Based upon the Community Development Department's records, the Vail Sky High Condominiums were built in
Eagle County and later annexed into the Town of Vail. At the time ofannexation,this property was rezoned from
Eagle County's Residential Suburban Medium (RSM)zoning district to the Town ofVail's Two-Family
Primary/Secondary Residential (PS)zoning district.The existing Vail Sky High Condominiums do not conform to
the Town ofVail's development standards.Since the condos were constructed prior to being regulated by the
Town,they are allowed to continue as a legal non-conforming structure and use.
According to our records,the Vail Sky High Condominiums exceed the maximum gross residential floor area
allowed for this site (please note: these records were accurate as of 1981,and do not necessarily represent current
conditions). Chapter 18:NONCONFORMING SITES,USES, STRUCTURES AND SITE IMPROVEMENTS,
states:"Structures which do not conform to density controls may be enlarged, only ifthe total gross residential
floor area of the enlarged structure does not exceed the total gross residential floor area ofthe preexisting non-
conforming structure."Based upon this section of the code,you will not be able to add additional GRFA to your
unit.However,you do have the opportunity to apply to the Planning and Environmental Commission for a GRFA
variance to allow for the expansion ofyour unit.A similar type of variance request was requested for Unit 9 at the
Vail Sky High Condominiums in 198I.At that time,the Planning and Environmental Commission determined that
there was no hardship to warrant a variance and the request was denied by a vote of 4-1.

A.Unlawful deposits:Subject to subsection C thereof,it is unlawful for any person to litter,
track or deposit,or cause to be littered,tracked or deposited,sand,gravel,rocks,mud, dirt,
snow,ice, or any other debris or material upon any street,sidewalk,alley or public place,or
any portion thereof.
B.Notice;Abatement:The Director of Public Works may notify and require any person who
violates or causes another to violate the provision ofsubsection A hereof,or who has in the
Director's employment a person who violates or causes anotherto violate the same,top
remove such sand,gravel,rocks,mud, dirt,snow,ice or any other debris or material within
twenty four (24)hours after receipt ofsaid notice by the Director ofPublic Works.In the
event the person so notified does not comply with the notice within the period oftime herein
specified,the Director of Public Works,or other authorized agent,may cause any such sand,
gravel,rocks,mud, dirt,snow,ice,debris or any other material to be removed from any street
or alley at the expense ofthe notified.
C.Exceptions:The pro visions ofsubsection A hereofshall not be applicable:
I.Within the immediate area ofany construction,maintenance or repair project ofany
street or alley or ofany water main,sewer main,electricity line,gas line,telephone line
or any appurtenance thereto;
2.To deposits ofsand,dirt or materials necessary for the protection ofthe public safety;and
3.To public areas designated for the dumping or depositing ofsaid materials.
D.Summons;Penalty:As an alternative to the notice for removal provided in subsection B
above,any
person who violates or causes another to violate the same,may be issued a summons to
appear before the Municipal Court ofthe Town for said violations. and upon being found
guilty ofa violation hereunder be punished as provided in Section I-4- I ofthis code.
E.Notice;Penalty:It is unlawful for any person to fail or refuse to comply with the notice of
the
Director ofPublic Works as provided in subsection B hereof,and any such person shall,in
addition to payment of the expense ofremoval incurred by the Director ofPublic Works,as
provided in subsection B hereof,upon being found guilty ofa violation hereunder,be
punishable as provided in Section 1-4-I of this Code.(1997 Code:Ordinance 6 (1979)

Ifthis permit requires a Town ofVail Fire Department Approval,Engineer's (Public Works)
review and approval,a Planning Department review ofHealth Department review,and a review
by the Building Department,the estimated time for a total review may take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements.Residential and small projects should take a lesser amount of
time.However,ifresidential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take the three (3) week
period.
Every attempt will be made by this department to expedite this permit as soon as possible .

