Subject: Solar Vail
We reviewed the fact that the Solar Vail application is really three applications for Conditional use permits.
1. Type VI EHU’s in the 9H) zone district.
2. Office space in the (H) zone district.
3. Telecommunications antennae in the (H) zone district.
Henry to provide Scot with the required documentation for these applications as soon as possible.
Scot passed along the preliminary comments from Public Works:
a. No snow storage area.
b. Long distance for delivery trucks to back up before getting to the hammerhead at the lower end of the driveway.
The applicant will be prepared to discuss these issues at the PEC meeting on the 25th.
Nina reviewed the requirements and regulations associated with the housing.
a. The first 5730 SF of housing will be assigned to replace the 11 existing deed restricted units on the site. This will be covered by a blanket deed restriction assignment.
b. The office space will have to have deed restricted units assigned to it. Nina’s quick calculations were that approximately 3 beds would have to be assigned to the office space.
As the office space will not be sold, Johannes will be the assignee.
c. All the remaining units will be deed restricted individually.
1) Deed restrictions will be assigned per unit and units may not be subdivided to different assignees.
2) Deed restriction assignments are in perpetuity and may not be reassigned.
3) Only 70% of the units in the project are required to be deed restricted.
d. The deed restrictions shall be recorded prior to TCO. Assignment of deed restrictions does not have to be done at that time and may be done later.
e. Priority shall be given to employees in the TOV when rentals are made.
f. Rents shall be “attainable” by employees in the TOV.
g. There are no annual fees or other costs associated with the deed restricted ehu’s.
When asked if TOV pay-in-lieu money was available for a project like this, Nina noted that TOV money was not. However, she suggested contacting Alex Potente at Eagle County (328-8685)
to see if the County had any Private Activity Bond money available. She also noted that the State CHAFA board sometimes offered loans and grants although the Vail area did not normally
see much interest on the part of the State.
Scot asked if the applicant would be amenable to making the PEC meeting on the 25th a worksession. The response was that we would prefer to keep it as a “final” hearing and that we
could table if the PEC raised issues that could not be resolved at that meeting. We also noted that in the past approvals have been given with specific conditions that required a return
to the PEC to get approval for specific items. This approach usually works to limit the scope of discussion at the subsequent hearings while allowing the applicant to move forward to
the DRB.
Scot requested that we submit a grading and drainage plan as soon as possible. This is in addition to the additional submittal requirements necessary for the CUP’s.
