I represent ]r'tssrs. Anderson and hrol1ard, the - owners of a duplex
iesiience located on Lot 34, Block Z, Viit Vi1lage, Thirteenth
fiii"g. Irtr. Frank Pettee oi P"ttee industries was the owner and

rrfri"qir"ntly subdivided the 1ot and conveyed the East one-ha1f to
Raynroi<l Young who has in turn conveyed it to llur.ral..DeY"iopt:l|.Cornoration. lrlr. Pettee is sti11 the owner of the West one-halt
and' apparently resides there
At thc time the duplex was constructed by Pettee Industries, for
rt,[atcvcr reason, ignored the 15 foot side yard setbacks and, in
fact, built sonre seven feet over the lot line to the lfest. Sub-
sequently, Pettee lndustries subdivided the 1ot into three s-eparate
p;;;;i;,'on" under each the East and ltest duplexes and the third
Ls all ihe remaining common area. This, if properly done and.
surv-yed, should haie been readily apparent under the Town sub-
division regulations.
A preliminary review of the Townts files fails to show any indica-
tibn of any Lvidence of cornpliance with either building inspection,
;i;; ;h".k'or subdivision cbnpliance. We are, at this p-oint, look-
i.rrg to the Town for answert ,ttd assistance in rernoving the encroach-
rufit ott ny clientrs proDerty and obtaining cornpliance with the re-
qui red setbacks

It would appear that in spite of what has alr-eady occutred_, that there
is relief'ttrat can be obtained in cases of this type by the Hargraves
vs Skrbina case decided about two years ago by the Colorado Court of
Appeals. We shall await a res_ponsb se,tting_ forth the Townrs position
oir- this matter. I enclose a detail taken from a survey done by Eagle
Valley Engineering.

We have complied with Mr. Ottors request since the construction has ceased.
since we must live in cLose proximity to one another as neighbors, I would fike
to eliminate any hard feelings betneen us. It is ny feeling that the changes we
have made improve and enhance your ProPerty as well as mine '
I apologize for the inconvenience that may have been present for you during the

tried to inform atl the sub-contractors;but since there were many different

As you are probably aware, the system is funded on three CMU piers on
one continuous footing. Above this is a 6 inch concrete slab which
picks up interior masonry'loads and transfers them'into the piers-and
iootings. I find that the slab is capable of transferping these loads
as per its intended PurPose.
