Hugh schmidt, the 0wner operator, opened the vail HcDonaldrs in september
1977 in a part of the unincorporated area of Eagle County. At that time,
it had a sign of either 52 square feet or 86 sqra.. feet (depending upon
the methodology used to calculate the size) rmunted on the roof of the
building, facing to the south. That sign was subsequently moved to face
east in its present position (a photocopy of that sign is enclosed). ln
August of 1982 (after being annexed into the Town of vail), the cornr,runity
Development Departrnent haC l,'lr. Schmidt rernove the arches port ion of .that
sign which was repl aced rvith a white rrH to reduce the size to approximately
38 square feet as it presently exists. In June of 1985, that sign must
be removed and the area brought into confornrace with the Present sign code.
0ur investigation shows that a large portion of Hr. schmidt's customers
are the Interstate 70 travellers and conformance with the code for CClll
will seriously impact the conven ience of the Interstate traveller, Tot'tn of
Vail sales tax revenues, and l''!r. Schmidtts business.
As can be seen by Exhibits I and 2, Vail HcDonald's bears little similarity
with the general Tot^rn of Vail financial profile, or visitor Cays, with
lir. schmidt's highest salest npnths bein-o in July and August. This is no
great surprise when you consider the annual tourism distribution in the State
of Colorado is considerably different then that of the Town of Vail (see
Exhibit 3). we must also consider that a much higher percentage of our
summer visitors arrive and travel through our state by automobile than
do winter visitors.
As was ment ioned earlier in August of .|982, the Torvn forceC a rernoval of a
portion of the existing sign. txhibit 4 shows the impact that resulted
from that loss of identification. lf anyone feels that this dov,'nwa rd
trenC in customer count is attributed to a downward trenC in the fast
food industry or lack of interest by the Interstate traveller, refer to
Exhibit 5 which shows no such lack of interest east of Vail Pass.
Customer surveys were done by I'tr. Schmidt at various times in 1982. These
surveys were to determine the point of origin of his customers anC how they
decided that they rnould stop at this particular place to eat. Exhibit 6
shows this customer distribution, anC if the customer was not an Eagle Valley
resident, whether he/she was staying in Vail, or'rjust passing throughr"
notice that 322 (February) and 5tr? (June) were travelling through on
Interstate 70. This February customer survey also found that 9lZ of these
customers stopped because they sarv the sign either on this triP or on
previous trips. The remaining 92 were brought here by bil lboard advertising
(Dumont, !! minutes away), radio advertising, worC-of-nouth' or other
means. lt is obvious that this now identifiable Interstate business needs
h ighway recogn i t ion .
We investigated the Rules Regulations and Standards Pertaining to Specific
Information and Business I-gE .. publ ished by the State of Colorado Depart-
ment of Highvrays. These are the roadside information signs as may be seen
in the Dillon area. The Highway Departnent criteria is that these l5 square
feet signs are visible f rom 35C feet which allows a recognition time of a
little over 4 seconds travelling at 55 mph. These signs are placed a
minimum of 1800 feet from the "Exit-Right Lane" sign allovring a reaction
time of approxinrately 20 seconds for an orderly exit from the Interstate.
Unfortunately, West Vail is not in what is classified as a "bonus area."
These signs are not al lowed in ln'est Vail.
lr/e investigated potential billboard sites. TLre nearest site available
for east-bound traffic is somewhere near the Utat' border.
The problem must be addressed on the i'icDonald's property.
Three different sized signs were prepared and erected (temporari ly) on
the site and photographed from various locations on the Interstate and
surrounding 'Jest Vai I area.
The first was 20 square feet on a Post, adjustable from 8 feet to
l4 feet. This was not of sufficient size to be visible to east-bound
traffic in time for a reasonable exlt. The second was 40 square feet
with the same results. The third was a 60 square foot tarpaulin and
this proved to be marginally successful at a height of l4 feet if viewed
between the cars and trucks on the west-bound lanes.
At the time the site for the HcDonaldrs was chosen, it was part of the
unincorporated area of the county and was al lowed much larger signage
necessary to attract the Interstate travel ler. Under present al lovrabl e
sign conditions, this site would not have been chosen.
Section 16.22.02e A of the Vail Sign Code states 'rPurpose, to identify
a business or organization being the sole business occupant within a building
with a low profile planter type design sign." I assurne that we "identify"
to our potential customers. A low profile planter type design cannot be
seen by them.
This proposal is not detrimental to persons working or residing in the area
or to adjacent property, to the neighborhood, or to the public wel fare in
general.
We have proposed the ninirnum of what we think will identify l'lr. Schnidtrs
business. lt would be al lovred that in the future, if the Highway
tdentification Signs becone availabrle to P'cDonald's in the 'Jest Vail aree,
l!r. schnridt would take this sign dor.rn and replace it with a 20 square foot
sign, at a naximum height of I feet.

