BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval,Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements.Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
'"Fill out the attached check list with the Building Permit Application.
If yes was answered to any of the questions then a "Public Way" permit is required.You
can pick up an application at either Community Development,located at 75 South Frontage
Road or PublicWorks, located at 1309 Elkhorn Drive.
'"Notice sign-offs for utility companies.ALL utilities must field verify (locate) respective
utilities prior to signing application.Some utility companies require up to 48 hours notice to
schedulea locate.
'"A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs,cones,etc.) and the work zone, (area of construction,staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
'"Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
'"Submit completed application to the Public Work's office for review.If required, locates will
be scheduled for the Town of Vail electriciansand irrigation crew. The locatestake place in
the morning, but may require up to 48 hours to perform.
>The Public Work's Construction Inspector will review the application and approve or deny
the permit.You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received,but please allow up
to one (1) week to process.
'"As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released.Please do not confuse the "Public Way Permit"with a
"Building Permit".

o Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter,track or
deposit,or cause to be littered, tracked or deposited, sand, gravel, rocks,mud,dirt,snow,ice, or any
other debris or material upon any street,sidewalk, alley or public place,or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof,or who has in the Director's employment
a personwho violates or causes another to violate the same,top remove such sand, gravel, rocks,mud,
dirt,snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of PublicWorks, or other authorized agent, may
cause any such sand,gravel,rocks,mud,dirt,snow,ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
o Summons and Penalty:As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punishedas provided in Section 1-4-1 of this code.
o Notice and Penalty:It is unlawful for any person to fail or refuse to compiy with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of PublicWorks, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code.(1997 Code:Ordinance 6 (1979).

amended,the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garageor other place of safety designated or maintained by this Municipality,and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

Time Requirements
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application
form and all accompanying material must be accepted by the Community Development Department prior
to application deadlines.A schedule of ORB meetings and associated application deadlines may be found

residential development,the application deadline is typically 3.5 weeks prior to a Design Review Board
hearing..
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in Title 12, Chapter
11 (Design Review) and Title 14 (Development Standards) of the MunicipalCode.
Requirements for properties located in hazard areas
If a property is located in or adjacent to a mapped hazard area (t.e.snow avalanche, rockfall, debris flow,
floodplain, wetland, poor soils, etc.), the Community Development Department may require a site-specific
geological investigation.If a site-specific geological investigation determines that the subject property is
located in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the
hazard report prior to the issuance of a building permit.Applicants are strongly encouraged to consult
with Community Development staff prior to submitting a ORB application to determine the relationship of
the property to all mapped hazards.
Required Plan Sheet Format
For all surveys, site plans, landscapeplans and other site improvement plans, all of the following must be
shown.
1.Plansheet size must be 24"x 36".For large projects, larger plan size may be allowed.
2. Scale.The minimum scale is 1"=20'.All plans must be at the same scale.
3. Graphic bar scale.
4. North arrow.
5. Title block, project name, project address and legal description.
6.Indication of plan preparer, addressand phone number.
7. Dates of original plan preparation and all revision dates.
8. Vicinity map or location map at a scaleof 1"=1,000'or larger.
9. Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5".
11. Names of all adjacent roadways.
12. Plan legend.

Design Review Board Meeting Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done during the winter is not buried by snow.All site tapings and
staking must be completed prior to the day of the DRB meeting.
Applicants who fail to appear before the Design Review Board on their scheduled meeting date and who
have not asked in advance that discussion on their item be postponed, will have their items removed
from the DRB agenda until such time as the item hasbeen republished.
If the DRB approves the application with conditions or modifications,all conditions of approval must be
resolved prior to the issuance of a bulldinq permit.
Staff Approval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the application, or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision
is subject to final approval by the DRB.
Additional Review and Fees
Ifthis application requires a separate review by any local, state or Federal agency other than the Town of
Vail,the application fee shall be increased by $200.00.Examples of such review,may include, but are
not limited to:Colorado Department of Highway Access Permits,Army Corpsof Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees in excess of 50% of the application fee.
If,at the applicant's request, any matter is postponed for hearing,causing the matter to be re-published,
then the entire fee for such re-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have design, land use or other
issues,which may have a significant impact on the community, may require review by external
consultants in addition to Town staff.Should a determination be made by Town staff that an external
consultant is needed, the Community Development Department may hire the consultant. The
Department shall estimate the amount of money necessary to pay the consultant and this amount shall
be forwarded to the Town by the applicant at the time of filing an application. The applicant shall pay
expenses incurred by the Town in excess of the amount forwarded by the application to the Town within
30 days of notification by the Town.Any excess funds will be returned to the applicant upon review
completion.

