Per our discussion, attached is additional information for the current Minor Alteration submittal.
Below is a narrative corresponding to the attached drawings, which are in addition to the exterior
lighting issues you already have in you possession.
Some of these issues pertain to either the original house or the recently completed cabana. But as
we have done in the past (because of one owner, and the lot line abandenments) we are
submitting this as one property.
There are five main issues in this request;
l. Exterior lighting (drawings and narrative previously submitted).
2. Addition of exterior stone veneer at existing house. Re; attached drawings "4 - Main
Level Floor Plan", and "13 - Exterior Elevations".
3. Addition of "man-door" in existing garage door at original house. Re; drawing " I 3 -
Exterior Elevations.
4. Extension ofexisting fence along new cabana from existing house. Re; drawings "l -
Site Plan (existing house site indicating location of existing fence) and A10l - (new
cabana) Site Plan. Existing and new fence design indicated on drawing "l- Site Fence".
5. Add stone/slab on grade patio outside billiards room, north side of cabana. (Per
previous submittal landscaped area required is 9,900 s.f., existing is 10,422. Re; attached
previous DRB application).

5. A request for an amendment to Section 18.54.050 J (Design Guidelines - outdoor
lighting), to allow for the exemption of low wattage lighting from the outdoor lighting
regulations.

Dominic Mauriello gave an overuiew of the staff memo and explained that this was lo allow low
level lighting to make a property safer, after lhe DRB final review. He then explained the new
language.
Greg Moffet asked if the applicant had anything to add.
John Schofield thought the 25 watt output was on the low side and he thought it should be in the
40 watt range. He said stairs typically have wattage in the 40-60 watl range.
Gene Uselton said this was a sensible proposal.
Greg Amsden said he was in favor of this, as it was a safety issue.
Ann Bishop had no comments.
Diane Golden agreed with the safely issue.
Greg Moffet said he agreed with the safety issue.
John Schofield made a motion for approval with a change in the language to include a maximum
initial lumen output of 400 (or equivalent to a 40 walt bulb).
Gene Uselton seconded the motion.
The molion passed by a vote of 6-0.

As requested, a representative from our office inspected the soil exposed in the proposed pool excavation
at the subject site on July 28,29 and August 4, t997. The purpose ofour inspection was to veri! that
the exposed materials would safely support the proposed pool.
1'he depth of the excavation varied frorn 2.0 to 9.0 feet. The materials exposed in the bottom of the
excavatiorr consisted of 1.5 to 5.0 feet of crushed rock. Beneath the crushed rock, the subsurface
tnaterials consisted of a moist to wet, dense, gravelly, sandy, silt with some cobbles. The exposed soils
and crushed rock within the excavation were compacted in accordance with our recommendations. ln
our opinion, the natural soils and the crushed rock will safely support the proposed pool. Our opinion is
based on the natural soils remaining unsaturated.

I vieited the above referenced home in Vail recently ior purposegof a geologic hazard evaluation, especially as it pertains torock {all potential . As you know thie hazard ig noted on theTown o{ Vail's ,naps as encroaching onto the property, wtth"l"ledlum" designation. In addition, debris flow and aval anchehazard are mapped as extending to the south side of the road.The expansion, aE ghown on your mapts (where the western home willbe razed), is on the north Eide of the road, further {rom thesource o{ rocks, and out of the other two zones.
The topography ig such that rocks will tend to stop in the heavyaspen growth on the Eolrth stde of the road. The outcropping ofrocks above the lot is minor and quite a distance from thishouse. I saw no large rockE near this home. Even though it isnot likely that mud or snow can reach the proposed expanlion, ttwould be prudent to landscape and grade the front (eouth) side ofthe property to preclude material from approaching area6 ofvulnerability. In addition to the walle shown, perhap- the entrydrive could have a high point in it at about the property line toprevent material from entering very far. The near gide of thehome (front) should be planned accordingly.

Enclosed is an application for a "Demolition Permit". Our intentions are to remove the
entire structure along with all miscellaneous improvements such as patios, driveways, etc.
as soon as possible. A new single family residence will be constructed in its place. The
tentative schedule is for this project to commence by July 15, 1996. According to the
architect, Bill Pierce, he anticipates having the Architectural and Structural plans for the
new residence available for me to apply for a Building Permit by June 24,1996.
Prior to demolition, we will be erecting a 7' to 8' high screen fence along the 3 property
lines. Other than trucks having street access in order to haul out the debris, we will not
be doing any work within the Right-A-Way area at this time.