to erect a free-standing sign of 55 square feet, 14 feet in height.
FINDINGS OF THE DESIGN REVIEt,I BOARD:
The Design Review Board voted 4-0 to deny the requested
variances. The motion for denial stated that the request v{as
incompatible with Sections 16.16.010 and 16.16.020 of the Town
of Vail Sign Code, and that approval may set a precedent that
is not within the intent of the sign code.
The Design Review Board recomnended that the applicant
study the possibility of placing signage on the rcof plane of the
structure..

decided that they rvoul d stop at this particular place to eat. Exhibit f,
shows this customer distribution, and if the customer was not an Eagle Valley
resident, whether he/she was staying in Vail, orrrjust passing throuqh,"
notice that 32t (February) end 542 (June) were travelI in_o throuoi. on
Interstate 70. This February customer survey also found that 9l? of these
custonrers stopped because they saw the siEn either on this trif, or on
previous trips. The remaining 9Z were brought here b,y billboard edvertisinc
(Dumont, 55 minutes a*ay), radio advertising, vorC-of-nouth, or otner
means. lt is obvious that this now identifiable Interstate business neeCs
h i g hvray recognition.
l/e investigated the Rules Regulations and Standards Pertaining to 5oecific
Information anc Business Signs as published by the state of coloraco gepart-
ment of Highvrays. These are the roadside inforrnat ion signs as rnay De seen
in the Dillon area. The Highway DepartRent criteria is that these l5 scuare
feet signs are visible f rorn 35C feet which allows a recognition time of a
little over 4 seconds travelling at 55 rnph. These sicns are placeC a
minimum of lt00 feet f rorn the ilExit-Ri9ht Lane" sign allov,ing a react ion
time of approximately 20 seconds for an orCerly exit f ron: the Interstate.
Unfortunately, l./est Vait is not in what is classified as a ,'bonus area.',
These signs are not al lovreC in West Vail.
l"te investigated potential billboard sites. The nearest site available
for east-bound traffic is somer,rhere near the Utal, border.

Three different sized signs were prepareC and erected (temporarily) on
the site and photographed from various locations on the Interstate an<.1
surround i ng ',Jest Vail area.
The first was 20 square feet on a post, adjustable from I feet to
l4 feet. This was not of sufficient size to be visible to east-bound
traffic in time for a reasonable exit. The second was 4C souare feet
with the same results. The third was a 60 square foot tarpaulin and
this proved to be rnarginal ly successful at a height of ll+ feet if vievred
between the cars and trucks on the west-bound lanes.
At the time the site for the HcDonald's was chosen, it was part of the
unincorporated area of the county and was al lowed much laroer sionage
necessary to attract the Interstate traveller. Under present allowable
sign conditions, this site would not have been chosen.
Section 16.22.028 A of the Vail Sign Code states,,Purpose, to identify
a business or organization being the sole business occupant within a building
with a low profile planter type design sign.r' I assurne that we ',identify,,
to our potential customers. A low profile planter type design cannot be
seen by thern.
This proposal is not detrimental to persons r+orking or residing in the area
or to aCjacent property, to the neighborhood, or to the public vrelfere in
general.

Hugh Schmidt, the owner-operator, opened the Vall l4cDonaldrs In September of
lg17 tn what was then the unlncorporated area of Eagle County. At that tlme lt
haC a slgn of approximately 86 sq.ft. nounted on the mansard roof faclng south.
That slgn was sutsequently moved to face east in its present posltlon. After
the area was annexeC into the Town of Vall in August 1982, the Conrmunity
Development Department forced removal of the logo portlon of tlre sign whlch was
replaced wlth a whlte rrf,ltr. Thls reducec the slgn to approxlmately 38 sq.ft.
as it presently exlsts. At that tlme, the Commun I ty Developrnent oePartment _also denied Hr. Schmidtts request to change to yel low letters. The whlte, of
course, ls virtually useless durlng those rpnths when there is snow on the roof
and noi too much better against the llght grey background of the roof.
An appl lcatlon for variance was subnitted for a free-standlng sign of-55 sq.ft.
on Harch 29, 1985. ln that submlttal, the following items rvere estat'llshed
(back-up daia shout C be on flle with the Town of Vail):
l. The economic profile of Hr. Schmldtrs business is quite
dif ferent then t:lost restaurants in the Tovrn, in that hi s
hlgh periods are in the summer tlme.

copy of the original approval; however, we do have a recorded
approval of the change of locatlon of the origlnal slgn dated
October 18, 1979 noted by the approving authority as trminor

McDonaIds is requesting variances from the following sections of the Townof Vail Sign Code for the corrnercjal core III.