The review process for new construction normally requires two separate meetings of the Design Review
Board: a conceptual review and a final review.Applicants should plan on presenting their development

not being affected by the proposed improvements and grading.

o Detailed legend, listing the type and size (caliper for deciduous trees, height for conifers, gallon size
for shrubs and height for foundation shrubs) of all the existing and proposed plant material including
ground cover.
o Delineate critical root zones for existing trees in close proximity to site grading and construction.
o Indicate the location of all proposed plantings.
o The location and type of existing and proposed watering systems to be employed in caring for plant
material following its installation.

Pre-application Meeting
A pre-application meeting with Town of Vail staff is encouraged.The purpose of a pre-application
meeting is to identify any critical issues pertaining to the applicant's 'proposal and to determine the
appropriate development review process for an application. In many cases,the pre-application meeting
helps to expedite the development review process as critical issues are identified and dealt with in the

Time Requirements
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application
form and all accompanying material must be accepted by the Community Development Department prior
to application deadlines.A schedule of ORB meetings and associated application deadlines may be found
on the World Wide Web at http://cLvail.co.us/commdev/olanning /drb/meetings/default.htm .For a new
residential development, the application deadline is typically 3.5 weeks prior to a Design Review Board
hearing.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in Title 12,Chapter
11 (Design Review) and Title 14 (Development Standards) of the MunicipalCode.
Requirements for properties located in hazard areas
If a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rockfall, debris flow,
floodplain, wetland, poor soils, etc.), the Community Development Department may require a site-specific
geological investigation.If a site-specific geological investigation determines that the subject property is
located in a geologically sensitive area,the property owner(s) must sign an affidavit recognizing the
hazard report prior to the issuance of a building permit.Applicants are strongly encouraged to consult
with Community Development staff prior to submitting a ORB application to determine the relationship of
the property to all mapped hazards.
Required Plan Sheet Format
For all surveys, site plans,landscape plansand other site improvement plans, all of the following must be
shown.
1.Plan sheet size must be 24"x 36". For large projects, larger plan size may be allowed.
2.Scale.The minimum scale is 1"=20'.All plans must be at the same scale.
3. Graphic bar scale.
4. North arrow.
5. Title block, project name, project address and legal description.
6.Indication of plan preparer, addressand phone number.
7.Dates of original plan preparation and all revision dates.
8.Vicinity map or location map at a scaleof 1"=1,000'or larger.
9.Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5".
11. Namesof all adjacent roadways.
12. Plan legend.

Design Review Board Meetinq Requirements
For new construction and additions,the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done durinq the winter is not buried by snow.All site tapings and
staking must be completed prior to the day of the DRBmeeting.
Applicants who fail to appear before the Design Review Board on their scheduled meeting date and who
have not asked in advance that discussion on their item be postponed,will have their items removed
from the DRBagenda until such time as the item has been republished.
If the DRBapproves the application with conditions or modifications, all conditions of approval must be
resolved prior to the issuance of a building permit.
Staff Approval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the application,or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision
is subject to final approval by the DRB.
Additional Review and Fees
If this application requires a separate review by any local, state or Federalagency other than the Town of
Vail, the application fee shall be increased by $200.00. Examples of such review,may include, but are
not limited to: Colorado Department of Highway Access Permits,Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees in excess of 50%of the application fee.
If,at the applicant's request,any matter is postponed for hearing,causing the matter to be re-published,
then the entire fee for such re-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have design,land use or other
issues,which may have a significant impact on the community,may require review by external
consultants in addition to Town staff.Should a determination be made by Town staff that an external
consultant is needed, the Community Development Department may hire the consultant.The
Department shall estimate the amount of money necessary to pay the consultant and this amount shall
be forwarded to the Town by the applicant at the time of filing an application. The applicant shall pay

