelB,aResubdivision ofTractD,Vaildas
Schone1s1 Filing.TheTownofVail CommunityDevelopmentDepartment is
recommending denial ofthecondit ional usepermitrequest ,subjecttothecriteria
andfind ings asoutlinedinSectionVIIIofthismemorandum.
II.DESCRIPTIONOFTHEREQUEST
TheChildren's GardenofLearning isrequesting aconditional usepermit toallow
fo r a "privateschool"atthesite generallyknownastheHudWirth site.Avicinity
maphasbeenattachedforreference(AttachmentA).Thepropertyiszoned
Two-FamilyPrimary/Secondary zonedistrict,whichallows "publicandprivate
schools"asaconditional use .Therequestincludestheconstructionofmodular
units,whichareintendedtoserveasclassroomsforapproximately 64children,
ages2-1/2 to5years.Theappl icant's letterofrequesthasbeenattachedfor
reference(AttachmentB).Therequestistemporaryinnature asitisintendedto
allowforthetemporaryrelocation oftheABCandLearningTreeschoolsduring
theconstructionofthenewfacilityattheMiddleCreeksite.Themodularunitsat
theHudWirthwillbe removed andthesite re-vegetated toitsoriginalstate,or
constructionofother usesatthesitewouldcommenceonethenewfacilityis
complete.Reductionsoftheplans have beenattachedforreference
(Attachment C).
III.BACKGROUND
ABCandLearning Treeprovideearlyeducational services to2-V2 to5yearold
children.In 2002,ABCandLearning Treemergedintooneinstitution and are

nowcalledtheChildren'sGardenofLearning.Theyarecurrentlyhousedonthe
siteknownasMountainBell,andoperateunderaleasefromtheTownof Vail.
TheproposeddevelopmentatMiddleCreek ,which istoinclude142employee
housingunitsandtheChildren'sGardenofLearning,is inthefinalstagesofthe
TownofVaildevelopmentreview processandconstruct ion istentatively
scheduledforfallof2003.Asaresult,theexistingstructuresonthesitewh ich
housetheChildren 's GardenofLearningwillneedtobedemolished.OnMarch
10,2003 ,theVailTownCouncilvotedtoallowtheChildren'sGardenofLearning
toproceedthroughthedevelopmentreviewprocesstousetheHudWirthsitefor
thetemporaryrelocationoftheirfacil ities.TheTownCouncil'sapprovalto
proceedthroughtheprocessdoesnotconstituteapprovaloftheconditionaluse
permitortheassociateddesignreviewapplication.TheTownCouncilalso
directedtheChildren'sGardenofLearningtopursueotherpossiblelocations.
Resolution No.4,Series of2002authorizedtheTownManagertopurchasethe
HudWirthsite.ThesiteiscurrentlyunplattedandiszonedTwo-Family
Primary/Secondary Residential.Itisavacant3.069acresite.TheTownofVail
hasnotyetcometoaconclusionastowhatuseswillbelocated onthesite.
TheChildren'sG arden ofLearningisrequestingaconditionalusepermittoallow
foraprivateschoolontheHudWirthsite.WhilethelocationoftheChildren's
Ga rden ofLearningonthesiteistemporary(lessthan2years),theTwo-Family
Primary/SecondaryResidentialzonedistrictdoesnotdifferentiatebetween
t emporary usesandpermanentuses.Therefore,theapplicationbeforethe
PlanningandEnvironmentalCommissionisaconditionalusepermit requestfor
aprivateschoolandmustbereviewedaccordingtothecriteriaprovidedby
Chapter16,ConditionalUses,Vail TownCode.Inaddition,theusemust
conformtothedevelopmentstandardsasoutlinedbyChapter12-60,Two-
Family Primary/Secondary ResidentialDistrict,VailTownCode .
IV.ROLESOFTHEREVIEWINGBODIES
Order of Review:Generally,applicationsforaconditionalusepermitwillbe
reviewedfirstbythePlanningandEnvironmentalCommissionforacceptabilityof
useandthenbytheDesign ReviewBoardforcomplianceofproposedbuildings
andsiteplanning.
Planning and Environmental Commission:
Action:ThePlanningandEnvironmentalComm ission is responsibleforfinal
approval/denial/approval with conditions ofconditionalusepermits.
ThePlanningandEnvironmentalCommissionisresponsiblefor
evaluatingaproposalfor :
1.Relationshipand impactoftheuseondevelopmentobjectivesofthe
Town .
2.Effectoftheuse onlightandair,distribution ofpopulation ,
transportationfacilit ies,utilities,schools,parksandrecreation
facilities ,andotherpublicfacilitiesandpublicfacilitiesneeds.

3 .Effectupontraffic,with particular reference to congestion,automotive
and pedestrian safetyand convenience ,trafficflowand contro l,
access,maneuverability ,andremovalofsnowfromthestreetsand
parkingareas..
4 .Effectuponthe character oftheareainwhichthe proposed useisto
belocated,includ ing thescaleandbulkofthe proposed usein
relationto surrounding uses.
5.Suchotherfactorsandcriteriaasthe Commission deems applicable
totheproposeduse .
6.The environmental impactreport concerning the proposed use ,ifan

Design Review Board:
Action :TheDesignReviewBoardhasnoreview authority ona conditional use
permitbutmustreviewany accompanying DesignReviewBoard application .
Town Council:
ActionsofDesignReviewBoardorPlann ing andEnv ironmental Commission
maybe appealed totheTown Councilor bytheTownCouncil.TownCouncil
evaluates whether ornotthePlanningand Environmental Comm ission orDesign
ReviewBoarderredwithapprovalsor denials andcanuphold,upholdwith
modifications,oroverturnthe board's decision .
Staff:
Thestaff is responsible forensuringthatall submittal requirements are provided
andplansconformtothe technical requirements oftheZoningRegu lations.The
staffalsoadvisesthe applicant asto compliance w ith thedesign guidelines.
Staffprovidesastaff memorandum containing background onthe property and
provides astaffevaluationoftheprojectwithrespecttotherequired criteria and
findings ,anda recommendation onapproval ,approvalwithcond itions,ordenial.
Staffalso facilitates the reviewprocess .