The specific request is for two 35 s.f. signs, one to be located on the
east elevation mansard roof, the other to be located on the west elevation
mansard roof. The signage design is a McDonald's Golden Arch logo that
wi'l 'l stand a'l one without a background against thjs nansard roof. Itshould be noted that in the accompanying rnemo from the Community
Development Dept. to Design Review Board there is a'l so a request for
variance from Section 16.22.155 C, No part of this sign shall extendabove... or the plate line of the bui'l ding. The applicant revised his
submittal just prior to the Design Review Board meeting to eliminate the
need for variance from this sect'i on of the code. The entire proposed
signage is now below the p1 ate line of the building.
The Design Review Boand failed to pass a motjon for approval for the s.i gn
variance request by a vote of 2-3. Failure to uphold a motion for
approval constitutes a recommendation of denial on this proposal from the
Design Review Board. Members of the board votjng against the motion
expressed concern over the degree of special cjncumstance involved, and
one board member expressed concern over the pnoposed design. Staff
recommendation for the proposal is for approval.

McDonald's Restaurant, as a single business use in comrnercial core III,qualifies for a wal'l sign, single business use as defined in Section
16.22.155 of the Town of Vail sign code.
BACKGROUND
At the time of the original annexation of west vail, the Town recognizedthat the west vai'l commercial area varied significantly from the cil and
Lionshead commercia] areas. The commercial core III zone district wascreated to facilitate development of commun.i ty based, automob.i leoriented, commercial, retail and offjce center with support uses. The
Town of vail sign code was amended to inc'l ude prov'i sions for the ccIII
area with this development phi'losophy in mind. The sign code for cclII
was written in an attempt to provide adequate s.i gnage for businesses,while taking into account the s'i gnage that was allowed under EagleCoulty regulations and also the basic guidelines of the exjsting Town ofVai1 sign code.
At the time McDonal d's was annexed into the Town of Vail, their signage
consjsted of approximately 86 square feet mounted on the mansard rooffacing south. That sign was subsequently moved to face east in itspresent position. After djscussion wjth the Community Development
Department, the logo portion of the sign was removed and replaced with a

As this application responds to the Design Review Board concernsof the previous submittal , we feel that the detr.iment to theneighborhood and adjacent properties have been minjmized as
compared to the previous submittal . liugh Schmidt, the owner-operator, opened the Vail lilcDonaldts In Septenber of
1977 ln what was then the unincorporated area of Eagle County. At that tlne it
haC a slgn of approxinately 86 sq.ft. rounted on the mansard rcof facing south.
That slgn was subsequently roved to face eest in lts present positlon. After
the area was annexeC into the Tor.rn of Vall In August l!82, the Cornmunity
Developnent Department forced retlrcval of the logo portlon of tl"e sign whlch was
replaced wlth a white rrl4rr. This reduceC the slgn to approximately lE sq.ft.
as it presently exists. At that tlre, the Community Developrnent Department
also denied Hr. SchmiCtrs request to change to yellow letters. The whlte, of
course, ls virtually useless during those ronths when there is snow on the roof
and not too much better against the llght grey background of the roof.
An applicatlon for variance was subnitteC for a free-standlng sign of 55 sq.ft.
on Harch 29, 1985. In that submlttal, the following items rvere establlshed

The next item was Resolution No. 19, Serjes of 1986, finding substantial complianceof a petition for an annexation election concerning the area of West Vail commonly
known as Vail Ridge. Larry Eskwith presented a map and plat of the area and thepetitions to Mayor Johnston. Ron Phillips swore in Pamela Brandmeyer, Town C1erk,
as the first witness. She then testjfjed the petitions and attachments had been
del'ivered to her on July 3, 1986, whjch were marked as Exhibit 1. She alsotestified that the mylar of the annexation plat was true and correct, which was then
marked as Exhibjt 2. At this time, Steve Highland was sworn. He testified that he
as a resident in the area to be annexed and had seen the plat before. He alsotestified he was involved jn the annexation process in that he was chosen by the
West Vajl Citizens for Reannexation to spearhead the process for hjs area. He thentestified that he had researched the County records, and the number of quafified
electors who are resident jn and land owners of the Vail Ridge area are one hundred
one (101); also that there were sixteen (16) signatures on the petitions, which is
more than the required ten percent (10%). He then testified that the petitions
satjsfied a1 I requirements of Colorado State law. At this time, Hermann Staufer
made a motion to approve the resolution, and Dan Corcoran seconded. A vote was
taken and the motion passed unanimously 7-0.
