My name is Jay Jamison, and I serve as the Board President for the Village Center Association, the largest condominium association in Vail Village. I am writing regarding the proposed Gore Creek Promenade refurbishment project. According to the Gore Creek Promenade project website, the project is slated for a design decision during your upcoming meeting this Tuesday. However, the official agenda for the Council meeting does not include this topic as an agenda item, which has created some uncertainty. Homeowners at Village Center only recently became aware of the current plans for the refurbishment project. We have significant concerns about the design and its potential impacts on the broader Vail Village as well as our community. While some owners have submitted public comments outlining these issues, we feel strongly that these concerns merit further discussion and collaboration before any final decision is made. I plan to attend Tuesday’s meeting and will provide comments during the public forum. However, I would like to respectfully request that the Council consider delaying any vote or decision on this project to allow for additional dialogue with stakeholders like our association and others in the community who will be directly affected. While I understand the intention behind addressing the housing challenges faced by our local workforce, this measure 6 If the true intention is to create more housing, I encourage the council to focus on individuals who own homes valued at over $6 million that are neither used by the owners nor ever rented out. Introducing a higher tax bracket for these properties could generate significant revenue without placing an undue burden on smaller property owners. These individuals, who likely 7 affordable long-term rentals could be a more constructive path forward. Thank you for your attention to this matter. I am a partial owner of a three bedroom townhouse in the Vail Racquet Club. We built child size bunk beds in the original laundry room. That small room is never rented as our skis are also stored there as well. The club requires a pull out couch in the living room. It is my understanding that ordinance 24 would therefore impose taxation of 5 total sleeping areas for our modest Unit L3, VRC. My family first purchased our beloved retreat in 1988. We continue to use and share our unit with family and friends but also participate in the rental pool to help cover taxes, insurance and upkeep of the unit. The proposed Ordinance 24 is exorbitant new taxation which will impose a great hardship on me and my family. At the very least it should not be applied to operations such as the Vail Racquet Club. You'll end up with less modest rental availability, less skier and hiker days and it will be a vicious cycle of decreasing prosperity for the more common people who love Vail too. I own a unit at the Vail Racquet Club and rent it as part of the Vail Racquet Club’s short-term rental program. Because I enjoy spending time in my Vail home and being a part of the community, I am not able to rent my home on a longer-term basis. The large fee increase you are considering would cause me to re-evaluate offering my home for vacation rentals, as even now revenue is supplementary and covers only a small percentage of my overall costs of ownership. STR units are an important segment of the Vail economy. Passing this Ordinance would be detrimental to STR owners and may result in negative impacts to Vail’s rental inventory and sales tax collections. I urge you to vote no on the proposed Ordinance and to instead consider other more balanced approaches if additional funds are needed to support affordable housing initiatives. While I understand the intention behind this proposal to fund affordable employee housing, I have concerns about the timing and the substantial financial burden it will place on STR operators and property owners. The proposed fee increases represent a significant escalation that could drastically impact operations, guest pricing, and owner satisfaction. Similarly, the fees for off-site STRs are disproportionately affecting homeowners who rely on third-party management services. These increases will result in substantial cost hikes that will likely be passed on to guests, potentially reducing Vail’s competitiveness as a tourist destination and impacting overall occupancy rates and town sales tax revenue. Off-site STR owners may face particular challenges, as many are individual homeowners who are already dealing with increasing operational costs and taxes. These drastic fee increases could disincentivize STR participation altogether, leading to fewer rental options and potentially harming the local economy. Moreover, the current timeline for implementing these changes feels rushed, especially given the long-term implications for property owners, guests, and the broader STR ecosystem. Instead of imposing such significant fee increases, I respectfully recommend that the council: 1. Delay the decision to allow for further discussion and stakeholder input. 2. Conduct an updated housing study to assess the current need and identify alternative solutions. 3. Explore more equitable funding options, such as increasing the Lodging Tax, which would distribute the cost burden across a broader base rather than targeting STRs exclusively. I ask that you reconsider the scope and scale of the proposed changes to ensure a balanced approach that supports affordable housing without disproportionately impacting STR operators and owners. The proposal for raising the short term rental fee for units in the town of vail is short sighted, and will have far reaching, longer term consequences to the town. This proposal suggests a minimum increase of 2,300%. That increase is, quite frankly, unconscionable. No property owner can budget or plan for a change in their expenses to this extreme degree. This increase is even more drastic if you consider that it includes a per bedroom basis -- thereby further multiplying that increase. Perhaps in suggesting this measure, your intention was that such costs could be "passed on" to the renter. That is NOT the way that economic markets work, though we would love it to work that way. In fact, if owners were to increase their rates to compensate for this additional expense, demand for rentals will drop. People will choose to drive to Vail rather than stay in Vail. This will not only affect tourism, but also traffic, and business. One of the beautiful