Thetwo-family primary/secondary residentialdistrict is intendedto
providesitesforsingle-family residentialusesortwo-family residential
usesinwhichoneunit isa larger primary residenceandthe second unit
is a smallercaretakerapartment,togetherwithsuchpublicfacilities as
mayappropriately belocatedinthesamedistrict.Thetwo -family
primary/secondary residential districtis intendedtoensureadequatelight,
air,privacy andopenspaceforeachdwelling,commensuratewith single-
familyandtwo-family occupancy,andtomaintain thedesirable residential
qualities ofsuch sites byestablishingappropriatesitedevelopment
standards.
12-60-3:CONDITIONALUSES:
Thefollowing conditionalusesshall be permitted,subjecttoissuance of a
conditionaluse permit inaccordancewiththeprovisions of chapter 16 of
thistitle:
Bedandbreakfast as furtherregulatedbySection 12-14 -18 ofthistitle.
Homechilddaycarefacility as furtherregulatedbysection 12-14-12 of
thistitle.
Publicbuildings,grounds and facilities.
Public or private schools.
Publicparkandrecreationfacilities .
Publicutilityand public serviceuses.
Skilifts andtows.
Type/Iemployeehousingunit as setforthinchapter 13 ofthistitle.
Publicorpriva te schoolsarelistedasacond itiona l useinthe Two-Family
Primary/Secondary Res identia l zonedistrict.Chap ter 12-16 ,Conditional Use
Permits,providesthefo llowing:
12-16-1:PURPOSE ;LIMITAnONS:
Inorder toprovidetheflexibility necessarytoachievetheobjectivesof
thistitle,specified usesare permitted incertaindistrictssubjecttothe
granting of a conditionalusepermit.Becauseoftheirunusualorspecial
characteristics,conditionalusesrequirereview and evaluation so that
theymaybelocatedproperlywithrespecttothepurposesofthistitleand
withrespecttotheireffectsonsurroundingproperties .Thereview
process prescribed inthischapter is intendedto assurecompatibilityand
harmonious developmentbetweenconditional usesandsurrounding
propertiesandthetownatlarge.Useslisted as conditional usesinthe
various districtsmaybeperm itted subject tosuchconditionsand
limitations as thetownmayprescribetoensurethatthelocationand
operation oftheconditional useswillbe inaccordance withdevelopment
objectivesofthetownandwillnotbedetrimentaltootherusesor
p roperties.Whereconditions cannotbedevisedtoachi eve these
objectives,applications forconditionalusepermitsshallbedenied.

12-11 -1:INTENT:
•
A.AttractiveAttributesRecognized:Vailis'a Townwith a unique
naturalsetting,internationallyknownforitsnaturalbeauty,alpine
environment,and thecompatibility of manmadestructureswiththe
environment.Thesecharacteristicshavecaused a significant
numberofvisitorstocometoVailwithmanyvisitorseventually
becoming permanent residentsparticipatingincommunitylife.
B.AreaCharacterProtection :Thesefactorsconstituteanimportant
economic baseforthe Town,bothforthosewhoearntheirliving
hereandforthosewhoviewtheTown asa preciousphysical
possession .TheTownCouncilfindsthatnewdevelopmentand
redevelopmentcanhave a substantialimpactonthecharacterof
anareainwhichitislocated.Someharmfuleffectsofoneland
useuponanothercanbe prevented throughzoning,subdivision
controls,andbuildingcodes.Otheraspectsofdevelopmentare
moresubtleandlessamenabletoexactrulesputintooperation
withoutregardtospecificdevelopmentproposals.Amongthese
arethegeneralformofthelandbeforeandafterdevelopment,the
spatialrelationshipsofstructuresandopenspacestolanduses
withinthevicinity and theTown,andtheappearanceofbuildings
andopenspaces as theycontributetothearea as it is being
developedandredeveloped.Inordertoprovideforthetimely
exerciseof judgment inthepublicinterestintheevaluationofthe
designofnewdevelopmentandredevelopment,theTownCouncil
hascreated a DesignReviewBoard(ORB)anddesigncriteria.
C.DesignReview:Therefore,inordertopreservethenaturalbeauty
oftheTownanditssetting,toprotectthewelfareofthe
community,tomaintainthevaluescreatedinthecommunity,to
protectandenhancelandandproperty,forthepromotionof
health,safety,andgeneralwelfareinthecommunity,andtoattain
theobjectivessetoutinthisSection ;theimprovement or
alterationofopenspace,exteriordesignofallnewdevelopment,
andallmodificationstoexisting developmentshallbesubjectto
designreview as specifiedinthisChapter.
D.Guidelines:It is theintentoftheseguidelinestoleave as much
designfreedom as possibletotheindividualdesignerwhileatthe
sametimemaintainingtheremarkablenaturalbeautyofthearea
bycreatingstructureswhicharedesignedtocomplementboth
theirindividualsitesandsurroundings .Theobjectivesofdesign
reviewshallbe as follows:
1.Torecognizetheinterdependenceofthepublicwelfareand
aesthetics,and toprovide a methodbywhichthis
interdependencemaycontinuetobenefititscitizens and
visitors.

