Re: Proposed Club for Vail Plaza Hotel
Dear Mr. Spencer,
The purpose of this letter is to clarify under what circumstances a ski club with ski
storage could be located on the second floor of the Vista Bahn Building which is within
the Commercial Core 1 (CC1) zone district. In order for a ski club with ski storage to be
located on the second floor (location of the current Tap Room) you would need to be
proposing either a permitted or conditional use as identified within the CC1 zone district.
A review of the Zoning Code specifically identifies a ski club or ski storage (commercial
ski storage) only within the basement or garden level of a structure. However, there is a
process by which a proposed land use can be determined by the Town Council to be
similar to an identified permitted or conditional use. The Town Council has recently
acted on two requests which may be applicable to your request.
On November 7, 2006, the Town Council made a determination that a "cocktail lounge
and bay" that utilizes no more than 30% of the total floor area of a space for ski lockers
and ski equipment storage remains a cocktail lounge and bar, which is a permitted use
on the second floor. On July 21, 2009, the Town Council approved a request by Four
Seasons to locate an exclusive ski concierge service in a structure located on property
zoned CC1. This requested resulted in the proposed exclusive ski concierge service
being determined to be a "Lodge Accessory/Personal Service Use ", which is a permitted
use on the second floor.
These determinations of similar use were based upon the description of the use as
having memberships for hotel guests, fractional unit owners, and other social members
where the services provided include, but are not limited to: lounge areas with ancillary
food and drink service available; changing areas, restrooms, and lockers; ski storage
facilities; ski rental facilities; and other recreational or social amenities. There was also
consideration to how the space would be utilized outside of the ski season to ensure
activity and vibrant activity in the Village.

Based on the determinations in 2006 and 2009 it may be possible to propose a cocktail
lounge and bar which has ski lockers and storage as an ancillary use or a lodge
accessory/personal service use. Should it be determined that your proposal for the
second floor of the Vista Bahn Building complies with the Zoning Code or meets the
speck findings made by the Town Council in 2006 and 2009 there would be no
conditional use or other special approvals required to establish a ski club with ski
storage. The only approvals that would be required would be a design review
application for signage, any exterior improvements, and the appropriate building permits.