How it relates to Building Permits
1.Fill out our check list provided with a Building Permit Application.
Ifyes was answered to any of the questions then a "Public Way" is required.You
can pick up an application at either Community Development,located at 75 South
Frontage Road or Public Works,located at 1309 Vail Valley Drive.
2.Notice sign offs for utility companies.All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to 48 hours notice to schedule a locate.
3.A construction traffic control/staging plan must be prepared on a separate sheet of
paper.An approved site plan may also be used.This plan will show locations of
all traffic control devices (signs, cones,etc.)and the work zone, (area of
Construction,Staging, etc.).This plan will expire on November 1st and will need
to be resubmitted for approval through the winter.
4. Sketch ofwork being performed must be submitted indicating dimensions (length,
width and depth ofwork). This may be drawn on the traffic control plan or a site
plan for the job.
5.Submit completed application to the Public Work's office for review.Ifrequired,
locates will be scheduled for the Town of Vail Electricians and Irrigation crew .
The locates take place in the morning,but may require up to 48 hours to perform.
6.The Public Work 's Construction Inspector will review the application and
approve or disapprove the permit. You will be contacted as to the status and any
requirements that may be needed.Most permits are released within 48 hours of
being received,but please allow up to one (1)week to process .
7.As soon as the permit is processed, a copy will be faxed to Community
Development allowing the "Building Permit"to be released.Please do not
confuse the "Public Way Permit"with a "Building Permit" which is to do work
on a project itself.
NOTE :
The above process is for work in a public way ONLY.
Public Way Permits are valid only until November 15th
A new Public Way Permit is required each year ifwork is not complete.

rebuild last summer June v-September 1998 '·'
o The bid was accepted based on the proposal submitted by Rob Silvera,
specifically noting points 14 &15.:.
o We took the bid based on the fact that the engineering plans would be
used for the work.At this point we have several concerns about the
completion ofthe work and Mr.Silvera not utilizing these plans for the
work.;.,
o Mr Silvera has been requested to pull a permit for the deck due to it being
above 30 inches from the ground..In addition,\\\e have requested that he
repair the warped handrail and bring it up.to ~~ae height.Warping ofthe
handrail it is suspected may be due totheJac~9fsupport pads for the
sono tubes and a lack oftherequired 42inchfrost depth.
The following-are concernswe arer:eque~'iirig that the TOV review
.when inspection of the deckoccurs,
1.The handrails were mot rebuilt to code height(standard practice whether a
building permit is required or not), In addition.the support beams at this
point are warped and in order for the rails to,be repaired,straightened and
match existing structure it would require repair work shown in the
drawing listed Exhibit A.,..,.
2. We are alsoconcerned about quality of workonthe deck foundation.
The Sono tubes installed should have a pad sppporting them which we
suspect were not put in (as per deck design f~Qr:n Monroe &Newell
Exhibit B),we will dig it opt if required...'C ,'
3. Steel connections were supposedtohave been .installed in the stairwell
tower repairs as per Detail,:B from Engineering Designworks.An
inadequate numberofthru .bolts arid steel plates were installed i.e. design
plans were again not followed.Please see evaluation from RKD taken
when new repair plans were being'made dueto stairwells being no better
than before Mr.Silverva's work..

The cast and west stairstnu:tures amsist of 3 landing levels and 5 stairflights l!C'O"S'Sjng the 4
levels ofthe building.Thestrnctares are constmeted using 2xjoistsand stringers,and 6x6 posts.The
6x6 posts appear to have beenset directly into the ground with no visible cxmc:rct.e fouudationsystem in
evidence.The stairmaterials appeared to bein reasonablecondition with thecxccption of the post bases,
where somerotwas visible.We ICCOIDDiend a frostdepth fOUDdation beIt;uufittcdat all stairpost
locations.Thiswouldbe most economically accomplishedby placing rciIIfon:ed concretepiers toa depth
ofat lcast 42"belowgrade at each post loc:ation.The piers should also exteDd a mjnjmmD of8"above

damage is most likdy being caused by locaJiud seuling ofthe soils upon which the slab and deck
structures arefounded..This soil settling is most likely due to improperfill mau:ria1 and/or samration and
erosion ofthese soils promoted by water draining from the roof:The emin:south facing aspect ofthe roof