Dear Bill:
Thank you for appearing before the Design Revierv Board on Wednesday, April 3, 1996, with the proposed
May residence, located at 1067 Ptarmigan Road.
Design Rwiew Board
As you are aware, the Desigt Review Board conceptually reviewed the proposed May residence. Upon
completion of their conccptual review, the Design Review Board's only questions or concerns were with
regard to the proposed relocation of the existing trees and the addition of some form of architectural element
on the long expanse of roof on the north elevation. The Desigr Review Board indicated that the four
proposed spruce trees adjacent to the property on the golfcourse be moved back onto the May property.
The Design Revierv Board felt thc best location for the relocated spruce trees would be immediately
adjaccnt to the pool wall and fence along thc north property line. It was felt that thc sprucc trees placed in
this location would act as a good buffer between thc golfcourse and the proposed pool deck.
The Design Review Board also had concerns regarding the large expanse ofroofon thc north elevation of
the building. It was felt that some form of architectural projection or feature be added to help break up the
roof, Each of thesc concerns needs to be addressed by yourself or Dale Smith at the time of final review of
the proposed May residence.
Zonins Analvsis
Thc Communify Development Department staffhas compleled a Zoning Analysis of the proposed project.
Each of the items listed below addresses an issue which must be resolved prior to final review by the Design
Review Board. Final review for the May residence is tentatively scheduled for April 17, 1996. The
following items must be addre.ssed:
l . As drawn, the garage portion of the building is in lhe front setback. If you do not propose to have
the building locatsd in the front setbach please make the appropriate changes. Ifyour desire is to
have the building in the fronl setback, please complete and submit an application for a front setback
variance for review by the Planning and Environmental Commission.

linc. As I believe youire awarb, fences, hedges andwalls cannot exceed 3'in height in the front
setback.
8. In order to determine whether the proposal complies with the Outdoor Lighting Ordinance, please
show all proposed exterior tighs on the sitc plan, as well as the appropriate building elevations.
Based upon your lot size of 16,500 q. ft., seventctn exterior lights are permitted on the property.
9. prior to the issuance of a Building Permit for the construction of the proposed May residence,-a
revocable Right-of-Way Permit will need to be issued for the improvements shown in the public
right-of-way.
10. To determine the limit of disturbance for the demo/rebuild, please indicate on the site plan and the
landscape plan, a proposed limit of disturbance. Additionally, thc limil of disturbance should be
delineaicd'on tire property during construction with a construction fence to protect the undisturbed ,
areas.

The purpose of this submittal is to review the existing TOV Lighting Ordinance and it's possible
alteration. I would like to review three things; it's stated intent, i.e. why it was created; the
existing Ordinance in terms of it's specific requirements; and difficulties that are arising with it.
With this in mind, I would then like to review potential amendment(s) to the Ordinance.
As stated in the Ordinance, it's intent is ".../o minimize the unintended and undesirable side ffict
ofoutdoor lighting, while encouraging the intended and desirable safety and aesthetic purposes
of outdoor lighting..." artd"...to protect the legitimate privacy of neighboringresidents...".This
concept is still valid and conect. However many of the specific requirements generated to
implement this concept are no longer valid.
The Ordinance, as it is cunently written, uses the area of a given site to determine the quantity
of "light sources" allowed for that site ( a light source being defined as "a single artificial point
source of luminescence...". One light source is permitted for each one lhousand square feet of site
area. Other definitions noted in the Ordinance include;
Luminous Area - the maximum light emitting from a single source (the physical area of
source measured in square inches).
Source Lumens - total initial lamp lumens of the light source.
Height Limits - maximum mounting height for residential applications is eight feet (8').
Luminance - a ratio of source lumens to luminous area.
Exemptions - current residential exemptions include Christmas tree lights, and [address]
sign illumination.
These requirements were based on the lighting technology and desired aesthetic effects available
at the time the Ordinance was written. These requirements no longer fully accomplish the goals
for which they were intended. With the existing codes, it is possible to meet all requirements, yet
still create undesirable side effects. New technology which uses both smaller light sources and
lower luminous output are discouraged with the existing wording of the code due to the quantity
restriction. The current Ordinance provides no means for the Town or Design Review Board to
make any subjective exceptions to accommodate new technology and design concepts.