2.To allowforthedevelopmen t ofp ublic andprivate property
which isinharmonywiththedesired character oftheTownas
defined bythegu idelines hereinpro vided.
3 .Topr eventthe unnecessary destruction orblighting of the
natural landscape.
4.To ensurethatthearchitectura l design,location,configuration
materials,colors,andoveralltreatment of built-upandopen
spaceshave beendesigned so thattheyrelateharmoniously
tothenaturallandformsandnative vegetation,theTown's
o verall appearance ,withsurroundingdevelopmentandwith
officially approvedplansorguidel ines,ifany,fortheareasin
whichthestructuresare proposed tobelocated.
5.Toprotectneighboringp roperty ownersandusersbymaking
sure thatreasonableprovisionhasbeenmadeforsuch
matters as pedestrianandvehiculartraffic,surfacewater
drainage,soundandsightbuffers,the preservation of lightand
air,andthoseaspectsofdesignnot adequately coveredby
otherregulationswhichmayhavesubstantialeffectson
neighboringlanduses.
VailLandUsePlan
Staffhas reviewed th e va rious planningdocumentsanddeterminedthatthe
fo llowing sectionsoftheVail LandUsePlanarerelevanttothiscondit ional use
permitreques t:
1.1 Vail should continuetogrowin a controlled
environment ,maintaining a balancebetween
residential,commercialandrecreationalusesto
serveboththevisitorandthe permanent resident.
6.1 Services should keeppa ce withincreasedgrowth.
6.2 TheTownofVailshould playa role infuture
developmentthroughbalancing gro wth with
services .
6.3Services should beadjustedtokeeppacewiththe
needsofpeakpe riods.
Inaddition,theVailLandUsePlan designates thissiteas "MediumDensity
Residential."TheMedium DensityResidentiallandusedes ignation statesthe
following:
Themediumdensityresidentialcategoryincludes housingwhichwould
typicallybedesigned as attached unitswithcommonwalls.Densities in
thiscategory wouldrangefrom 3 to 14 dwellingunitsp er buildableacre.
Otheractivities inthiscategorywouldinclude private recreational
facilities,andp rivateparking facilities,and institutional/public uses such
as churches,fire stations,and parks andopensspacefacilities.

TheTwo-Fam ily Primary/Secondary Residential zoned istrict lists "publicor
privateschools"asaconditionaluse ,allowedinthiszonedistrictsubjecttothe
issuanceofacond itional usepermit.Conditionalusepermitsareregulatedby
Chapter 12-16 oftheVailTownCode .According toSection12-16 -1,VailTown
Code :

properties.Whereconditions cannot bedevisedtoachievethese
objectives ,applicationsforconditionalusepermitsshallbedenied.
A.CONSIDERATION OFFACTORS:
1.Relationshipandimpactoftheuseonthedevelopment
objectivesoftheTown.
Staffbelieves thatthisuseisimportant totheTownofVailandwill
haveapositive impactontheTown .Theseschoolsprovidea
valuableservicetothemembersofthecommun ity.Accordingto
theTownofVail LandUsePlan,oneofthegoalsisasfollows:
1.1 Vailshouldcontinuetogrowin a controlledenvironment,
maintaining a balancebetwe en residential,commercial
andrecreational usestoserveboththevisitorandthe
permanent resident.
Staffbelievesthatoneoftheprimarydeve lopment objectivesin
theTownofVailistoprovideservicestotheresidents ofVail,and
believesthatprovid ing earlyeducationtothechildren of the
communityisanimportantfunction .
TheTownofVailhasestablisheddevelopment objectiveswith
regardstohowdevelopmentistooccur intheTownofVail.
Specifically,thepurposeoftheTownofVailDevelopment
StandardHandbookstatesthefollowing :
It is thepurposeoftheserules,regulations ,andstandards
toensurethegeneralhealth,safety,andwelfareofthe
community.Theserules,regulations,andstandardsare
intendedtoensuresafeandefficientde velopment within
theTownofVailforpedestrians,vehiculartraffic,
emergency responsetraffic,andthecommunityatlarge.
Thedevelopmentstandardswillhelp protect property
values,ensuretheaestheticquality ofthecommunityand
ensureadequatedevelopmentof property withintheTown
of Vail.
Inaddition ,theTownofVail hasestablishedDesign Guidelines
whichspecificallyguidedev elopment intheTownofVail.While
enforcementofthe DesignGuidelinesfallstotheDesignReview
Board,asestablishedbyChapter3-4,DesignReviewBoard,of
theVailTownCode ,staffbelievesthattheobjectives ofthe
DesignGuidelines areapplicableinthereviewofthis conditional
usepermitrequest.Theobjectivesofdesign reviewareas
follows:

1.Torecognizetheinterdependenceofthepublicwelfareand
aesthetics,andtoprovide a methodbywhichthis
interdependencemaycontinuetobenefititscitizensand
visitors.
2.Toallowforthedevelopmentofpublicandprivateproperty
whichisinharmonywiththedesiredcharacteroftheTown as
definedbytheguidelineshereinprovided.
3.Topreventtheunnecessarydestruction or blightingofthe
natural landscape.
4.Toensurethatthearchitectural design,location,configuration
materials,colors,andoveralltreatmentofbuilt-upandopen
spaceshavebeendesigned so thattheyrelateharmoniously
tothenaturallandformsandnative vegetation,the Town's
overallappearance,withsurroundingdevelopmentandwith
officiallyapprovedplans or guidelines,ifany,forthe areas in
whichthestructures areproposedtobelocated.
5.Toprotectneighboringpropertyownersand users bymaking
surethatreasonableprovisionhasbeenmadeforsuch
matters as pedestrianandvehiculartraffic,surfacewater
drainage,soundandsightbuffers,thepreservationoflightand
air,andthoseaspectsofdesignnotadequatelycoveredby
otherregulationswhichmayhavesubstantialeffectson
neighboringland uses.
Theaesthetic impactsofplacingmodulartrailers ,inaresidential
neighborhood,onasitewhichiscurrentlyundisturbed,doesnot
supportthe development objectivesoftheTownofVailasoutlined
above.
2.The effect oftheuseon light andair,distribution of
population,transportation facilities,utilities,schools,parks
and recreation facilities,and other public facilities needs.
Accordingtothesummaryprovidedbytheapplicant ,the
Children'sGardenofLearningwillprovideearlylearningservices
for64preschoolagechildren,withtwofull-timedirectors,4toddler
teachers,2 assistants,5 pre-schoolteachers ,1 office
administrator,andtwolunchaidsthatcomefo r anhouratlunch.
Thehoursofoperationarelimitedto 7:30 amto 5:30 pm,Monday
throughFriday.
Staffdoesnotbelievethattherewillbeanegative impactonlight
andair ,d istribution ofpopulation ,transportationfacilit ies,utilities,
norparksandrecreationfacilities.Becausetheuse istemporary
innature,thereisnolongtermeffectonthesecriteria .Inaddition ,
thefacilityisfulf illing aneedforearlyeducat ion intheTownof
Vail.
Withregardstootherpublicfacilitiesneeds,thissitehasbeen
identifiedasthepotentialsiteforaW est Vailfirestation.The
locationofth e Children 's GardenofLearningcouldimpactthe

timingofconstructionofthefirestationonthissite.Duetosafety
concernsandthe areaofthesiteproposedtobeusedbythe
Children'sGarden ofLearning,noconstructioncouldoccuruntil
theChildren's GardenofLearningvacatesthissite.
3.Effect upon traffic with particular reference to congestion,
automotive and pedestrian safety and convenience,traffic
flow and control,access,maneuverability,and removal of
snow from the street and parking areas.
T he applicant shallprovideparking inaccordancewithChapter
12-10,Off-Street ParkingandLoading,VailTownCode.Parking
forusesnotspecificallylistedinChapter12-10,VailTownCode
shall bedeterminedbythePlanning and Environmental
Commission.Theapplicanthasproposed24parkingspacesfor
theChildren's Gardenof Learning.TheEarly LearningCenterat
theMiddleCreeksite wasapprovedwith22parkingspaces.Staff
believes that24spaceswillbeadequate toservethisfacility.It
should benotedthatnoparking willbeallowed onChamonix
Road.Anyadditionalneeds fordrop-offortemporaryparking
shallbeaccommodatedonsite.
Theapplicant hasprovidedareaforsnowstoragewhichmeets
theTownregulations,whichstatethatanareaequaling 30%of
thepavedareabeprovidedforsnowstorage.
4.Effect uponthe character oftheareain which the proposed
useistobe located,including the scale and bulk ofthe
proposed usein relation to surrounding uses.
The Design ReviewBoard hasconceptuallyreviewedtheplansfor
theChildren'sGardenofLearning.Asummaryoftheircomments
isattached(Attachment D).Generally,theDesignReviewBoard
hasconcernsabouttheplacement oftheseproposedtempo rary
structures inthislocation.Specifically,they findthat theproposal
isnotincompliance withthe Design Guidelines andwillhavea
negativeeffect uponthecharacterofthearea.Duetothehigh
visibility oft he siteandthe lackofanysortofbufferofthe
structures,neithertheDesignReviewBoardnorstaff believes that
theproposaliscompatiblewiththeneighborhood.Thebuildings
lackthearticulation,thematerials,the landscaping,etc.,tocomply
withthe Design Guidelines,andtheaestheticeffectonthe
characteroftheneighborhoodwillbe negative .
B.FINDINGS
ThePlanning and EnvironmentalCommission shallmakethefollowing
findings beforegranting aconditional usepermit:

1.Thattheproposedlocationoftheuseisinaccordancewiththe
purposesoftheconditionalusepermitsectionofthezoningcode
andthepurposesofthe district inwhichthesite islocated.
2.Thattheproposedlocationoftheuseandtheconditionsunder
whichitwouldbeoperatedormaintainedwouldnotbedetrimental
tothepublichealth,safety ,orwelfareormateriallyinjuriousto
propertiesorimprovementsinthevicinity .
3.Thattheproposedusewouldcomplywitheachoftheapplicable
provisionsofthecond itional usepermitsectionofthezoning
code .

purposesoftheconditionalusepermitsectionofthezoningcodeand

Iamgivingyoua detailed description of ourdayatthe Children's Garden of
Learning:
Weareopen Monday-Friday.Wearenotopenon weekends,butwewillhave
teacherscomingtosetupandcleanthe classrooms.They typically willonlybethere
foranhour-twoatthemost.
Weare encouraging all teachers toutili ze thefreebusroutesandtocarpool.Thiswill
be continually talkedaboutasourmove approaches.
WeareworkingwiththeTOVon securing parking passesforthe teachers onthe
weekdays .