This past fall the Town of Vail requested that you, in your capacity as association
president,remove a dog-house and basketball hoop encroaching on Town of Vail
property.The Town appreciates your prompt assistance with this.
Due to some unforeseen circumstances we were unable to break ground this past fall.
With a new construction season approaching we are working out final details to begin
construction early this spring.One ofthe detai ls that has come up is that the asphalt for
the Sunlight North driveway encroaches onto Town ofVail property and must be
removed..
Some initial estimating for sawing off the edge ofthe asphalt and hauling it away came in
at $600.00.The Town of Vail is willing to contract to have the work done for $600.00.
IfSunlight North would like to have the work done themselves,it would need to be done
no later than April 3'd,2000. If the work is not completed by that date the Town will
have the work completed and bill Sunlight North for the cost.

Schone,Fil ing No, 2.Since the cost wi II exceed $5,000,bids are being
taken by the sewer district for this line along with two other lines on July
9,1975,in order to try to hold the costs of all the lines to a minimum .
Vail City Corporation wants to reserve the right to accept or reject
all bids (see copy of letter enclosed).However,you have another letter in
your files that states he will build this line.Probably the overall bids
wi 11 be lower because of letting 3 jobs at one time.Most contractors will
tie their bids together on an "all or none"basis.Let's hope there are no
problems in awarding the overall contract.

As engineers for Vail Village West Water &Sanitation District,we would
like to point out that any exemptions granted should comply with the rules
and regulations of the District (copy enclosed).Where one water service
line serves one structure owned by several parties,the developer .should
be notified in writing that only one bill will be issued for all owners
and that water will be disconnected to all units should the account be
delinquent.The owner should also be notifed that the parties would jointly

We have reviewed the Soil and Foundation Report by T. E.Summerlee for
the above referenced project.This report concerned itself with soils
and foundation recommendations,and made some comments on surface runoff
and erosion problems.
From an on-site inspection and the results of the soils investigation,
we have no geologic objection to the development purposed for this site.
We do object to the approval of this project without an adequate drainage
and erosion control plan as previously mentioned in our letter of July 16,
1974.

THE PURPOSE OF THiS INVESTIGATION WAS TO DETERMINE SUBSURFACE

CONDITIONS AT THIS SITE AND TO FORMULATE APPROPRIATE FOUNDATION
DESIGN CRITERIA rOR THE PROPOSED STRUCTURES.
PROPOSED CONSTRUCTioN
IT IS UNDERSTOOD THAT TWO (2)BUILDINGS CONTAINING A TOTAL
Of NINE (9)LIVING UNITS WILL BE CONSTRUCTED IN THE AREA COVERED
BY THiS INVESTIGATION •.THE PROPOSED STRUCTURES WILL BE TWO (2)
TO THREE (J)LEVELS HIGH WITH SOME BASEMENT AND GARDEN LEVEL AREAS •.
IT IS ASSUMEO THAT THE CONSTRUCTION WILL CONSIST OF CAST-iN-PLACE
REINfORCED CONCRETE FOUNDATION WALLS WITH WOOD FRAME SUPERSTRUC-
TURES ABOVE.THE GROUND fLOORS WILL BE CONCRETE SLABS-ON-GRADE ~
LOADS ARE EXPECTED TO BE LIGHT TO MODERATE.
FIELD INVESTIGATION
Two (2)TEST PITS WERE EXCAVATED AT LOCATIONS APPROXIMATELY
SHOWN ON THE TEST PIT LOCATION PLAN, FIGURE NO.1.THE TEST
PITS WERE EXCAVATED WITH A TRACK MOUNTEO BACKHOE.SAMPLES WERE
RECOVERED OF VARIOUS SUBSURFACE STRATA EXPOSED BY THE TEST
PIT EXCAVATIONS.THE LOGS OF THE TEST PITS ARE PRESENTED IN
FICOURE NO.2.