Re: Exterior Lighting Discussion with the Design Review Board
On Wednesday, September 17, 1997, the Design Review Board discussed the Town's exterior
lighting ordinance. The discussion was in response to a request of a local architectural firm to use
new technologies in outdoor lighting such as fiber optics.
The following is a summary of the DRB's comments on the issue:
o The current ordinance that regulates lighting based on lot size does not necessarily address
the problems associated with outdoor lighting.
o The idea of allowing low-level ground lighting seems reasonable.
o Amend the ordinance to regulate a maximum luminous output for a site and but less
emphasis on the numbers of lights.
o Do not further complicate the existing ordinance if we make changes.
o Create exemptions for certain types (exit lights, step lights, etc.) or levels (less than "X"
luminous output, fully cut-off, etc.) of lighting when it comes to quanttty'
o Continue to ensure no negative impacts on adjoining properties.
o Establish development standards (orientation, height, location" etc.) for outdoor lighting
and relax the current regulations.
o The Town should amend regulafions to keep pace with new technologies.
e Consider a foot candle measurement for the development as a whole.
Again, the above thoughts are the result of the DRB discussion on the outdoor lighting issue. I
would suggest that we discuss the issue at greater length and possibly make changes to the
existing ordinance. In my opinion, however, this is not necessarily a top priority given the current
staffing situation.

inches above grade and are either fully cutotf or have a maximum initial lumen output
of 250, from the total allowable number of exterior light sources permitted on a
property.

I. DESCRIPTION OF THE REOUEST
The applicant is requesting an amendment to the Zoning Code to allow additional exterior light
sources beyond the total allowable number of exterior light sources permitted on a property. The
additional light sources are proposed to be no more than 18 inches above grade and are either fully
cutoff or have a maximum lumen ouFut of 250 (the equivalent ot a25 watt bulb).
The proposed code revision would amend Section 18.54.050(J)2b (Design Guidelines - Outdoor
Lighting - Frequency). The existing text is shown for reference, the proposed additional text is
shown in itallcs.
b. Frequency. For lots in residential zone districts, the maximum number of light sources per
lot shall be limited to one light source per one thousand square feet of lot area. The location
of said lights shall be left open to the discretion of the property owner, so long as the lights
are in compliance with the Town ot Vail's Municipal Code.
Lights sources, which are placed no more than 18" above finished grade, and are either fully
cutoff, as defined by Section 18.04.137, or have a maximum initial lumen output of 250
(equvilent to a 25 watt bulb), may be allowed in addition to the total number of permitted
outdoor light sources. Number, location and style of such light sources is subject to Design
Review.
The proposed text change would allow lights such as, step lights, landscape lights and walkway
lighting, in addition to the lights currently permitted. These lights are generally recessed into walls
or mounted just above ground level and provide lighting for a small area. The applicant has
indicated that because the current regulations limit the total number of lights per site, there is a
tendency to use one brighter light than to use smaller more focused lights. The result is a greater
impact on adjacent properties from these brighter lights, The applicant has stated that the proposed
change meets the intent of the lighting regulations which is to minimuze the unintended and
undesirable effects of outdoor lighting.
II. BACKGROUND
In 1993, the Design Guidelines were amended to add the outdoor lighting regulations. The current
regulations for residential properties limit the maximum number of light fixtures to one light source
per 1,000 square feet ol lot area. For example, a 15,000 square foot lot is permitted a maximum of
15 exterior light sources. There are also resrictions on the total luminance of each fixture and the
maximum height. The only light sources which are currently exempt from these regulations include
Christmas tree lights, sign illumination and municipal lighting. See attached for the complete
regulations for outdoor lighting.
III. CONFORMITV WITH THE TOWN'S RELEVANT PLANNING DOCUMENTS
In considering the proposed amendment to the Zoning Code, staff reviewed the intent of the Design
Guidelines and the purpose statement of the Outdoor Lighting.
Zoning Code
According to the purpose statement of the Design Review chapter, the intent of the design
guidelines is to ensure that development is compatible with the existing landscape and to
protect neighboring properties from negative impacts of development. The intent of the
Outdoor Lighting section of the Design Review chapter is to "minimize the unintended and
undesirable effects of outdoor lighting while encouraging the intended and desirable safety
and aesthetic purposes of outdoor lighting."
Staff believes that the proposed amendment is in accordance with both the purpose
statements of the Design Review chapter and of the Outdoor Lighting section of the Design
Review chapter. The ability to add additional low level lighting may reduce impacts on
adjacent properties. Property owners would have the ability to use these low level lights
which have limited impacts on adjacent properties, while improving safety, particularly
around steps and wallflvays. Staff believes that this proposed amendment will not negatively
impact adjacent properties and can improve the overall aesthetics of outdoor lighting.
IV. STAFF RECOMMENDATION
Staff recommends approval ol the proposed amendments to the Zoning Code, subject to the
following finding:
That the proposed amendment is in accordance with the purpose statements of the Design
Review Chapter of the Vail Municipal Code and is in accordance with the intent of the
Outdoor Lighting regulations of the Design Guidelines.