Dear Kerry,
On January 29,I met you at the property to examine the exterior stair structures at
either end of the building.You also provided me with a report stamped by Steven
Lewis of Engineering Designworks,lnc.,dated August 19,1997,in which he made
some recommendations for the same stair structures,(attached).
Observations
There had clearly been some work done on the stairs since the report by Lewis.
Specifically,the foundation under the posts appears to be complete,although it is
obviously not possible to determine at this point if the reinforcing was done correctly,
and according to Engineering Desigriworks'details.I did note,however,that the
5/16"steel plate that connects the post·to the concrete pier was not built according
to Detail S,as there are only 2 bolts visible at each post instead of 3 bolts.Also,as
you pointed out to me,the posts on the eastern stair had been cut about 3 feet above
the piers, and the lower portion was replaced.This left a connection that clearly was
not resisting the lateral motion well.
The Engineering Designworks report also suggested the replacement of the existing
2x6 cross bracing with 6x6 cross bracing.This had not been done.
Other factors which I observed,and which I believe contribute to the insecure feel ing
at the upper landing of the stair are the following:
• The railings as they exist are approximately 36"high,and they are in disrepair.
• The stringers,or the sloped support beams for the stair,are connected to the
posts inconsistently,and in some places not at all.
•Many of the connections throughout the stair construction are loosening up over
time.
• Each stair tread consists of a single 2x12 supported at each end,without an
intermediate support.
Recommendations
•Provide a steel connection at the joint in the posts above the concrete piers on th e
eastern stair,which is similar to that in Detail B by Engineering Designworks.
Provide three bolts above and below the joint,and place the plates on the north
and south sides of the posts.
•Provide 6x6 cross bracing at each intermediate landing,according to the
specifications by Engineering Designworks.
• Replace railings with 42"high railings at landings.A design which incorporates
angled members from post to post could help with overa ll cross bracing of the
structure.
• Replace stringers,bolting them directly to the structural 6x6 posts.An additional
option is to add an intermediate stringer at each flight.
I believe that the first three of these ideas will make a substantial difference in making
the stairs feel secure.The last suggestion involves a great deal of reconstruction,and
you might not find it worth the effort.An easier alternative would be to inspect each
of the stringer/post connections and to reinforce them with lag bolts.

departments with regard to necessary review,these projects may also take the three (3) week
period.
Every attempt will be made by this department to expedite this permit as soon as possible .

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits
1.Fill out our check list provided with a Building Permit Application.
If yes was answered to any ofthe questions then a "Public Way" is required.You
can pick up an application at either Community Development,located at 75 South
Frontage Road or Public Works,located at 1309 Vail Valley Drive.
2.Notice sign offs for utility companies.All utilities must field verify (locate)
respective utilities prior to signing application.Some utility companies require up
to 48 hours notice to schedule a locate .
3. A construction traffic control/staging plan must be prepared on a separate sheet of
paper. An approved site plan may also be used .This plan will show locations of
all traffic control devices (signs ,cones,etc.)and the work zone,(area of
Construction,Staging,etc.).This plan will expire on November 1st and will need
to be resubmitted for approval through the winter.
4.Sketch of work being performed must be submitted indicating dimensions (length,
width and depth ofwork).This may be drawn on the traffic control plan or a site
plan for the job.
5.Submit completed application to the Public Work's office for review.Ifrequired,
locates will be scheduled for the Town ofVail Electricians and Irrigation crew.
The locates take place in the morning,but may require up to 48 hours to perform.
6.The Public Work's Construction Inspector will review the application and
approve or disapprove the permit. You will be contacted as to the status and any
requirements that may be needed.Most permits are released within 48 hours of
being received, but please allow up to one (1)week to process.
7.As soon as the permit is processed ,a copy will be faxed to Community
Development allowing the "Building Permit"to be released. Please do not
confuse the "Public Way Permit"with a "Building Permit"which is to do work
on a project itself.
NOTE:
The above process is for work in a public way ONLY.
Public Way Permits are valid only until November is".
A new Public Way Permit is required each year ifwork is not complete.

