Dear Ben:
I just wanted to update you on the status of your project. The PEC votcd unanimously at their
June l2*,2000 meeting to approve the conditional use permit application tbr a Type II employee
housing unit. This approval is subject to the following conditions:
l. Prior to the issuance of a building permit, the applicant shall submit a Type II EHU deed
restriction to the Town of Vail Department of Community Development. This document
shall be recorded at the Eagle County Clerk and Recorder's Office and wiil require that the
employee housing unit be permanently restricted for employee housing.
2. That the curb cut located at the driveway entrance to the property shall be brought into
conformity with the Development Standards.
3. That no application for a building permit, grading permit, or subdivision shall be approved
until a site-specific geologic invesrigation, conducted by a professional geologist or registered
professional engineer, is complcted (per section 12-21-15 (8.1.).

are critical and will deiay your building permit approvai if not submitted in a timely manner.
At their meeting on June 7ft, 2000, the Design Review Board voted in favor of the following
motion:

tt '". 'F,our revised landscape plan and site plans have been reviewed by members of the Development':", Review Team. There are a few aiterations that are required prior to final design approval:
Public Works Requirements:
1. Finished grades must not be greater than 2: l; please adjust the landscape plan accordingly
(i.e. proposed grades on the east and west sides of structures near boulder retaining walls).
The srb plan has aheady been adjusted and complies with this requirement,
2. Please complete and submit a revocable right-of-way permit. This is required for the
proposed boulders in the right-of-way along the north side ofthe property and for the large
boulder that will be moved into the 10 foot drainage easement along the west side of the
pfoperfy.
3. Delineate the snow storage area within the Fopeffy boundaries (30% of driveway area
required).
Planning Requirements
I . On the site ptan, please identif,i roof ridges and ridge elevations for all proposed structures.
Also indicate the existing and proposed grades undemeath these ridges (i.e. show contours
running undemeath building footprints). (An ILC will be required prior to a framing
inspection to determine building height. At no point along a roof ridge, is the height to be
greater than 33 feet above existing or finished grade (whichever is more restrictive)),
2. Submit a roofplan indicating roofpitches and drainage system (i.e. gutters and downspouts).
3. Please submit three sets of completed site, landscape, and floor plans. These plans must be
drawn to scale. "NTS" measurements are .
Provided that all of these requirements are met, you will receive frnal design approval fiom
planning staff subject to the following conditions:

2. Boulder retaining walls that exceed 4 feet in height will require engineer-stamped and
approved drawings.

Your conceptual plans have been reviewed by members of the Town's Development Review Team and
by the Design Review Board. The following issucs havo been raised which should be resolved prior to
final rwiew of fhe plans:
Public Works Issues:
l. Engineer-stamped and approved drawings must be provided for boulder retaining walls that exceed 4
feet in height and also for the double tier wall on the east side of uuit A (if wall is existing, it does not
require a stamp)
2. Sheet 5 of 6 shows a boulder retaining wall at 8.5 feet in height; no retaining wall can exceed 6 feet
(if wall is existing, it does not require a stamp)
3. Indicate where snow storage is to be accommodated on the property. This space must be no less tlan
30% of the driveway area for an unheated driveway and no less than l0% for a heated driveway.
4. Finished grades must not be greater than 2:l; please adjust the site plan accordingly (ie. proposed
grades on the east and west sides of structures near boulder retaining walls)

(the DRB referred to decks, deck railings, and log and timber building materials)4. Eliminate trim boards on comers and use wood trim instead of stucco 'pop-out' trim5. Re-orient roof planes or add donners to stop snow-shedding onto pedestrian areas and also to create
'undulation' bctween the roofs on the existing and proposed structures (ie. break up long roof planes)

I. DESCRIPTION OF THE PROPOSED USE
In September and December of 1992, the Town Council passed Ordinances 9 and 27, Series
of 1992, to create Chapter 13 (Employee Housing) which provides for the addition of
Employee Housing Units (EHUs) as permitted or conditional uses within certain zone districts.
In April of 2000, the Town Council passed Ordinance 6, Series of 2000, to repeal and reenact
this chapter and provide additional incentives for the creation of employee housing in Vail. ln
Section 12-2-2, an Employee Housing Unit is defined as follows:
Section 12-2-2
Employee Housing Unit (EHU): A dwelling unit which shall not be leased or
rented for any peiod less than thitty (30) consecutive days, and shall be rcnted
only to tenants who arc full-time employees of Eagle County. EHUs shall be
allowed in certain zone districts as sef forth in this Title (Section 12-13).
Development sfandands for EHUs shall be as provided in Chapter 13,
"EmployeeHousing"of thisTitle. Forthepurposes of thisdefinition,aTull-time"
employee shall mean a person who works a minimum of an average of thirty
(30) hours perweek. There shall be five (5) categoies of EHUs: Type l, Type il,
Type lll, Type lV, and Type V. Provisions relating to each type of EHU are sef
forth in Chapter 13, "Employee Housing" of this Title.
The applicant is proposing a Type ll employee housing unit above a proposed three-car
garage. The employee housing unit will be approximately 984 square feet in size and will
include two bathrooms, a full kitchen, a living room, and two bedrooms. One enclosed parking
space will also be provided for the EHU. The applicant is proposing to utilize the 500 squafe
foot GRFA credit.
II. STAFF RECOMMENDATION
The Community Development Department recommends approval of this application for a Type
ll Employee Housing Unit, based on the following findings:
1. That the proposed location of the use is in accordance with the purposes of
Section 12-13 (Employee Housing) and the purposes of the district in which the
site is located.
That the proposed location of the use end the conditions under which it would
be operated or maintained would not be detrimental to the public health, safety,
or welfare or materially injurious to properties or improvements in the vicinity.
That the proposed use would comply with each of the applicable provisions of
Section 12-16 (Conditional Use Permits) of the Vail Municipal Code.
lf the Planning and Environmental Commission chooses to approve this application, the
Community Development Department recommends the following conditions:
1. Priorto the issuance of a building permit, the applicant shall submit a Type ll
EHU deed restriction to the Town of Vail Department of Community
Development. This document shall be recorded at the Eagle County Clerk and
Recorde/s Otfice and will require that the employee housing unit be
permanently restricted for employee housing.
2. That the curb cut located at the driveway entrance to the property shall be
brought into conformity with the Development Standards.
3. That no application for a building permit, grading permit, or subdivision shall be
approved until a site-specific geologic investigation, conducted by a professional
geclogist or registered professional engineer, is completed (per section 12-21-

