The PEC votcd unanimously at their June l2*,2000 meeting to approve the conditional use permit application tbr a Type II employee housing unit. This approval is subject to the following conditions: l. Prior to the issuance of a building permit, the applicant shall submit a Type II EHU deed restriction to the Town of Vail Department of Community Development. This document shall be recorded at the Eagle County Clerk and Recorder's Office and wiil require that the employee housing unit be permanently restricted for employee housing. 2. The srb plan has aheady been adjusted and complies with this requirement, 2. Please complete and submit a revocable right-of-way permit. This is required for the proposed boulders in the right-of-way along the north side ofthe property and for the large boulder that will be moved into the 10 foot drainage easement along the west side of the pfoperfy. 3. DESCRIPTION OF THE PROPOSED USE In September and December of 1992, the Town Council passed Ordinances 9 and 27, Series of 1992, to create Chapter 13 (Employee Housing) which provides for the addition of Employee Housing Units (EHUs) as permitted or conditional uses within certain zone districts. In April of 2000, the Town Council passed Ordinance 6, Series of 2000, to repeal and reenact this chapter and provide additional incentives for the creation of employee housing in Vail. ln Section 12-2-2, an Employee Housing Unit is defined as follows: Section 12-2-2 Employee Housing Unit (EHU): A dwelling unit which shall not be leased or rented for any peiod less than thitty (30) consecutive days, and shall be rcnted only to tenants who arc full-time employees of Eagle County. EHUs shall be allowed in certain zone districts as sef forth in this Title (Section 12-13). Development sfandands for EHUs shall be as provided in Chapter 13, "EmployeeHousing"of thisTitle. Forthepurposes of thisdefinition,aTull-time" employee shall mean a person who works a minimum of an average of thirty (30) hours perweek. There shall be five (5) categoies of EHUs: Type l, Type il, Type lll, Type lV, and Type V. Provisions relating to each type of EHU are sef forth in Chapter 13, "Employee Housing" of this Title. The applicant is proposing a Type ll employee housing unit above a proposed three-car garage. The employee housing unit will be approximately 984 square feet in size and will include two bathrooms, a full kitchen, a living room, and two bedrooms. One enclosed parking space will also be provided for the EHU. The applicant is proposing to utilize the 500 squafe foot GRFA credit. II. STAFF RECOMMENDATION The Community Development Department recommends approval of this application for a Type ll Employee Housing Unit, based on the following findings: 1. That the proposed location of the use is in accordance with the purposes of Section 12-13 (Employee Housing) and the purposes of the district in which the site is located. That the proposed location of the use end the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. Relationship and impact of the use on the development obiectives of the Town. When the Town Council adopted the Town of Vail Affordable Housing Study on November 20, 1990, it recognized a need to increase the supply of locals/employee housing units. The Town encourages EHUs as a means of providing quality living conditions and expanding the supply of employee housing for both year-round and seasonal local residents. The proposed unit will have a positive impact on the Town's rental housing needs. 2. The effect of the use on liqht and air. distribution of population. transportation facilities, utilities, schools, parks and recreation facilities. and other public facilities needs. Staff believes that there will be little impact from the proposed Type ll 3. EHU on light, air, population, transportation, utilities, schools or parks. Effect upon traffic with particular reference to conqestion, automotive and pedestrian safetv and convenience, traffic flow and control, access. maneuverabilitv, and removal of snow from the street and parkino areas. Two additional vehicles are anticipated in association with this EHU. One enclosed parking space and one surface parking space are proposed. Staff feels that this would be an insignificant impact on the above-referenced criteria. Snow storage will be accommodated on the property. The driveway area and entrance will be reduced to conform to development standards. Effect upon the character of the area in which the proposed use is to be located. includino the scale and bulk of the proposed use in relation to surroundinq uses. The scale and bulk of this proposed structure is very similar to those in existence in the suri'ounding neighborhood. Staff believes that the proposal will not significantly impact the scale and bulk of this project in relation to sunounding uses. The proposal is also consistent with the development standards applicable to this property. Staff is not aware of any other EHUs in the vicinity. However, the existence of a Type ll EHU should in no way alter the residential character of the neighborhood. Employee Housinq Units mav be allowed as a conditional use in those zone districts as specified bv Section 12-13 of the Vail Municipal Code, E'rir.,/oyee Housrng and shall be subiect to the following requirements: a. Zonins districts permitted bv ilcht or bv conditional use. However, the use of the EHU bonus (500 sq.ft) would eliminate your ability to apply for a 250 sq.ft. addition that would nonnally be allowed for each unit. Construction of an EIIU also requires a conditional use permit from the Planning and Environmental Commission. As mentioned previousll prior to approl'al ofa development pla4 it will be necessary to have a site-specific geological investigation conducted by a qualifted geologist or engineer. Development approval would be contingent upon the recommendation of the geologist or engineer and could potentially require mitigation measures.