Dear Kerry,
On January 29,I met you at the property to examine the exterior stair structures at
either end of the building.You also provided me w ith a report stamped by Steven
Lewis of Engineering Designworks,lnc.,dated August 19,1997,in which he made
some recommendations for the same stair structures,(attached).
Observations
There had clearly been some work done on the stairs since the report by Lewis.
Specifically,the foundation under the posts appears to be complete,although it is
obviously not possible to determine at this point if the reinforcing was done correctly,
and according to Engineering Designworks'details.I did note,however,that the
5/16"steel plate that connects the post to the concrete pier was not built according
to Detail B, as there are only 2 bolts visible at each post instead of 3 bolts.Also,as
you pointed out to me,the posts on the eastern stair had been cut about 3 feet above
the piers,and the lower portion was replaced.This left a con nection that clearly was
not resisting the lateral motion well.
The Engineering Designworks report also suggested the replacement of the existing
2x6 cross bracing with 6x6 cross bracing.This had not been done.
Other factors which I observed,and which I believe contribute to the insecure feeling
at the upper landing of the stair are the following:
•The railings as they exist are approximately 36"high,and they are in disrepair.
•The stringers,or the sloped support beams for the stair,are connected to the
posts inconsistently,and in some places not at all.
•Many of the connections throughout the sta ir construction are loosening up over
time.
• Each stair tread consists of a single 2x12 supported at each end ,without an
intermediate support.
Recommendations ••
•Provide a steel connection at the joint in the posts above the concrete piers on the
eastern stair,which is similar to that in Detail B by Engineering Designworks.
Provide three bolts above and below the joint,and place the plates on the north
and south sides of the posts.
•Provide 6x6 cross bracing at each intermediate landing,according to the
specifications by Engineering Designworks.
• Replace railings with 42"high railings at landings.A design which incorporates
angled members from post to post could help with overall cross bracing ·of the
structure.
• Replace stringers,bolting them directly to the structural 6x6 posts.An additional
option is to add an intermediate stringer at each flight.
I believe that the first three of these ideas will make a substantial difference in making
the stairs feel secure.The last suggestion involves a great deal of reconstruction,and
you might not find it worth the effort.An easier alternative would be to inspect each
of the stringer/post connections and to reinforce them with lag bolts.

III.IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
A.In addition to meeting s ubmi t t a l requirements,the
applicant must s t ake and t ape the project site to
indicate property lines,building lines and building
corners.All trees to be removed must be taped.All
site tapings and staking must be completed prior to the
DRB site visit.The applicant must ensure that staking
done during the winter is not buried by snow.
B.The review process for NEW BUILDINGS normally requires
two separate meetings of the Design Review Board:a
conceptual review and a final review.
c.Applicants who fail to appear before the Design Review
Board o n their scheduled meeting date and who have not
asked in advance t ha t discussion on their item be
postponed,will have t hei r items r emoved from t he DRB
agenda until such t ime as t he item has been
r-epubLiahed.
D.The following items may,at the discretion of the
zoning admini strator,be approved by the community
Development Department staff (i.e.a formal hearing

which do not alter the existing plane of the

D.Sign off from each utility company verifying the
location o f utility s er vi ce and availability (see
attached utility verifica tion form).
E.A preliminary title report Schedule A and B must
accompany all submittals ,to insure property ownership
and i den t i fy all easements affecting the subject
property.
F.Architectural Plans (1/8"=l'or larger,1/4"is
preferred scale for review)3 copies are required.
1.Floor plans and all elevations of the proposed
development drawn to scale and fully d i mens i oned.

Once a building permit has been i ssued,and construction is
underway,and before the Building Department will schedu le a

VIII.CONCEPTUAL DESIGN REVIEW
A.Submittal requirements:The owner or authorized agent
of any project requiring design approval as prescribed
by this chapter may submit plans for conceptual review
by the Design Review Board to the Department of
Community Development.The conceptual review is
intended to give the applicant a basic understanding of
the compatibility of their proposal with the Town's
Design Guidelines.This procedure is recommended
primarily for applications more complex than single-
family and two-family residences.However,developers
of single-family and two-family projects shall not be
excluded from the opportunity to request a conceptual
design review.Complete applications must be submitted
10 working days prior to a scheduled DRB meeting.
The following information shall be submitted for a
conceptual review:
1.A conceptual site and landscape plan at a minimum
scale of one inch equals twenty feet;
2.Conceptual elevations showing exterior materials
and a description of the character of the proposed
structure or structures;
3.Sufficient information to show the proposal
complies with the development standards of the
zone district in which the project is to be
located (i.e.GRFA,site coverage calculations,
number of parking spaces,etc.);
4.Completed DRB application form.
B.Procedure:Upon receipt of an application for
conceptual design review,the Department of Community
Development shall review the submitted materials for
general compliance with the appropriate requirements of
the zoning code.If the proposal is in basic
compliance with the zoning code requirements,the
project shall be forwarded to the DRB for conceptual
review.If the application is not generally in
compliance with zoning code requirements,the
application and submittal materials shall be returned
to the applicant with a written explanation as to why
the Community Development Department staff has found
the project not to be in compliance with zoning code
requirements.Once a complete application has been
received,the DRB shall review the submitted conceptual
review application and supporting material in order to
determine whether or not the project generally complies
with the design guidelines.The DRB does not vote on
conceptual reviews.The property owner or his
representative shall be present at the DRB hearing.