judgment of the Town to make reasonable provisions for completion of certain improvements

WHEREAS, the Developer wishes to provide collateral to guarantee performance of
this Agreement, including constructlon of the above-referenced improvements by means of the

NOW, THEREFORE, in consideration of the lollowing mutual covenants and
agreements, the Developer and the Town agree as follows:
1. The Developer agrees, at its sole cosl and expenses, to furnish all equipment
ald material necessary to perform and complete all improvements, on or before

improVements hs listed above, in accordance with all plans and specifications filed in the
office of the community Development Department, the Town of Vail, and to do allwork
incidental thereto according to and in compliance with the following:
a. Such other designs, drawings, maps, specifications, sketches, and other matter
submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspection of, and
to lhe satisfaction of, the Town Engineer, lhe To,,rrn Building Offlcial, or other
official from the Town of Vail, as affected by special districts or service districts,
as their respective interest may appear, and shall not be deemed complete until
approved ancl accepted as completed by the Town of Vail community
Development Department and Public Works Department.
2. To secure and guarantee performance of its obligatlons as set lorth herein, the
Developer agrees to provide security and collateral as follows:

6' lf the Town delermjnes that any of the improvements contemplated herein arenot.constructed in compliance with the plans and specifications set forth heiein by the date setforth in paragraph 2, the Town may, bui shall not be required to, withdraw from the cashdeposit such funds as may be necessary to complete the unfinished lmprovements. TheTown shall release such funds upon the written requesf of the staff of the CommunityDevelopment Department stating that the improv6ments have not been completed as requiredby the agreement. The Town shall not require the concurrence of the devetoper prior to therelease of the funds, nor shall the Town be required to verify independently that theimprovements have not been completed as required by this Agreement, but shall release suchfunds solely upon the request of the communily DeveiopmeniDepartment.
It the costs of completing the work exceed lhe amount of the deposit, lhe excess,
together with interest at twelve percent per annum, shall be a lien against the property andmry be collected by civil suit or may be certified to the treasurer of Eagle County'to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and tandscaping, as definecj in ihis
chapter, such failure or refusal shall be considered a violation of the Zoning code.
7. The Developer warrants all work and material for a period of one year after
acceplance ol all work referred to in this Agreemenl by the Town pursuant to section
17 '16.250 if such work is located on Town of Vail propefi or within Town of Vail right-of-way.

This letter is in response to your l-etter of June 11 , 1969, which item-ized certain discrepancies in the plans for the Talmage residence. Thefollowing are our coments and/or proposed corrections to these dis-
crepancies:
l. Enclosed, please find a detailed survey of the Talmage property
showing approximate location of the residence.
2. Found.ation wall reinforcement will be: vertical bars: #5 G 48"with voids filled with concretei horizontal bars: #6 @ 48" con-tained in concrete filled "U" blocks. This anount of steelyields 0.J-9 square inches per square foot total reinforcing.

30 inches. We are not aware that the Code requires this space,nor can \^/e see where our plans anywhere show l-ess than that.
8. A11 guard rails on balconies shown have no openings less than9 inches.
9. Windows in the west bedroom on the upper floor will be changed
from 2-418 windows to 2-422 to increase minimum open dimension
beyond that required (22"). A11 other wind.ows either complywith the Code or are not to be built at this time.
I0. Both fireplaces will- have hearths in accordance with the Code.
11 . We are attempting to find why a letter of approval from theArchitectural Control Cornrnittee has not been sent to your office.It is our understanding that the project has been approved.
