One of the stipulations for providing the new product requires that the chimney covers comply with the Intemational Fuel Gas Code, section 503.5.4 which reads in part "decorative shrouds shall not be installed at the terntination of factory�built chimneys except where such shrouds are listed and labeled for use with the speciic factory-built chimney system and are instal/ed in accor�dance with the manufacturers installation instructions." There are several mitigating circumstances with this project which require additional consideration. The first is that the factory-buitt fireplace manufacturer, Pr+eway, is no longer in business. Secondly, the existing flues require terminafion caps which are currerrtly missing. Third, all of the fireplaces except one have been converted to gas-buming appliances. Fourth, the structure above the fireplace chase is a cover, and not a shroud. Shrouds typically have closed sides to hide or `shroud' the vent teRninations. In this instance all the flues are completely exposed. We have researched and reviewed the shroud requirements of other manufacturers such as Simpson DuraVerrt and compared their UL listed designs to those of this project. We have evaluated the clearances for designs that approximate the irrtentions for this project and have found what we consider to be acceptable conditions. In fact, the new design of chase covering provides improved conditions compared to the existing structure. We have consulted with American Chimney Shroud, a leading manufa�turer of listed shrouds. They have concurred with our assessment that the new design of chase oovers will meet and/or exceed the requirements for a safe and functionaF fireplace system. I have attached a copy of their letter for your review. Since we cannot speak with the fireplace manufacturer we are requesting that, under the currerrt circumstances as outlined above, you witl consider the installation of the new chimney caps and covers to have been thoroughly evaluated and safe for this intended application. Being one of very few UL approved decora.tive chimney cap manufacturers in the country has given American Chimney Shroud an unpaxalleled expertise with safe chimney configurations. Unfortunately, in this situation the The ICC (International Commercial Code) R1004.3 stating that "Decorwtive chininey shrouds should not be installed at the termination of air cooled chimneys for factory built fireplaces e.xcept where the shrauds are listed and labeled for use with the specific jactory built fireplace systein and installed in accordance with manufacturers i�rstulla�ion insd�udions" can not be "precisely" satisfied. However, logically and reasonably, this standard can be met, considering the fireplace and flue manufacturer in question has been defunct for almost two decades, and many identically engineered fireplace and chimney products still remain on the market that do offer specifications for UL approved custom tops. American Chimney Shroud has laboratory tested to these specifications and is therefore preferred and recommended by the current flue manufacturers as a source for custom chimney tops. Moreover, in regard to the actual architectural design, the chimney cover will in no way hinder or even affect the function of the fireplace systems involved. The lid will sit several feet off the top of the chase, and is completely open and frce flowing around its perimeter. The lid will also include an open top maintaining complete and free air flow around all dimensions of the fireplace flues. The new caps in question will be a significant improvement in design, quality and safety over the existing site conditions. Since the original chimney manufacturer, Preway is no longer in business, I have researched 2 cutrent chimney manufacturers; Selkirk and Dura-Vent. found the shroud construction requirements for each manufacturer were identical. On page 3 of the Dura-Vents publication L157, the following is stated: "A shroud built and installed in compliance with these instructions is LTL listed for use with DuraTech chimney (listing number MH7399)." Therefore I conclude that if the shrouds on the subject project are construc�ed in accordance with Dura-Vent's requirements, the shroud will be UL listed for the application, and the intent of 2006 IFGC 503.5.4 is sa.tisfied. After reviewing and performi.ng area calculations on the proposed shroud design drawing (see attached), I find the proposed chimney cover design in compliance with the shroud requirements from Dura-Vent publication L157, dated 10/2007. Please find my calculations attached. When the construction is complete, the chimneys will be in compliance with the 2006 IFGC, and be demonstrably safer than the existing conditions. APPLICATION AND LISTING As specified in these instructions, Shrouds are approved for use with DuraTech Chimney (5"-24" diameter). A Shroud built and installed in compliance with these instructions is UL listed for use with DuraTech chimney (listing number MH7399). INSTALLATION NOTES Practice good workmanship. MH7399 �L SHROUD REQUIREMENTS Shrouds can either be field-fabricated or factory-fabrfcated, but they must meet the requirements as specified in these instructions. Shrouds must be constructed of a minimum 24 gauge (.024") stainless steel, aluminized steel, galvanized steel, or copper, Other materials may also be used, such as brick, mortar, stucco, stone, etc., provided they are compietely non-combustible. Check with your local building code authorities for any additional shroud requirements. Shrouds must be able to be remaved to allow chimney access to properly clean the chimney. DuraTech installations which include the use of a shroud must comply with the following requirements (Fl�ure 1): • DuraTech chimney must maintain at least 2" clearance from combustible materials. • The chase enclosure must be ventilated. • The Chase Top Flashing or fleld-fabricated chase pan must be used. Fieldfabricated chase pans are acceptable if they meet these requirements: • Materiai must be 24 gauge (.024") Galvanized steel or equivalent, • Chase pan must have opening 3" larger than outside diameter of chimney pipe with at least a 1/2" upturned flangelcollar, • Chase pan must overhang chase by 1/2" per side for proper air flow, ■ Chase pan must have a 1" down urned outside edge (weather protection). Most factory-fabricated shrouds will fail under one of these basic sryle categories.