A mi st ake has been discovered concerning t he Brewer GRFA Variance.
The Vail Sky High Condominiums a re located on both l ot s 4 and 5 of
Vail Das Schone Subd ivisi on,Fi ling No.2,Bloc.k G.Each of these
l ot s is i dent i cal s i ze:10,454 square feet.Thus , t he site area'
is twice wh at i s l i sted in you r memo. The new site area figure
is 20,908 s quar e f eet.
There are 12 units on 20,908 squa re f eet 'of site area,a densit y
of 25 un its to the acre .The f ormer County zoning of Residential
Suburban Me dium (RSM)wou ld have allowed 6272 sq ft of floor ar ea.
The 1'0 \,-111 I S zoning--Residential PrimaryISecondary (R PiS)would
a l l ow 4341 sq f t of GRFA.

The meeting was called to order at 2:00 p .m.by the chairman,Gerry White.
1.Approval of minutes of July 27, 1981 .
Dan corrected a statemen~he had made concerning the Hopkins item to read that
he felt that the Town wa s ga ining by Mr .Hopk ins building employee units .
Roger Tilkemeier hadn I t been listed in "membe rs present".Dan moved and Jim
seconded to approve the minutes with those corrections.The vote was 5-0 in favor .
After discuss ion ,Roger moved and Dan ,seconded to appoint Duane to DRB for Sept,
Oct,and Nov ember.Dan volunteered to take the next 3 months--December,J anuary
and Fehruary. The vote was 4-0,Duane abstaining.

Peter Patten showe d the s'~te plan and explained that everyone thought that the
parties involved had taken care of the minor subdivision before Ipanema was constructed.
Dan added that a condo map would be filed this week that would show the correct
lines.
Jim Morgan moved and Roger se conded to appr ove the minor subdi vision r equest as
submitted i n the memo with t he restrict ion t hat no addit ional GRFA be added.
TIle vote was 4-0 with Dan abstaining .

Peter Pat ten gave the background and l isted corrections to the memo .They
were that the lot s i ze should be twice as l arge.or 20,908 sq ft.Dick
Brewer introduced himself and his representative,Ray Storey.Ray explained
the Brewers'position,stating that the development was now primarily f or empl oyees ,
and were l ess exp ensive units -~difficult to sell now because of financing.He a dded
that the porch was already defined,and that it had 4 of the 6 sur faces ,and t hat
no more space would be added,that the entrance would be improved.
Di scussion as to whet her or not this would be precedent setting f ollowed.Gerry
reminded them that cost or inconvenience is not considered a hardship.Jim Morgan
moved and Dan seconded to deny the variance as-it was stated in the memo dated
August 24.1981.The vote was 4-1 to deny.Duane vot ed against denial .He felt
that the added GRFA was not adding bulk,nor was it a significant increase.He
al so f elt that a greenhouse's transparency made it somewhat less bu lky in
appearance.
5.'Request £or a variance from the covered.parking requirement i n Section 18 .12.080
of the Vail Muni cipal Code in order to build a secondary unit on lot 5,Block
6,Vail Intermountain Subdivision,1933 Bellflower.Applicants:Craig and Jan Webb .
Peter Jamar presented the memo and reminded t he commi ssioners of the restrictions
of Ordinance 22 of 1981,for lots under 15,000.One restriction was that half
of the parking must be covered to have a secondary unit.He added that one of
the reasons for this criteria was aesthetic,b~t in l ooking at Bellflower Drive,
he discovered that there were no garages at a l l .Therefore,the staff felt that
the va r iance should be gr anted ,especially in light of the fact that the added
unit was already enc l osed in the basement .The staff also fel t that another st ruct ur e
on the site would be more detrimental to t hc s i.t c.than 2 ndditonal parkirig spcccz
would be,and that another employee unit was desirable.
Duane moved and Roger seconded to approve the r equest for the parking variance
as stated in the staff memo dated 8/24/81 .The vote was 5-0 in favor.
7.Request f or an exterior alteration "and modi ficat i on to the Hill building to
add a greenhouse,dining room a ddi t i on and new bed room located at 311 Bridge St.
Applicant:Mrs .Cortlandt T.'Hill.
Dick Ryan stated that the bedroom addition was being dropped,and so the request
wa s for the dining room and open greenh ouse only.lIe expl ained the memo and
Jack Curtin showe d add i tional plans.The addi t i on of t he green hou s e only needed
ORB approval .Roger moved to approve the reque st subj ect to the conditions i n
the memo,and a s stated in the st aff memo dated 8/24/81.Duane seconded.The
vote was 5_0,unanimously in f avor of t he request

