Dear Martin,
I enjoyed meeting you at your office a few weeks ago when we discussed my unit(Landmark#116/TH5).
Alter Design Builders submitted a Building Permit Application on 4/30/09 for the anticipated renovation
of my unit with a valuation of$20,000. The scope of work that was actually agreed upon in August 2009
was$10,900 with $9,100 work remaining to be completed by another contractor. Please see the
attached application with the revised remaining work valuation signed by Howard Oisen. Please issue a
credit for the change in value from $20,000 to$10,900 for permit#B09-0084.
Attached is a new Permit Application for completion of the remaining work to be done by New Century
Builders—Erik Jensen. Please call me if you have any questions or concerns. Thanks and I look forward

Asbestos testing and abatement protects worlcers,homeowners,neighbors and emergency services responders from
exposure to harmful asbestos.The Town of Vail asbestos abatement program is in addition to the State of Colorado's
regulations.It is your responsibility to be in compliance with the State.Please contact the State directly for their
requirements at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require
asbestos testing:
One-and Two-Family Dwellings: 30 square feet
All Others: 160 square feet
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified
and Vail-registered abatement contractor.An asbestos abatement permit must be approved,
and the clearance letter must be submitted to the Town of Vail before the building permit will be
issued.

INTRODUCTION:
On August 22nd, 2006,an inspection/survey was conducted and 20
bulk samples were collected from the:

Vail,CO. 81657
The purpose of the inspection/survey was to locate and sample
suspected asbestos containing rnaterials that might be present in the
� Residence that is planned for demolition.
The inspection was made, and the samples were collected by 3ohn R.
Peterman, an A.H.E.R.A. and State of Colorado Certified Asbestos
Inspector. Great care was taken during the inspection and sampling to be as
accurate as possibie. It should be noted that minimai damage was done to
the existing building structures during the inspection so there is no
documentation for unseen conditions or stored items.
All samples were anaiyzed by DCM Science La.b in Wheatridge,CO.
This laboxatory is deemed `�'roficient"in the E.P.A.Quality Assurance (QA)
program for the determination of asbestos in buik materials, and is
accredited by the American Hygiene Association (AHA),
SAMPLING PROTOCOL:
A random sampling scheme was used to sample the suspect materials that
were discovered. If during any future demolition or renovation work,
suspect material is discovered that hasn't been sampled and would be
disturbed, work should be halted until tUe material has been tested.

The LandMark

SIJILDING DESCRIPTiON:
The LandMark consists of two multi-story baildings with a connecting
underground parking gara.ge. The Tower Building is the east building with
seven stories, and a garage level. 'The Town House building has single level
units on the first floor, and loft units on the tip levels. This survey covers
the inside of the buildings. The interior waiis are covered in sheetrock with
a light texture, and wood paneling. Note: In some areas a texture has been
troweled over the original finisli. The ceilings are sheetrock with a heavy
spray-on texture, and twin tee concrete with the same spray-on texture. The
basement area has suspended ceiling tiles tlu�oughout, and most have been
replaced not long ago. The older tiles were tested in the Billy's Grill area.
The floors are covered with carpet, ceramic tiles, and sheet vinyl flooring.
The sheet vinyl was not tested in this survey. The heating is provided by
baseboard heating, and fireplaces. No suspect thermai system insulation was
observed during this inspectioa The garage ceiling had a spray-on fire
proofing that was mostly removed prior to this inspection.
CONCLUSIONS AND RECOMMENDATIONS:
Presumed Asbestos containing materials,present in the buiidings, are as
follows:

Labora.tory Analysis of the bulk samples collected during tlus inspection
inclicate that Asbestos was detected in all of the composite sheetrock
samples. However, the Asbestos content is less than the Regulatory Limit
(Greater than 1% Asbestos). The.Asbestos content of the samples was
verified by the Requi�red Point Count Analysis. The samples collected were
taken from the original areas of the buildings. If conditions are encountered
that aze not the originai construction, additional testing or documentation
may be required. If the renoWation work will irnpact on the three presumed
Asbestos containing materials listed, the P.A.C.M. must be handled as per
Colo. Reg. #8 prior to disturbance of the materials.

Hazardous Air Pollutants(NESHAP}for asbestos(Federal Register,Vat. 55, No.224,pp.48406-48433,
11/'20/90y. The analyticat procedures foilowed are describeci in°Interim Method for the Determinatian of
Asbestos in Buik Insufatiort Sampies",(USEPA 600iM4-83-020, 1982),with minor modifications recommended
by the Atmospherie Research and Exposure Assessment C.aboratory,USEPA,Research Triangie Park, N.C.
Samples analyzed by the point count method are milled to homogenize fhe sample,prepared on microscope "
stides and point counted using po(arized light microsc:opy(PLM)in conjunction with a point counting stage and
counter. One hundred counts are perEormed on four separate preparations of each sampie for a tota[of 400
points.. If asbestos is identfied buf not counted during the poinf counting procedure,total asbestos is reported
as zero and presence is noted on the report. Other preparation procedures induding ashing artd acid washing
may be perfarmed with client permission to improve accuracy in determining asbestos concentration. Atl
samples are archived for six months unless other arrangemenis are made by the dient.

DCM Science Laboratory, Inc.analyzes bulk asbestos samples foltowing procedures developed by the
McCrone Research lnstittute and in comptiance with guidelines estabfshed by the Environmental Protec�ion
Agency(EPA-600/R-93/116,July, 1993).
Buik sampies are prepared for anafysis using a 10X-80X stereo microscape in a hepa filter hood which provides
a contaminaaon free environment. The sample is then analyzed by polarized tight microscopy(PLM)at t00X.
When the sample consists of more than one fayer,each tayer is prepared and analyzed separatety_ Fiber and
matrix materiats are iden6fied by the characterization of op6cat properbes including color and pleochrorfsm, �
form,deavage;relief;birefringence�gXfj�jOR,orienta6on,tuvinning,interference figure and other distinguishing
features. Dispersion staining is also used to further aid in mineral identification. Ail percentages of asbestos,
other fibers and non-fibraus constituents are cakx�lated from the va�ues obtained from the stereo and PCM
microscopes analysis. In-house and NIST standards as wel!as a chart prepared by R.D.Terry and G.V.
Chilinger for'The Journa[of Sedimentary Petrobgy�", (Valume 24,pp.229-234, 1955)provide a guide for
estimating percenfages. A!I samp(es are archived for so�months unless other arrangements are made by the
