Fences, Hedges, lYalls, and Screening:
l.The placement of '"valls and fences shall respect existing land folms and fit into
land rnassing
2. Design of fences, walls, and other structural landscape fleahrres shall be of
materials compatible with the site and the nuterials of the structures on the site.

facilities.
Setbacks Observed:
All accessory uses and structures except fences, hedges, rvalls and landscaping, or
ground level site development such as rvalks, driveways, and teffaces shall be
located within the required minimum setback lines on each site. Recreational
amenities may be exempted by the Design l{eview Board if it deterrnines that their
location is not detrimental environmentally and/or aesthetically.
Sight Triangle:
To minimize traffic hazards at street iritersections by improving visibility for
drivers ofconverging vehicles in any district where setbacks are required, no fence
or structure over three feet (3') in height shall be perrnitted within the triangular
portion of a comer lot measured from the point of intersection of the lot lines
abutting the streets a distance ofthiny feet (30') along each lot line.

5. Height Limitations:
Fences, hedges, "valls and landscaping screens shall not exceed tliree feet (3') in
height within any required front setback area, and shall not exceed six feet (6') in
height in any other ponion of the site, provided that higher fences, hedges, rvalls or
landscaping screens may be authorized by the A&ninistrator when necessary to
screen public utility equipment. No barbed wire or elecuically charged fence shall
be erected or maintained.
Accessorl Structures; Utilities; ServiceAreas:
l. Design of accessory stnctures upon a site shall be compatible with the design and
materials of the rnain strucnu'e or structures upon the site.
2. Accessory buitdings generally should be attached to the main building either
directly or by means of a continuous wall, fence or similar feature of the same or a
complementary material as the main building's exterior finish.
3. All utitity service systems shall be installed underground. Any utility system the
operation of which lequires above ground installation shall be located and/or
screened so as not to detract from the overail site design quaiity.

On 514105, we appeared before the TOV DRB regarding an application for a minor
alteration Specifically, this application was for the addition of a fence on the back of our
property. Our application was dcnied.
There are several reasons for wanting to install a fence on ouf prop€rty, all ofwhich
address the protection of our animals, our propefty, and ourselves. Specffically:
1) We have two male Old English Sheepdogs which we would like to keep on orn
prop€rty and offof neighbors' prop€rty.
2) There are many other dogs in the neighborhood which are allowed to run free
throughout the neighborhood. We would prefer that they are kept offour pmperty
as our dogs have been attacked and injured by otho dogs in the past. @ven
though ftsir swnenl wer€ within a few feet) In addition" the amount of dog feces
left by other dogs is not only unappealing, but poses a health hazard as well.
3) We have been experierrcing an increasingly large number of individuals passing
through our back yard. Often these people passing tbrough the property do so in
the early hours of the moming when they are intoxicated, waking both us and our
dogs.
4) We have been experiencing an increasing anount oftheft of property (wood,
ladders, equipmenf etc.) from our back yard. We believe a fence will deter
continued theft.
Fences were previously addressed in section l2-14-Z of the TOV code. This section was
repealed in 1999 by ord. 22. lnthe current version of the TOV Developrnent Standards
Handbook, t|rc 12-14-2 wording remains essentially the same, adding that'Tences shall
not be encouraged...." However, the old TOV code allowed for fences, and the current
language does not specifically prohibit fences. In fact, there are many other fences in the
neighborhood (see attachments), anrl the DRB has approved the installation of fences
subsequent to the language change (see attachment). In fact, two of the four properties
adjacent to our property have fences.
We are asking the Town Council to allow us to install a fence similar to examples we
provided to the DRB. @xamples attached.) As expressed to the DRB, we are more than
happy to workwiththetownto incorporate landscapingormakeothermodifications to
our proposal, as long as the primary purpos€s of the fence are served.

1. Subsoil conditions are fairly uniformover the site with topsoil to a depth of
two feet, underl ain by si I ty sand withgravel and fragmented rock.

SCOPE
This report presents the results of a Soils and Foundation
Investigation for the proposed garage addition to an existing
residence on Lot 4, Vail Village bJest Filing No. 1, Vai1, Colo-
rado. The investigation was prepared by means of test pits
and laboratory testing of samples obtained from these p'its.
This investigation presents a description of surface
and subsurface conditions encountered at the site. recommended
foundation systems, allowable design pressures, and groundwater
conditions as well as design and construction criteria infl uenced
by the subsoils.
SITE LOCATION AND DE.SCRIPTION
The site is located at 1760 Alpine Drive, on Lot 4, Vail
Vil'lage t,{est Filing No. 1, Vail, Colorado. The lot drains to
the'north. Vegetation consists of grasses and weeds. The
proposed garage is to be added to the north side of an existing
structure.

