HomeMy WebLinkAboutVail Intermountain Block 6 Lot 11 January 20, 2005 David Reichardt PO Box 3867 Vail CO 81658-3867 CERTIFIED MAIL-RETURN RECEIPT REQUESTED Re: 2995 Basingdale Blvd Unapproved sheds, accumulation of junk Dear Mr. Reichardt: One of the many functions of Code Enforcement is to provide for the enforcement of the Town of Vail Municipal Codes. It has come to our attention that the above-described property may be in violation of the Town of Vail Municipal Codes as follows: Reported Violation(s): You have appliances, boxes, toilets, tires and many other miscellaneous items being stored outside of your residence. You also have 2 sheds which I cannot find a Design Review approval for. Section 12-11-3 (DESIGN APPROVAL) states, in part,that: A. Scope: No person shall commence removal of vegetation, site preparation, building construction or demolition, dumping of material upon a site, sign erection, exterior alteration or enlargement of an existing structure,paving, fencing or other improvements of open space within the corporate limits of the Town unless design approval has been granted as prescribed in this Chapter. The addition of plant materials to existing landscaping, gardening and landscape maintenance shall be exempt from this provision. B. Violation: It shall be a violation of this Chapter and the building permit for any person to commence, continue or complete work that has not received design approval as prescribed in this Chapter and/or is not in conformity with the plans approved and authorized by the Administrator and/or the Design Review Board and the Building Official. (Ord. 39(1983) § 1) Section 5-1-3 (KEEPING JUNK) states,in part,that: The storing or keeping by any person within the Town of any old articles or materials which may be classified as junk, adjacent to or in close proximity to any public building, public park or grounds, business buildings or residences without first providing fully enclosed buildings for the storage of the same, shall be deemed a public nuisance. It is specifically provided that trash, garbage and refuse and trash, garbage and refuse containers, barrels and cans must be obscured from view and not accessible to scavenging animals. It is further specifically provided that "junk" as referred to in this Chapter shall be expressly deemed to include, without limitation, any motor vehicle that is incapable of operation under its own power. A motor vehicle shall be presumed incapable of operation if it has remained in one location for a period in excess of thirty(30) days. (Ord. 16(1968) § 1: Ord. 15(1968) § 1: Ord. 18(1966) § 2(b)) Section 5-2-5 (RUBBLE STORAGE) states, in part,that: Rubble need not be stored in refuse containers or refuse storage rooms,but shall not be allowed to accumulate and shall be stored in such a manner as not to constitute or create an unsanitary or unsightly condition or a health or fire hazard. (Ord. 4(1973) § 4(b)) We are asking that you submit a complete Design Review application within 14 calendar days from receipt of this letter for the sheds. Please move all other items inside or off of the property within 14 calendar days from receipt of this letter. Failure to do so will result in a summons being issued. Your prompt attention regarding this matter will be greatly appreciated and will help assure that Vail continues to be the desirable and pleasant resort community for which we all strive.
