SUBJECT: First reading of ordinance No. 8, Series of 2010, an ordinance
amending Section 12-14-20, Commercial Core Construction, Vail
Town Code, to allow for the extension of the commercial core
temporary construction signage for businesses and setting forth
details in regard thereto.

I. DESCRIPTION OF THE REQUEST
The applicant, the Town of Vail, is requesting a first reading of Ordinance No. 8,
Series of 2010, for proposed text amendments to Section 12-14-20, Commercial
Core Construction, Vail Town Code, to allow for the extension of the commercial
core temporary construction signage for businesses and setting forth details in
regard thereto.
The Vail Town Council shall approve, approve with modifications, or deny
Ordinance No. 8, Series of 2010, upon first reading. Attached for reference are
Ordinance No. 8, Series of 2010 (Attachment A) and the April 26, 2010 Staff
memorandum to the PEC (Attachment B).
II. BACKGROUND
On May 3, 2005, the Town Council adopted Section 12-14-20, Commercial Core
Construction, Vail Town Code, through Ordinance No. 10, Series of 2005. These
regulations facilitated the installation of temporary construction mitigation signs
and fencing within the Town’s commercial areas to lessen the impact of
redevelopment construction on the Town’s businesses, residents, and guests.
These regulations were originally set to expire on April 1, 2008, but were
extended to April 1, 2010 by Ordinance No. 4, Series of 2008.
On April 26, 2010, the Planning and Environmental Commission forwarded a
recommendation of approval to the Vail Town Council for Ordinance No. 8,
Series of 2010 by a vote of 6-0-0.
III.CRITERIA FOR REVIEW
The criteria outlined in Section V of Staff’s April 26, 2010 memorandum to the
Planning and Environmental Commission shall be used as the principal criteria in
evaluating the merits of the proposed special development district.

IV. REQUESTED ACTION
Should the Town Council choose to approve Ordinance No. 8, Series of 2010,
upon first reading, the Community Development Department recommends the
motion
Town Council pass the following :
“The Town Council approves, on first reading, Ordinance No. 8, Series
of 2010, an ordinance amending Section 12-14-20, Commercial Core
Construction, Vail Town Code, to allow for the extension of the
commercial core temporary construction signage for businesses and
setting forth details in regard thereto.”
Should the Town Council choose to approve Ordinance No. 8, Series of 2010,
upon first reading, the Community Development Department recommends the
findings
Town Council makes the following :
“1. That the amendments are consistent with the applicable elements of
the adopted goals, objectives and policies outlined in the Vail
Comprehensive Plan and is compatible with the development
objectives of the Town, based upon Section V of the Staff
memorandum dated April 26, 2010, and the evidence and testimony
presented; and,
2. That the amendments further the general and specific purposes of
Zoning Regulations, based upon Section V of the Staff memorandum
dated April 26, 2010, and the evidence and testimony presented; and,
3. That the amendments promote the health, safety, morals, and general
welfare of the Town and promote the coordinated and harmonious
development of the Town in a manner that conserves and enhances
its natural environment and its established character as a resort and
residential community of the highest quality, based upon Section V of
the Staff memorandum dated April 26, 2010, and the evidence and
testimony presented.”