SITE INVESTIGATION
The fiel d i nvesti gati on performed on July 9, 1982, con-
sisted of excavating,'l ogging, and sampling one test pit.
The location of the test pit is shown on Drawing No. 1. A
summary of the test pit 1o9 is detailed on Figure No. 1. A
summary of the test results is shown on Figure No. 2.
The test pit was excavated with a conventional backhoe.
Laboratory samples were obtained for grain-sjze analysis.
SUBSURFACE AND GROUNDl,lATER CONDITIONS
Refer to the summary of test pits, Figure No. 1. Subsur-
face conditions consist of two feet of topsoil with some out-
cropping rock, underlain by silty sand with gravel and frag-
mented rock.

PROPOSED CONSTRUCTI ON
lfe understand that the proposed garage addition will con-
sist of a one-story structure, utilizing wood frame type of
construction. If the proposed project differs significantly

FOUNDATI ON RECOMMENDATIONS
Low consolidating silty sands will be encountered in
the excavation. The proposed garage addition should be founded
on conventional type spread footings designed for a maximum
soil bearing pressure of 2000 psf (dead load plus one-half
live load). At this pressure, foundation settlements wi I I
be tolerab'le. It would be advisable to proportion footings
so as to mi nimi ze di fferenti al settl ements. The bottom of
the footing should be placed a minimum of 4B inches below
fi nal grade for frost protecti on.
SLAB CONSTRUCTION
The upper natural soils will provide adequate support
for slab-on-grade construction. If clean, granular soi ls
are imported to be used as select fill no problem with capillary
rise of moisture will occur. However, if the select fill
contains some clays or fine materia'l s there is always the
possibility of capillary rise of moisture.
lrle suggest that the plans and specifications be prepared
with a specified minimum of 4 inches of clean, washed gravel
immediately under the floor slabs. The purpose of this clean,
washed material is to break capillary rise of moisture to
avoid problems with bonding of asphalt tiles to floor s'labs
and other problems associated with minor amounts of moisture.

soils with a vibratory type compactor immediately prior to
placement of f'l oor slabs. Slabs should be constructed i,n accor-
dance with ACI recommendations to minimize the risk of shrinkage
problems. Slabs should be scored into maximum 200 square foot
areas to local ize and control any cracking.
GROUNDI.IATER AND DRAI N SYSTEM
l.lhile little or no groundwater was encountered at the
time the field investigation was conducted, jt is possible
that seasonal variations will cause fluctuations, or for a
water table to be present in the upper soils during the spring
months, or after a pro'longed period of rain. A peripheral
drain system as <letailed on Figure No. 3 shoutd be jnstal'l ed
around the foundation.
REINFORCING
Foundation wa'l ls should be we'l l-reinforced so as to mini-
mi ze the effects of di fferenti a'l movements . Refer to foundati on

The foundation walls should be designed to resist a'l ateral
earth pressure of 30 pcf equivalent fluid weight.

BACKFILL AND SURFACE DRAINAGE
The potenti a.l ly consol i dati ng foundatfon soi I s encountered
in portions of the site shou'ld be prevented from being wetted
after construction. General ly, this can be accomplished by
insuring that the backfil I placed around the foundation walls
will not settle after completion of construction and that
the backfi I I material is rel atively 'impervious.
Duri ng the backfi 1l i ng operati ons, the addi ti on of water
to the backfill soils should be only enough so as to increase
the moi sture content to optimum I evel s to ai d i n obtai ni ng
pr0per compaction -- do not puddle.
The on-site soi'l s will provide suitab'l e backf ill materia'l .
Surface water running toward the structure from upslope
areas should be diverted around and away from the building
by means of drainage swales or other simi'l ar measures.
The final grade should have a positive slope away from
the foundation walls on all sides. A minimum of 12 inches
in the first ten feet is recommended. Downspouts and sill
cocks should discharge into splash blocks that extend beyond
the limits of the backfill. Splash blocks should slope from
the foundation walls. The use of long downspout extensions
in place of splash blocks is advisable.

the sprinkler heads should be placed so that the spray from
the heads, under full pressure, does not fall within five
feet of foundation wal1s, porches or patio slabs. Lawn irrigation
must be controlled.
If the future owners desire to plant next to foundation
walls, porches or patio slabs, and are willing to assume the
risk of structural damage, etc., then it is advisable to plant
only flowers and shrubbery (no lawn) of varieties that require
very little moisture. These flowers and shrubs should be
hand-watered only.

and the owner should be cautioned that there is some risk
of future damage. The contractor is directed to those items