Ourschooldaybeginsat9:00AMandendsat 4:00 PM.Wedo offer extended hours
for parents thatneedthem .This means inthe morning weopenthe school at7:30 AM
andinthe evening weare open for children until5:30PM
Wehaveasmanyas65 children ages 2-51/2 thatattendeachday .IntheAMwe
typically have5-10 children that arrive before 9 :00 AM.Inthe evening wehave18-
20 children thatstay after 4 :00 PM .These numbers are subject to change,as many of
our parent's workintheski industry,sothe y mayneed extended hours forthe
children oncethe mountain opens,Extended hours forthe children make thechild 's
day extremely longandwetryto discourage itas much as possible!The staff at
Children 's Garden believes thatseven hours of careand education isa maximum
number of hoursachild should be ina school regardless of age .
With parking requirements ontheMtBellsite ,weask that parents intheAMandPM
stagger theirarrivals.Wehavedrop off timefrom8:50till9 :I0and pick uptime
from4:00PMtill4 :10PM .These times typically areour busiest.
Day Schedule:
Early Extended hours:7:30-9:00:Children haveearly morning snackandhavequiet
activities setupunt il 9 :00 AM.
9:00-9:45:Freeplay .Wehavethe rooms setup with specific activities foreachage
group .Theyarefreeto choose andwork together on activities .
9:45 :Circletime.Eachroomhasall children get together andread stories andsing
songs .
10:10-15:Free choice timeand snack.
10:45:Grouptime:Each child is placed ina small group with teacher andthey
explore different activities asagroup.Thisisatimefor teachers and children to

Learning:
Wearcopen Monday-Friday.Wearenotopenon weekends,butwewillhave
teachers coming tosetupandcleanthe classrooms .They typically willonlybethere
foranhour-twoatthemost.
Weare encouraging allteacherstoutilizethefreebusroutesandtocarpool.Thiswill
be continually talked aboutasourmoveapproaches.
Weare working withtheTOVonsecuring parking passes forthe teachers onthe
weekdays .

Our school day begins at9 :00 AMand ends at 4:00 PM.Wedo offer extended hours
for parents that need them.This means inthe morning we open the school at7:30 AM
andinthe evening weare open for children until5:30PM
We have as many as65 children ages 2-51/2 that attend eachday.Inthe AM we
typically have 5 -10 children that arrive before 9:00 AM .Inthe evening we have 18-
20 children that stay after 4:00 PM.These numbers are subject to change,as many of
our parent's work intheski industry,so they may need extended hours forthe
children once the mountain opens .Extended hours forthe children make the child's
day extremely long andwetryto discourage itas much as possible!The staff at
Children's Garden believes that seven hours of care and education isa maximum
number of hours a child should beina school regardless of age .
With parking requirements ontheMtBellsite ,weaskthat parents inthe AM and PM
stagger their arrivals.We have drop off time from 8:50 till 9:10 and pick up time
from 4:00 PMtill4:I0PM.These times typically are our busiest.
Day Schedule:
Early Extended hours :7:30-9:00:Children have early morning snack and have quiet
activities setup until 9 :00 AM.
9:00-9:45:Free play.We have the rooms setup with specific activities for each age
group.They arefreeto choose and work together on activities.
9:45:Circle time.Each room hasall children get together and read stories and sing
songs.
10:10-15:Free choice time and snack.
10:45 :Group time :Each child is placed ina small group with teacher and they
explore different activities asa group.This isa time for teachers and children to
extend learning and study atopicin depth.
11:30 :Clean uptime:Everyone works together to clean up room andset out mats for
naptime.
11 :45:Assistant read stories and children rest on mats

12:30:Outside time.Explore playgrounds and utilize gross motorequipment

II.DESCRIPTIONOFTHEREQUEST
TheChildren's GardenofLearning isrequestingaconditional usepermit toallow
fora"privateschool"atthesitegenerallyknownastheHudWirthsite.Avicinity
maphasbeenattachedforreference(AttachmentA).Thepropertyiszoned
Two-FamilyPrimary/Secondary zonedistrict ,whichallows "publicandprivate
schools"asaconditionaluse.Therequestincludestheconstruction ofmodular
units,whichare intendedtoserveasclassroomsfo r approximately64children,
ages2-1/2to 5 years.Theapplicant'sletterofrequesthasbeenattachedfor
reference(AttachmentB).Therequestistemporaryinnatureasit isintendedto
allowforthetemporaryrelocationoftheABCandLearningTreeschoolsduring
theconstructionofthenewfacilityattheMiddleCreeksite.Themodularunitsat
theHudW irth willberemovedandthesitere-vegetatedtoitsoriginalstate,or
constructionofotherusesatthesitewouldcommenceonethenewfacilityis
complete.Reductionsoftheplanshavebeenattachedforreference