Peter Patten explained that the proposal was a complete redevelopment of the Casino
building.He pres ented the site plans and expl ained the f loor plans.Gerry Wh ite
read a letter f rom the condominium asso cintion s ta ti ng that the alley was c ommon
property and that to bu i l d there wou ld r eq uire approval from them.Therefore ,
the a l ley propos al was not t o be consider ed a t t his meeting.Ger ry added that
when he went out to t he si t e , he ha d not been tol d t hat t he building would be
extended 8 feet on the soutlll~est corner.

Dick Ryan stated that for the 2-1/2 years that he had been in the Plannin$
offices,there had been much t alk of trying to improve this part of the Village
and .much talk of making the alleyway a viable walkway.He felt that the project
was a tremendous improvement to the Village.
Gordon Pierce,architect for the project,showed slides and talked about scheduling
the construction.He stated that after Labor Day,the plan.was to take out the
trash,equipment and partitions that weren't ne eded.He added that the contractor
felt that he could meet the planned schedule.Discussion followed with concern
expressed that the project not look half finished through wint er,and maybe using
a finish material on the exterior if work was stopped part way through.
The northwest corner of the building was discussed,some members feeling that
the building should not be extended out at that point.John Donovan also objected
to the extension.Others felt that a small projection might be better than a
flat wall in that area.
Gordon spoke of lowering the alley 2 or 3 feet to make it lighter and airier,
and possibly to have glass looking into Pistachio's restaurant.
The proposal discussed at this point did not include the alley or the extension
at the northwest corner of the building,and these two items were to be continued
for 2 weeks .
Dan moved and Roger seconded to approve the exterior alteration and modification
to the Casino Building as stated in the memo with two add itional conditions :
1.That the finished facade be compl et ed before Christmas or the applicant do
:1 t reat ment .simil rrr t o t hc unfi.ni shed commercial space at the Gondcla bui l :'i.ng,
2. That t he applicant agrees to participate financially in street improvements,
e.g.street pavers ,street lights,at the intersection of Gore Creek Drive and
Bridge Street if a mini_improvement district is formed.The appl icants'share
would be determined by street frontage of property and other property owner s woul d
also have to agree to participate.
The vote was 5-0 in favor.The deck area office expansion was continued until
the next PEC meeting.
8.Request for,an amendment to the Vail Lionshead Urban Design Guide Pl an for
Study Area #5,and an exterior a lt er at i on and modification to construct new
commerci al and office space located wouth of Vantage Point,north of Lift House
Lodge and Lions Pride bu ilding and northeast of Vail 21 building.Applicant :
Robert T.Lazier.
Dick Ry an presented the memo and stated that this was a s ignificant proposal
f or Vail.He a dded that the Urban Desi gn Guide Pl an discusses including more
common sp ac eand en courages a new entry concept into the mall from t he east,and
this proposal f ul fills some major objectives of the UDGP and was an improvement
to the community.
Much discussion about parking followed.Gerry f elt that parking was a major
i ssue in t his proposal,and that the loss of pa rking did not justify the propos al.
Dick fel t that thi s IWS the purpose of the 1100 s pace parking structure,that
i t wasvpl anned knowing there would be more demand l ater.Gerry predicted that
the parkin g structure was not going to be bi g enough, and sooner or l ater more
parking was going t o be needed.