Please note that under Section 12-16 of the Vail Town Code, the approval of a conditional use
permit shall lapse and become void if a building permit is not obtained and construction not
commenced and diligently pursued toward completion, or the use for which the approval has
been granted has not commenced within two years from when the approval becomes final.

]V.CRITERIA AND FINDINGS
A. Consideration of Factors:
Before acting on a conditional use permit application, the Planning and Environmental
Commission shall consider the factors with respect to the proposed use:
1. Relationship and impact of the use on the development obiectives of the
Town.
When the Town Council adopted the Town of Vail Affordable Housing
Study on November 20, 1990, it recognized a need to increase the
supply of locals/employee housing units. The Town encourages EHUs
as a means of providing quality living conditions and expanding the
supply of employee housing for both year-round and seasonal local
residents. The proposed unit will have a positive impact on the Town's
rental housing needs.
2. The effect of the use on liqht and air. distribution of population.
transportation facilities, utilities, schools, parks and recreation facilities.
and other public facilities needs.
Staff believes that there will be little impact from the proposed Type ll

EHU on light, air, population, transportation, utilities, schools or parks.
Effect upon traffic with particular reference to conqestion, automotive
and pedestrian safetv and convenience, traffic flow and control, access.
maneuverabilitv, and removal of snow from the street and parkino areas.
Two additional vehicles are anticipated in association with this EHU.
One enclosed parking space and one surface parking space are
proposed. Staff feels that this would be an insignificant impact on the
above-referenced criteria. Snow storage will be accommodated on the
property. The driveway area and entrance will be reduced to conform to
development standards.
Effect upon the character of the area in which the proposed use is to be
located. includino the scale and bulk of the proposed use in relation to
surroundinq uses.
The scale and bulk of this proposed structure is very similar to those in
existence in the suri'ounding neighborhood. Staff believes that the
proposal will not significantly impact the scale and bulk of this project in
relation to sunounding uses. The proposal is also consistent with the
development standards applicable to this property. Staff is not aware of
any other EHUs in the vicinity. However, the existence of a Type ll EHU
should in no way alter the residential character of the neighborhood.
Employee Housinq Units mav be allowed as a conditional use in those
zone districts as specified bv Section 12-13 of the Vail Municipal Code,
E'rir.,/oyee Housrng and shall be subiect to the following requirements:
a. Zonins districts permitted bv ilcht or bv conditional use.
Type ll EHUs are a conditional use in the Single-Family Residential, Two
Family Residential, Primary/Secondary Residential, and Agriculture &
Open Space zone districts. The subject property is zoned Two-Family
Residential.
b. Ownership/Transference.
The EHU shall not be sold or transferred separately from the unit it is
associated with. The applicants are not proposing to sell or transfer the
EHtJ separately fronr the free-rnai'ket dwelling units.
c. AdditionalGRFA.
The EHU is entitled to an additional 500 s.f. GRFA credit which the
appiicant is propcsing to utilize.

d. Garaoe CrediVStoraqe Requirement
A 300 s.f. garage credit is allowed for the EHU. All units not constructed
with a garage shall be required a minimum 75 s.f. of storage area in
addition to normal closet space. This 75 s.f. shall be a credit for storage
only. The applicants are proposing to utilize the 300 s.f. garage credit to
accommodate one of two required parking spaces for the EHU.
e. Parkinq
Parking requirements for EHUs are per Chapter 12-10. The proposed
El-ilj will be 984 s.f. in size and requires two parking spaces. The
applicants are proposing :wo parking spaces for the EHU: one enclosed
anc one surface.

The minimum square footage for a Type ll EHU is 300 s.f. and the

This is a follow-up letter to our pre-application meeting regarding the potcntial for garage and EHU development on
your property located at 2490 Bald Mountain Road. You also received a letter (dated August 27, 1999) which
outlined the development potential for your properfy. One important note is that yotu lot size was reported in that
letter as being 20,4'73.2 sq.ft. According to the plans we have on frle, your lot size is 15,663 sq.ft. A topographic
survey will be able to veriS the lot size. Regardless, there should be ample site coverage and GRFA remaining on
your property to construct a garage and EHU as plarned.

Just to clari$, if you chose to constmct the EHU, you would receive a bonus of 500 sq.ft. which would be added to
the total remaining GRFA on the property. This would bring the total GRFA ttxat you have to work with ro 2210
sq.ft. Of this GRFA, you could construct an EHU between 300 sq.ft. and 900 sq.fl- in size. However, the use of the
EHU bonus (500 sq.ft) would eliminate your ability to apply for a 250 sq.ft. addition that would nonnally be
allowed for each unit. Construction of an EIIU also requires a conditional use permit from the Planning and
Environmental Commission.
As mentioned previousll prior to approl'al ofa development pla4 it will be necessary to have a site-specific
geological investigation conducted by a qualifted geologist or engineer. Development approval would be contingent
upon the recommendation of the geologist or engineer and could potentially require mitigation measures.
