Town Code sections can be found at www.vailciov.com under Vail Information - Town Code Online. All projects re-
quiring design review must receive approval prior to submitting a building permit application. An application for Design
Review cannot be accepted until all required information is received by the Community Development Department, as
outlined in the submittal requirements. The project may also need to be reviewed by the Town Council and/or the Plan-
ning and Environmental Commission. Design review approval expires one year from the date of approval, unless a
building permit is issued and construction commences.

Hey Mary,
The Town of Vail has recently received and reviewed the design review application for a new water feature and
new patio at the Hicks Residence located at 225 Forest Road.
The proposed water feature is located entirely within the Town of Vail owned Forest Road street right-of-way.
The Town of Vail Public Works Department has denied this proposal to construct improvements within the
Town's street right-of-way. The elements of the water feature already installed without permits must be
removed and the area shall be restored with natural vegetation within 30 days (by September 7, 2009).
The Hicks Residence is located within the Two-Family Primary/Secondary District. There is a minimum 20-foot
front setback requirement within this district pursuant to Section 12-6D-6, Vail Town Code; however, pursuant
to Section 14-10-4, Vail Town Code, patios or decks or other similar features may encroach into this required
front setback by 10 feet. The proposed patio does not comply with the minimum 10-foot setback from the front
property line and can not be approved as submitted. The proposed patio must be redesigned, a setback
variance application must be submitted for review by the Planning and Environmental Commission, or the patio
shall not constructed as proposed. Please let me know which of these alternatives you wish to pursue.

Hey Mary,
Please find attached a copy of the design review approval for the new stone veneer, water feature, and
landscaping at 225 Forest Road.
Please note that this approval does not apply to the proposed stone paver patio. The proposed patio does not
comply with the setback standards prescribed by the Vail Town Code. The proposed patio must be re-designed
to conform to the required setbacks or a setback variance must be obtained before design review approval can
be issued.