THE OVERBURDEN SOILS CONSISTED PRIMARILY OF CLAYEY SILTS AND
SILTY TO SANDY CLAYS WITH SOME GRAVEL,COBBLES,FLOATERS AND
BOULDERS.GENERALLY,THE PERCENTAGE OF THE CDURSE MATERIALS
(COBBLES AND BOULDERS)INCREASED WITH INCREASED DEPTH BELOW THE
GROUND SURFACE.
NO GROUND WATER WAS ENCOUNTERED TO A DEPTH OF TWELVE (12)
rEET,THE MAXIMUM OEPTH EXPLORED.
OfsCUSSION
THE NATURAL SOILS ENCOUNTERED AT THIS SITE WERE PRIMARILY
MEDIUM STIFF,CLAYEY SILTS AND VERY SILTY TO SANOY CLAYS. THESE
MATERIALS ARE NON-EXPANSIVE IN THAT THEY WILL NOT CHANGE VOLUME
(SWELL)IF T~EIR MOISTURE CONTENT INCREASES.THE SUPPORTING
CAPACITY OF THE OVE~BURDEN SOILS IS CONSIDERED TD BE LOW TO MODERATE.
BASED ON THE SUPPORTING CAPACITY OF THE POOREST MATERIALS
ENCOUNTERED BY THE TEST PIT EXCAVATIONS,,I T IS RECOMMENDED THAT

This office has reviewed subject appl ication and inspected the site.The following
comments are presented for your consideration:
(a)a grading and drainage plan should be required and approved by this
office;
(b)the proposed driveway enters the county road at a very poor angle and
at a point of very minimal site distance.A revised driveway relocation
and parking plan should be submitted and approved;
(c)the slope from the parking lot to the barrow ditch should be constructed
at no more than one foot vertical to three feet horizontal and seeded,
or a properly designed retaining wall should be installed.
At this time,the county staff is not in a position to adequately follow through and
insure that conditions of an exemption are carried out prior to development.Therefore,
it is recommended that this appl ication be denied or tabled until items (a)and (b)
have been completed and item (c)agreed to.

AREA AND GENERAL DI SCUSSION:Lots 5 and 6 lie i n an area between major drainage
channels and are not subject t o large amounts of storm flows.There is an
a r ea,labe lled Area "A"on the enclosed map,co nsisting of about 8 acres,
which does affect the subject pr operty.Most of this drainage diverts to
bo th sides of this area,however,and little will affect the proposed struc-
There is a l arger ar ea to the Eas t of this whi ch drains into the Northerly
road ditch of Ga rmish Drive in f ront of the lots.This is called Area "B"
on t he attached map,and contains about 40 acres.The roadway is about
1 ,500 "feet in length and,because of this,and the total area drained,will
r equire a larger than normal dri veway culvert.Grades on the road are good
and,with wel l maintai ned ditches will carr yall of t he f l ow generat ed.

The sl~pes of t his site are 15-18%,and are moderate.The area is well
grassed where not disturced,aDd the ground above has trees and fair to good
vegetation.Since a smaller amount of sheet drainage will occur,drainage
swales along the side lot l i nes and between the proposed buildings are
necessary.The parking area can be drained,as proposed on the architects
drawing,to one corner of the parki ng area.However,it is not recommended
that the side lot drainage be taken to this same point since this would create
an additional load on a proposed gr ease trap manhole for this locaticm.This
manhole should be 4 feet in diameter and about 8 feet deep with a storm type
cast iron or steel inlet grating.The outlet should be 8"and submerged at
least ~feet below the water surface so that all oils and grease f rom the
parking and driveway area will be trapped.Cleaning of the manhole once or
twice a year will be necessary.

DRP.INAGE CALCULATIONS:Using the rational drainage formula for smaller dr ninage
areas,the maximum expected runoff from a 100 year storm would be computed
as follows:
SUMMARY AND RECOMMENDATIONS:The subject site will not be subject to any severe
drainage problems in a 100 year storm.Good drainage swales should be provided
along the side lot lines to the roadway.All disturbed areas should be
reseeded immediately.Road ditches should be 2 feet deep by ~feet wide
minimum, and a 30"driveway culvert should be installed.Drainage culverts
at the intersection just West of this site should be kept open so that
flooding will not occur across the roadway.This is not a problem of the
