quiring design review must receive approval prior to submitting a building permit application. An application for Design
Review cannot be accepted until all required information is received by the Community Development Department, as
outlined in the submittal requirements. The project may also need to be reviewed by the Town Council and/or the Plan-
ning and Environmental Commission. Design review approval expires one year from the date of approval, unless a
building permit is issued and construction commences.

As you are aware, windows have recently been installed at the Lauridsen Residence (265 Forest Road) without
design review or building permit approvals. Upon review of the since submitted Minor Exterior Alteration design
review application, it appears that the installed windows have enclosed Terrace #2 on the Lower Level Floor of
the structure. This enclose has created a residential addition, not a minor exterior alteration, to the building.
By enclosing Terrace #2, this previous exempt area is now calculated as Gross Residential Floor Area (GRFA).
The maximum allowed GRFA for this lot is 7,662 sq.ft. According to the final GRFA calculations for this property
(Building Permit B03-0278 - Revised), all but 381 sq.ft. of the allowable GRFA for this lot has already been
constructed. The proposed Terrace #2 enclosure is approximately 367 sq.ft. in size, which less than the
remaining 381 sq.ft.
However, the enclosure of Terrace #2, which is located on the lowest level of the structure, reduces the GRFA
"basement deduction" calculations for this property by increasing the amount of above-grade exterior wall area
used in that calculation. The enclosure reduces the overall basement floor area deduction rate from 35% to
29% which results in the property exceeding the GRFA limits by approximately 579 sq.ft. Therefore, design
review approval can not be issued for the already installed windows since they create a residential addition in
excess of the GRFA limits prescribed by 12-6D-8, Density Control, Vail Town Code.
To remedy this situation, said windows must be removed by no later than Noon on Monday, November 2, 2009.
Once the windows have been removed, please contact the Town of Vail Community Development Department
for inspections to verify their removal.
