Dear Mr. Tobin and the Members of the Tyrolean Condominium Association:
I am in receipt of the letter to the Vail Town Council from the Tyrolean Condominium
Association regarding the Vail Mountain View Development, dated January 30, 2009.
The purpose ofmy letter is to respond to the three conserns identified in your letter as
they relate to the Vail Mountain View Development. First, with regard to the lack of
notice, the development application submitted and reyiewed for the development of the
project was a design review application. As such, the Town of Vail Design Review
Board held public hearings and conducted their review in accordance with the adopted
procedures for the application type. That said, I understand the concerns expressed by
the Association and will consider the them in light of the development review process
amendments the Town of Vail Community Development Deparlment is currently
preparing for Town Council review,
Second, the Association may be correct in their belief that the Town Code is vague with
regard to the interpretation of an underground parking structure. In the case of the Vail
Mountain View development, the Town of Vail Design Review Board, upon a thorough
and complete review of the design review application, determined that the proposed
development complied with both the intent and the prescribed design guidelines within
Chapter I I, Design Review, Vail Town Code. Again, the Association's concems and
input on this matter are duly noted and will also be considered as part of the development
review process amendments cunently underway.
Third, the Association is correct in their understanding that the underground parking
structure was "over-engineered" and constructed in a manner that could support a future
residential building. With that in mind, any future residential development on the Vail
Mountain View site will require adjacent property owner notification. While I can not
obligate the Toun to notice provisions beyond the legal requirements ofthe adopted
Town Code, I will commit to place a memorandum in the Vail Mountain View

The Town Code apparently docs not cunently contain a definition or other standards related to
what constihrtes an "underground stuctwe". Instea4 the Town relies on staff to exercise its subjective
discretion and interpretation in making a judgment call in that regard. For example, we have leamed that
Town staff, in reviewing Mountain View's development application, relied on the undergound parking
structues built at both Golden Feak (into the hillside) and bclow City Marta (Vail Coromns) as
prcoedents for allowing Mountain View's 'hnderground" pfltitrg stucfire. In rcality, the topographical
circumstances of these two ipecedents" are quite differem then at Mountain View, where the stucture
instead was built well above grade, and then partially covered with dirt ard landscaping.
Such a subjective system of determining what consiortes an underground stnrcture provides an
opportunity for abuses to take place, like that which has resulted a Mountain View in the opinion of the
Tyrolean Associatioo. As a result, the Tyrolean ownen barrc ultrmately been finmcially damagpd duc to
the urdeniable deseased value of their respective r€sidenoes. Therefore, in order to help prcveut this
fronn occuning again elsewhere in the Town, the Association requests that the Tovrn Council consider
amending the Town Code by adopting a clear definition or standards for "IJnderground Struchues", and
tlnt such definition or standards make clear that an above-ground srructure partially covered with dirt and
landscaping is not deemed to be an 'hnderground' stnrcture.
m. Future Development. Finally, the Tyrolean Association has leamed that the parking
stnrctue was "over-engineered" and construct€d in a rnanner that would support a future residential
building on top of il. Accordingly, the Association rcquests that the Town provide notice to the
Association and it's homeowner rrnobers of any public nreetings and hearings relared to any fuhue
developrent application(s) pertaining to the Mountain View sirc, even if processed ty-rigbt". ln
particular, the Association is strongly oppmod to my frrther developnent reking plac€ on top of fre
pa*ing structue, or any odrer activity that would fi[ther adversely impact or damage the Tyrolean
Association and its honreowners.

WHEREAS, the Developer, as a condition of of the Temporary Certificate of
Occupancy for

Agreement; and
WHEREAS, the Developer is obligated to provide security or collateral sufficient in ihe
judgement of the Town to make reasonable provisions for completion of certain improvements set
forth in the attached estimated bid(s) in accordance with the approved plans and specifications
filed in the office of the Community Development Department of the Town of Vail; and
WHEREAS, the Developer wishes to provide collateral to guarantee performance of this
Agreement, including completion of the all improvements referred to in this Agreement, by means
of the following:
The Developer agrees to establish a cash deposit account with the Town of Vail, as
escrow agent, in the amount of $ ? I ,RQS. o 6 as collateral for the
completion of all improvements refen'ed to in this Agreement, in the event there is a
default under this Agreement by the Developer.
NOW THEREFORE, in consideration of the following mutual covenants and agreements,
the Developer and the Town agree as follows:
1. The Developer agrees, at its sole cost and expense, to furnish all equipment and
materials necessary to perform and complete all improvements referred to in this Agreement. The
Developer agrees to complete all improvements referred to in this Agreement on or before the /tr