III.BACKGROUND
ABCandLearningTree provideearlyeducationalservicesto 2-Y2 to5yearold
children.In2002,ABCandLearning Treemergedintooneinstitutionand are

nowcalledtheChildren'sGardenofLearning.Theyarecurrentlyhousedonthe
siteknownasMountainBell,andoperateunderaleasefromtheTownofVail.
TheproposeddevelopmentatMiddleCreek,which istoinclude142employee
housingunitsandtheChildren'sGardenofLearning,isinthefinalstagesofthe
TownofVaildevelopmentreviewprocess andconstructionistentatively
scheduledforfallof2003.Asaresult,theexisting structuresonthesite which
housetheChildren'sGardenofLearningwillneedtobedemolished.OnMarch
10,2003,theVailTownCouncilvotedtoallowtheChildren's GardenofLearning
toproceedthroughthedevelopmentreviewprocesstousetheHudWirthsitefor
thetemporaryrelocationoftheirfacilities.TheTownCouncil'sapprovalto
proceedthroughtheprocessdoesnotconstituteapprovaloftheconditionaluse
permitortheassociateddesignreviewapplication.TheTownCouncilalso
directed theChildren's GardenofLearningtopursueotherpossiblelocations.
Resolution No.4,Seriesof2002authorizedtheTownManagertopurchasethe
HudWirthsite.Thesite iscurrentlyunplattedandiszonedTwo-Family
Primary/Secondary Residential.Itisavacant3.069acresite.TheTownofVail
hasnotyetcometoaconclusionastowhatuseswillbelocatedonthesite.
TheChildren'sGardenofLearning isrequestingaconditionalusepermittoallow
foraprivateschoolontheHudWirthsite.WhilethelocationoftheChildren's
GardenofLearningonthesiteistemporary(lessthan2years),theTwo-Family
Primary/Secondary Residential zonedistrictdoesnotdifferentiatebetween
temporaryusesandpermanentuses.Therefore,theapplicationbeforethe
PlanningandEnvironmentalCommissionisaconditional usepermit requestfor
aprivateschoolandmustbe reviewed accordingtothecriteriaprovidedby
Chapter16,ConditionalUses,VailTownCode.Inaddition,theusemust
conformtothedevelopmentstandardsasoutlinedbyChapter12-60,Two-
Family Primary/Secondary ResidentialDistrict,VailTownCode.

12-16-1:PURPOSE;LIMITATIONS:
Inordertoprovidetheflexibilitynecessarytoachievetheobjectivesof
thistitle,specifiedusesare permitted incertaindistrictssubjecttothe
grantingof a conditionalusepermit.Becauseoftheirunusualorspecial
characteristics,conditional uses requirereview and evaluation so that
theymaybelocated properly withrespecttothepurposesofthistitleand
withrespecttotheireffectsonsurroundingproperties.Thereview
process prescribed inthischapterisintendedtoassurecompatibilityand
harmoniousdevelopmentbetweenconditionalusesandsurrounding
properties and thetownatlarge.Useslisted as conditional uses inthe

A.AttractiveAttributesRecognized:VailisaTownwith a unique
naturalsetting,internationallyknownforitsnaturalbeauty ,alpine
environment,and thecompatibilityofmanmadestructureswiththe
environment.Thesecharacteristicshavecaused a significant
numberofvisitorstocometoVailwithmanyvisitorseventually
becoming permanent residentsparticipatingincommunitylife.
B.AreaCharacterProtection:Thesefactorsconstituteanimportant
economic baseforthe Town,bothforthosewhoearntheirliving
here and forthosewhoviewtheTown as apreciousphysical
possession.TheTownCouncilfindsthatnewdevelopment and
redevelopmentcanhave a substantialimpactonthecharacterof
anareainwhich it islocated.Someharmfuleffectsofoneland
useupon another canbepreventedthroughzoning,subdivision
controls,andbuildingcodes.Otheraspects of developmentare
moresubtle and lessamenabletoexactrules put intooperation
withoutregardtospecificdevelopmentproposals.Amongthese
arethegeneralform of thelandbefore and afterdevelopment,the
spatialrelationshipsofstructuresandopenspacestolanduses
withinthevicinity and the Town,andtheappearance of buildings
andopenspacesastheycontributetotheareaasitisbeing
developed and redeveloped.Inordertoprovideforthetimely
exerciseof judgment inthepublicinterestintheevaluationofthe
design of newdevelopmentandredevelopment,theTownCouncil
hascreated a DesignReviewBoard(ORB)anddesigncriteria.
C.DesignReview:Therefore,inordertopreservethenaturalbeauty
oftheTown and itssetting,toprotectthewelfareofthe
community,tomaintainthevaluescreatedinthecommunity,to
protectandenhancelandandproperty,forthepromotionof
health,safety,and generalwelfareinthecommunity,andtoattain
theobjectivessetoutinthisSection;theimprovementor
alterationofopenspace,exteriordesignofallnewdevelopment,
andallmodificationstoexistingdevelopmentshallbesubjectto
designreview as specifiedinthisChapter.
D.Guidelines:It istheintent of theseguidelinestoleave as much
designfreedom as possibletotheindividualdesignerwhileatthe
sametimemaintainingtheremarkablenaturalbeautyofthearea
bycreatingstructureswhicharedesignedtocomplementboth
theirindividualsites and surroundings.Theobjectivesofdesign
reviewshallbe as follows :
1.Torecognizetheinterdependenceofthepublicwelfareand
aesthetics,andtoprovide a methodbywhichthis
interdependencemaycontinuetobenefititscitizensand
visitors.

officially approved plansorguidelines ,ifany,fortheareasin
whichthestructuresare proposed tobelocated.
5.Toprotectneighboring property ownersandusersbymaking
surethatreasonable provision hasbeenmadeforsuch
matters as pedestrian and vehiculartraffic,surfacewater
drainage,soundandsightbuffers,thepreservation of lightand
air,andthoseaspectsofdesignnot adequately coveredby
otherregulationswhichmayhavesubstantialeffectson
neighboringlanduses.