attractions of Vail is the walkability of it. People come to stay; they ditch their car, and they walk to restaurants and shops. If people do not stay in Vail because the cost is too high, business will be negatively affected. Property values will also eventually be impacted. This additional, unplanned expense on property owners will cause many to sell their property. The "economics" of owning that asset will demand its sale. However, who will buy, when a prospective owner cannot cover the costs of ownership given the additional costs, and inability to recoup those costs. Understandably, this decision was intended to eliminate some budget deficiency. I would strongly recommend that the council review the potential hazards of such a move. The ultimate costs of this decision will certainly, and greatly outstrip any short term gain created by enacting it. This plan is a dangerously bad one. A 24 times increase is outrageous. In addition to being exorbitant, it puts a tremendous hardship on individual unit owners who are having a hard enough time showing an annual profit or even breaking even. It may also have the unintended consequences of depressing the real estate market. We enjoy living part time in Vail and our ability to rent out our unit when we are not there makes this possible. such a rental fee increase would definitely be a hardship for us and could possibly necessitate our selling our unit. I also rent my condos when I'm not in town in order to help me maintain the ever increasing costs of maintenance and living. Today I am learning you are considering increasing the current $50 per unit annual short term rental fee to $1,000 to $2,000 per bedroom per year. I am hearing you are settling into a figure of $1,200 per bedroom per year. In my case, I have a 2 bedroom condo, which would translate into a 4800% increase!!! That is an outrageous increase and I am oppose to it. While I don't disgaree to an increase given the inflation, I would agree to something like 5% to 10% maximum. Frontage Road Vail, CO 81657 Dear Members of the Vail Town Council, I am writing as a second homeowner in Vail to express my deep concern regarding the proposed increase in short-term rental (STR) fees from the current $50 per unit per year to $1,200 per bedroom per year, set to take effect in June 2025. While I understand the Council’s goal of addressing affordable housing challenges, I believe such a steep increase will have significant unintended consequences that could negatively impact homeowners, the local economy, and the Vail community as a whole. Like many others, I am only able to maintain my second home in Vail by renting it out when I am not using it. The proposed fee increase would dramatically raise the cost of ownership, making it more challenging to keep my property in Vail. This is not simply a matter of passing the added expense on to renters; it fundamentally increases the financial burden of owning property in Vail year over year. I also want to highlight that my ability to use my property during the off-seasons, when I visit Vail as a second home for approximately half of the year, directly contributes to the local economy. As a frequent visitor, I spend money on groceries, dining out, and shopping in Vail’s retail stores, adding consistent revenue to the community even when tourism activity may be lower. These contributions, along with those of other second homeowners, are part of what sustains Vail’s businesses year-round. I recognize and support efforts to address affordable housing for locals, but such a substantial fee increase risks undermining the delicate balance that enables property owners like myself to contribute to the community and local economy. Short-term rentals play a vital role in supporting tourism, providing diverse accommodation options, and contributing to local businesses. An excessive fee increase could drive some homeowners to sell, potentially reducing the availability of vacation rentals and impacting tourism revenue. I urge the Council to consider the following alternatives that would better balance the need for affordable housing with the sustainability of homeownership: • Incremental Fee Increases: Gradually increasing the STR fee over several years to ease the burden on property owners while still generating additional revenue. 18 • Tiered Fees: Implementing a tiered structure based on rental income or usage, so smaller-scale owners are not disproportionately affected. I respectfully ask that the Council reconsider the proposed fee structure and evaluate more balanced approaches that account for the contributions of second homeowners to Vail’s vibrant community and economy. Together, we can find a solution that supports affordable housing goals without imposing prohibitive costs on property owners who love and invest in Vail. Thank you for your time and consideration. VAIL TOWN COUNCIL AGENDA ITEM REPORT ATTACHMENTS: Council Memo 1-7-25 39 To:Town Council From:Public Works Department Date:January 7, 2025 Subject:Ford Park Retractable Bollard Contract Award I.SUMMARY The Town of Vail has $400k remaining in the Vail Pedestrian Safety budget to install two retractable bollards at the entrance to East Betty Ford Way to restrict and control vehicular access into Ford Park. The proposed bollards are retractable to allow authorized vehicles to access as needed. The project also will function as a pilot test of retractable bollards to better understand their operations and maintenance in Vail and determine if they might be appropriate in other key high pedestrian areas. Town staff advertised the project for public bid in November and received only one bid from Hallmark Inc. in the amount of $410,000. Hallmark Inc. has experience in Vail and Ford Park, and most recently completed the improvements to West Betty Ford Way. Since the bid opening town staff, the design consultant, Hallmark and the retractable bollard vender met to find savings in the project. After thoroughly vetting the project, the team was able to reduce the project installation costs to not exceed $300,000; a portion of which ($105,000) will be funded by the MMOF grant received in the fall of 2022. The project is scheduled to start at the end of April and be completed by the end of May, so that it does not interfere with any scheduled events at the Ford Park Amphitheater. The bollards themselves have a 12-16 week lead time and will need to be ordered in the next couple of weeks in order to meet that timeline.