Bill Ruoff showed plans and a model.Dick added that the staff's biggest concern
was that Lionshead become more successful,and that something significant needed
to be done there.
Jay Peterson stated that every project included a compromise.He added that
they couldn't make a good entrance and solve Vail's parking problem.Lionshead
has difficulty in this area,needs commercial space here,and that the parking
problem wouldn't be worsened,he felt.Gerry felt that one problem would be
solved while creating another with the parking.Dick felt that they didn't want
to see parking used by people who come to the commercial area.that these people
should be parking in the parking structure and that this would also reduce congestion.
Dan stated that both parking structures were designed for expansion later.
Dinah Chapman,president of the Lionshead Association of Businesses stated that
in June Bill Ruoff had presented his plan to about 30 members of the association,
and that parking was mentioned,and no complaints were received.She added that
with the present situation.the alley was usually blocked and parking illegally
used.The people at this meeting were ecstatic over the proposal.
Gerry felt that the Lionshead parking structure would soon be too crowded to
park there.Roger suggested that the other members voice their opinions.
Duane said that he was in favor of the proposal,Dan said that he was also in
favor,Jim felt that it was a vast improvement to the situation there,and Roger
stated that he had been working in Lionshead for the past 6 years,trying to
breathe some life into the commercial aspect,and that this appears to address
the most serious problem and recommended approval,He added that when the parking
problem becomes more serious,the planning commission would address it and solve

Jim moved and Roger seconded to recommend approval of the amendment to the Urban
Design Guide Plan to the To\m Council.The vote was 4~1 in favor (Gerry against).
Duane moved and Jim seconded for approval of the exterior alteration and modi-
fication of the proposal dated August 26,1981 with the 6 conditions listed
in the memo.The vote was 5-0 in favor.
Roger moved to adjourn ,at 5:15 p.m.

ZONING VARIANCE REQUEST

Submitted by Lauria and Richard Brewer
The property in question was purchased by Richard
and Lauria Brewer in August,1978.They wish to
improve their property with the addition of a small
sun room, 100 square feet.More than just enhanc-
ing the value of their property,it would greatly
enhance its liveability as the Brewers have two
children and only one bedroom (a situation that
occurred after the purchase of the property.)Thus,
even a small increase in space is desirable.
The plot involved was down-zoned from high-density
to primary-secondary when the Town of Vail annexed
West Vail.Prior to the annexation,the GLA
allowable on the plot for a high-density dwelling
was 12,000 square feet.As it exists,the total
GLA of the building is only 8,595 square feet--
about two-thirds of what was allowable under the
previous zoning ordinance.So while the property
was one-third underbuilt under the previous county
zoning,it is now overbuilt with reference to the
Town of Vail density restrictions.
At the time of purchase,the Brewers were hopeful
of eventually enclosing their porch,though the
concept of a sun room was arrived at later.They
are presently prevented from any development of
their property,however small the increase in GLA,
by the present zoning ordinance.The variance
requested would add 100 square feet to the structure,
or an increase of less than one-eightieth of its
present GLA.The down-zoning of the property imposes
a hardship on the Brewers by not allowing for even
such a small increase,one that would have been
possible under the previous county zoning.

were applied to the living room area to cool it enough to enter it and extinguish the
fire which was burning in the bedroom.The fire in the bedroom was extineuished with a
booster line after the room was ventilated thrg.u.,gh the West wi ndow iTn;ts 2,3,aod 11 vere
entered and ventilated to reduce smoke damage to those units.

considered the above referenced application again.
Although we have not been able to secure the needed
easement for our sewer main in the vacinity of this
property,we do not feel that we can hold Messers.
Robinson,Brenner,and O'Donahue responsible.
We understand the condominium covenants provide
for centralized billing and responsibility for sewer
service charges,thus eliminating the necessity for
separate service lines.

At their meeting on 3 July 1975,the Technical Review Committee (a group of technical
advisers from various publ ic agencies)reviewed your appl ication and offer the following
comments and recommendations to you and the Planning Commission for consi dering
approval and use of the property.
1.That the appl ic ant get together with the Upper Eagle Val ley Sanitation District
to determine if an easement is necessary for the existing sewer serving the subject
units.
2.Two days prior to the 16 July Planning Oornrnlasion meeting the applicant shall submit
a detailed plat of existing rights-of-way,eXisting parking,proposed parking and
measures to rei ieve congestion.Suggested were a visible fence at the heads of the
parking spaces and that parking not be allowed in the center section of the lot.This
last suggestion recognizing the one space per dwelling unit provision of the covenants.
These statements will be forwarded to the County Planning Commission and Planning
Department for their consideration by the meeting on 16 July 1975,beginning at 8:00 P.M.