Inaddition,theTownofVailhasestablishedDesign Guidelines
whichspecificallyguide development intheTownofVail.While
enforcementoftheDesign GuidelinesfallstotheDesignReview
Board,asestablishedbyChapter3-4,Design ReviewBoard,of
theVailTownCode,staffbelievesthattheobjectives ofthe
DesignGuidelinesareapplicableinthe review ofthisconditional
usepermitrequest.Theobjectivesofdesign review areas

aesthetics,andtoprovide a methodbywhichthis
interdependencemaycontinuetobenefititscitizensand
visitors.
2.Toallowforthedevelopmentofpublicandprivateproperty
whichisinharmonywiththedesiredcharacteroftheTown as
definedbytheguidelineshereinprovided.
3.Topreventtheunnecessarydestructionorblightingofthe
natural landscape.
4.Toensurethatthearchitecturaldesign,location,configuration
materials,colors,andoveralltreatmentofbuilt-upandopen
spaceshavebeendesigned so thattheyrelateharmoniously
tothenaturallandformsandnative vegetation,the Town's
overallappearance,withsurroundingdevelopmentandwith
officiallyapprovedplansorguidelines,ifany,fortheareasin
whichthestructuresareproposedtobe located.
5.Toprotectneighboringpropertyownersandusersbymaking
surethatreasonableprovisionhasbeenmadeforsuch
matters as pedestrianandvehiculartraffic,surfacewater
drainage,soundandsightbutters,thepreservationoflightand
air,andthoseaspects of designnotadequatelycoveredby
otherregulationswhichmayhavesubstantialeffectson
neighboringland uses .
Theaestheticimpactsofplacing modular trailers ,inaresidential
neighborhood ,onasitewhichis currently undisturbed,doesnot
supportthe development objectivesoftheTownofVailasoutlined
above.
2.Theeffectoftheuseonlightandair,distributionof
population,transportationfacilities,utilities,schools,parks
andrecreationfacilities,andotherpublicfacilitiesneeds.
Accordingtothesummaryprovidedbytheapplicant ,the
Child ren's GardenofLearningwillprovideearlylearningservices
for64 preschool agechildren,withtwofull-time directors,4toddler
teachers ,2assistants,5pre-schoolteachers,1office
administrator,andtwolunchaidsthatcomeforanhouratlunch.
Thehoursofoperationarelimited to7 :30 amto5 :30 pm ,Monday
throughFriday .
Staffdoesnotbelieveth at therewillbeanegativeimpactonlight
andair ,distribution ofpopulation,transportation facilities ,utilities ,
norparksandrecreationfacilities.Becausetheuseis temporary
innature .thereisnolongtermeffectonthesecriteria.Inaddition,
thefacilityisfulfillinganeedforearlyeducationintheTownof
Vail.
Withregardstootherpublicfacilitiesneeds,thissitehasbeen
identifiedasthepotentialsiteforaWestVailfirestation.The
locationoftheChildren's GardenofLearning could impact the

timingofconstructionofthefirestationonthissite.Duetosafety
concernsandtheareaofthesiteproposedtobeusedbythe
Children'sGardenofLearning,noconstructioncouldoccuruntil
theChildren's GardenofLearningvacatesthissite.
3.Effect upon traffic with particular reference to congestion,
automotive and pedestrian safety and convenience,traffic
flow and control,access,maneuverability,and removal of
snow from the street and parking areas.
TheapplicantshallprovideparkinginaccordancewithChapter
12-10,Off-StreetParkingand Loading,VailTownCode.Parking
forusesnotspecificallylistedinChapter12-10,VailTownCode
shallbedeterminedbythePlanningandEnvironmental
Commission.Theapplicanthasproposed24parkingspacesfor
theChildren's GardenofLearning.TheEarlyLearningCenterat
theMiddleCreek sitewasapprovedwith22parkingspaces.Staff
believesthat24spaceswillbeadequatetoservethisfacility.It
shouldbenotedthatnoparkingwillbeallowedonChamonix
Road.Anyadditionalneedsfordrop-offortemporaryparking
shallbeaccommodatedonsite.
Theapplicanthasprovidedareaforsnowstoragewhichmeets
theTownregulations,whichstatethatanareaequaling30%of
thepavedareabeprovidedforsnowstorage.
4.Effect upon the character oftheareain which the proposed
useistobe located,including the scale and bulk of the
proposed usein relation to surrounding uses.
The Design ReviewBoardhasconceptuallyreviewedtheplansfor
theChildren'sGardenofLearning.Asummaryoftheircomments
isattached(AttachmentD).Generally,theDesignReviewBoard
hasconcernsabouttheplacementoftheseproposedtemporary
structuresinthislocation.Specifically,theyfindthattheproposal
isnotincompliancewiththeDesignGuidelinesandwillhavea
negativeeffectuponthecharacterofthearea.Duetothehigh
visibilityofthesiteandthelackofanysortofbufferofthe
structures,neithertheDesign ReviewBoardnorstaffbelievesthat
theproposaliscompatiblewiththe neighborhood.Thebuildings
lackthearticulation,thematerials,thelandscaping,etc.,tocomply
withtheDesignGuidelines,andtheaestheticeffectonthe
characteroftheneighborhoodwillbenegative.
B.FINDINGS
ThePlanningandEnvironmentalCommissionshallmakethefollowing
findingsbeforegrantingaconditionalusepermit:

1.Thattheproposedlocationoftheuseisinaccordancewiththe
purposesoftheconditionalusepermitsectionofthezoningcode
andthepurposesofthedistrictinwhichthesite islocated.
2.Thattheproposedlocationoftheuseandtheconditionsunder
whichitwouldbeoperatedormaintainedwould notbedetrimental
tothepublichealth,safety,orwelfareormateriallyinjurious to
propertiesorimprovementsinthevicinity.
3.Thattheproposedusewouldcomplywitheachoftheapplicable
provisions oftheconditionalusepermitsectionofthezoning
code.
IX.STAFFRECOMMENDATION
TheCommunity Development Departmentrecommends denial ofaconditional
usepermit,toallowforaprivate school,locatedatParcelB,aresubdivisionof
TractD,VaildasSchone 1stFiling,generallyknownasthe "HudWirth"property.
(Afullmetes &boundsdescriptionisavailableattheDepartmentofCommunity
Development upon request).Staff'srecommendationisbaseduponthereview
ofthecriteriainSectionVIIIofthismemorandumandtheevidenceand
testimonypresented,subjecttothefollowingfindings:
1.Thattheproposedlocationoftheuseisnotinaccordancewiththe
purposesofthe conditional usepermitsectionofthezoningcodeand
thepurposesofthePrimary/Secondaryzonedistrict.
2.Thattheproposedlocation oftheuseandtheconditionsunderwhich
itwillbeoperatedormaintainedwillbedetrimentaltothepublic
health,safety,orwelfareandmateriallyinjurioustopropertiesor
improvementsinthevicinity.
ShouldthePlanning andEnvironmental Commissionchoosetoapprovethis
conditionalusepermitrequest,theCommunityDevelopmentDepartment
recommendsthefollowingconditions:
1.Thisconditionalusepermitallowstheapplicanttoprovideearly
educationalservicetonomorethan70childrenandinaccordance
withtheprogramasoutlinedinAttachmentB.
2.Theapplicantis responsible fortherevegetationofthesitewhenthe

our parent 's workintheski industry,sotheymayneed extended hoursforthe
children oncethe mountain opens .Extended hours forthe children makethe child's
day extremely longandwetryto discourage itasmuchaspossible!The staff at
Children's Garden believes that seven hours of careand education isa maximum
number of hoursachild should beinaschool regardless of age.
With parking requirements ontheMtBellsite,weaskthatparentsintheAMandPM
stagger theirarrivals.Wehavedrop off timefrom8:50till9:10andpickuptime
from4:00PMtill4:10PM.These times typically areour busiest.

TheTownofVailisthepropertyowneroftheHudWirthsite,whichistheproposed
locationforthetemporaryrelocationoftheChildren'sGardenofLearning.The
Children's GardenofLearning isrequestingapprovalfromtheTownofVailtoproceed
throughthedevelopment review process.
Thedevelopment review processincludesa review ofaconditionalusepermitbythe
PlanningandEnvironmentalCommissiontoallowfora"privateeducationalinstitution"in
theTwo-FamilyPrimary/SecondaryResidentialzonedistrict.ThePlanningand
EnvironmentalCommissionhearingisscheduledforMarch10,2003 .Inaddition,the
processwillincludea review bytheDesignReviewBoardfortheassociateddesign
review application .Theproposalincludestheplacementofmodulartrailers,andthe
constructionofaplayareaandassociatedparkingforthetemporaryrelocationofthe
Children's GardenofLearning.Reductionsoftheproposal have beenattachedfor
reference(AttachmentB).
OnFebruary19,2003,theapplicantappearedbeforetheDesignReviewBoardfora
conceptual review oftheproposedapplication.AsummaryoftheDesignReview
Board'scommentshasbeenattachedforreference(AttachmentC).
III.BACKGROUND
TheChildren 's GardenofLearning(formerlyABCandLearningTree)needstobe
temporarilyrelocated duringtheconstruction oftheMiddleCreekaffordablehousing

project.AfterreviewofmultipleTown-owned parcels(AttachmentD),itwas determined
bytheapplicant.thattheHudWirthsiteisasuitablelocationforthetemporaryfacilities .
Therelocationperiodwilllastapproximately 15monthsandwillbeginJuneof2003.
IV.STAFFRECOMMENDATION
TheCommunityDevelopmentDepartmentrecommendsthattheTownCouncilapprove
thisrequesttoproceedthroughthedevelopmentreviewprocess .Pleasenotethatan
approvalofthisrequestdoesnotconstituteanapprovaloftheproposed improvements,
itsimplyallowstheapplicanttoproceedthroughthe development reviewprocess .The
Councilwillbeinformedofthestatusoftheproposalthroughperiodicupdatesofthe
PlanningandEnvironmentalCommission andDesignReviewBoardmeetings .

concerns:
1.Duetotheresidentialcharacteroftheneighborhoodandthehighvisibi lity ofthesite,
themodulartrailerswillneedtobemodifiedtoblendwiththecharacterofthe
neighborhood andthesite.AswithalldevelopmentintheTownofVail ,the
Children'sGardenofLearningmustcomplywith theDesignGuidelinesasoutlined in
Title14oftheVailTownCode.
2.TheDesignReviewBoardiswillingtoworkwiththeChildren'sGardenofLearningin
anywaytheycan,includinghelpingtoevaluatesiteswhichmaybemoresuitablefor
modulartrailers.However,regardlessofthesite,themodular trailersmustbe
modified tocomplywiththeTownofVailDesignGuidelines.
DuetotheconcernsoftheDesignReviewBoardandtheTownCouncil,therelocationofthe
Children'sGardenofLearningtotheHudWirthsiteisscheduledforTownCouncilonMarch4,
2003.Asaresult,theconditionalusepermitrequesthasbeentabledtoMarch10,2003.Should