manner, all improvements refened to in this Agreement, in accordance with all approved plans
and specifications filed In the office of the Community Development Department of the Town of
Vail, and to do all work incidental thereto according to and in compliance with the following:

the satisfaction of, the Town Planner, the Town Engineer, the Town Building
Official, or other official from the Town of Vail, as affected by special districts or
service districts, as their respective interest may appear, and shall not be deemed

complete until approved and accepted as completed by the Community
Development Department and Public Works Department of the Town of Vail.2. To secure and guarantee pedormance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:
A cash deposit account with the Town of Vail, as escrow agent, in the amount of

referred to in this Agreement, in the event there is a default under this Agreement
by the Developer.
3. The Developer may at any time substitute the collateral originally set forth above
for another form of security or collateral acceptable to the Town to guarantee the faithful
completion of those improvements refened to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Tom, nor any
officer or employee thereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall be and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) arise out of or are based upon
any performance by the Developer hereunder; and the Developer shall reimburse the Town for
any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. lt is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements refened to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security refened to in this
Agreement and complete the uncompleted improvements refered to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy refened to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12o/o) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements referred to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

NOTES TO ALL APPLICANTS
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application
form and all accompanying material rnust be accepted by the Community Development Depaftment prior
to application deadlines. A schedule of DRB meetings and associated applicaUon deadlines may be found
on the World Wide Web at www.vailoov.com,
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forttr in Tide 12 (Zoning
Regulations) and Title 14 (Development Standards) of the Town of Vail Municipal Code.
Desion Review Board Meetino Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative, shall be present at the Design Review Board Hearing. Applicanb
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda until such time as the item has been republished.
If the DRB approves the application with conditions or modifications, all conditions of approval must be
resolved praor to the issuance of a building permit.

The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve wlth certain modifications, deny the application, or refer the application to the Design Review
Board for a decision, All staff approvals are reviewed by the Design Review Board and any staff decision
is subject to final apprwal by the DRB.

development review process in order to remove two existing private stairuays located

BACKGROUND RATIONALE:
Two stairways are currently located on the Town owned tract of land located adjacent
to the Gore Creek. The Tyrolean has two dwelling units in the building which are
accessible from the existing streamwalk south of the Tyrolean. These stairways
provide the only means of access to the two residential units below the Tyrolean
Restaurant. The applicant is seeking approval to combine the two units into one
dwelling unit. The new unit would have one entrance located between the previous
entrances and therefore is requesting the proposed stairs for access. The existing
stairs would be removed.
STAFF RECOMMENDATION:
Straff recommends approval of the request to proceed through the Design Review
process. The project can be staff approved upon Council approval.

I have reviewed your revised submittal for the proposcd modifications to the dwelling units
located at the Tyrolean restaurant. After reviewing the revised plans I have produced the
following comments:
l. The revised submittal is still incomplete. You have not provided the grading plan
with existing and proposed contours as request in the previous correspondence. I
have discussed thc requirements with Greg Hall, Town Engineer, and he needs to
see at a minimum five sections of the existing conditions aud proposed grading.
The five sections should begin at thc east side of the meter box and continue east
along building column lines. Ifyou havc any qucstions in regard to these sections
contact Greg Hall.
2. The Zoning Code requires that a title report with schedules A and B be provided
upon application in order to verifr ownership and list easements impacting the site.
As indicated previously, please provide a title report.
3' The proposed paver patio extends beyond the property line. Please revise the plan
to show this patio on the Tyrolean property. Also clearly show the limits of
proposed paver work. It is unclear from the plan where the pavers will end,

necessary. Afterreviewing the information submitted and meeting with you on the site I have
produced the following comments:

The need for this requiremcnt becamc evident to me after you explained the scope
ofthe project. The request involves regrading in orderto install a patio, correcta
drainage problem on site, and reconstruct a retaining wall. The Public Works
Departrnent will need a topographic suwey in order to properly evaluate the
proposal.
2. Please provide a grading plan which indicates existing and proposed contours. A
drainage plan is also required and can be incorporated into the grading plan. These
plans and all other site plans must show these improvements in context with
adjacent paths, stairs, stream, and the like.
3. Provide a landscapc plan showing any proposed and existing trees and other
vegetation.
4. Provide a lighting plan for the site. Indicate existing and proposed lighting and
provide details ofeach fixture.
