I am counsel for the owners of the two residential units in the Rucksack Building both of whom
filed a development application with the Town of Vail, namely William A. Gardiner and Debora
A. Gardiner, Martin J. Mullally Credit Trust, and Yvonne Mullally Survivors Trust. William
Pierce is the architect for their requested development.
I was provided a copy of your correspondence of August 18, 2008, to Mr. Pierce that set forth
your initial comments and concerns regarding the development of the two residential units. Mr.
Pierce will respond to your comments as he has the appropriate knowledge and experience
regarding these matters. One matter that I was asked to address pertains to paragraph 3.b., of
your correspondence, where you request"adequate homeowner's association sign-off. . . ." We
believe that was provided to the Town of Vail in the Resolution of September 29, 2007, a copy
of which provided to the Town of Vail on October 1, 2007, by Jeffrey Selby in conjunction with
his development application of the Rucksack Building. Please refer to paragraphs 2-3. Mr.
Selby's application was approved by the Town of Vail based upon his representation that he had
authority of the HOA which by the way only includes Mr. Selby and the two residential owners.
The Resolution as represented by Mr. Selby gives HOA approval for his development of the
Rucksack building, as well as the development of the units of the residential owners. The Town
of Vail allowed Mr. Selby to move forward with his development of the Rucksack Building in
accordance with the Resolution. We believe that the Resolution should answer your initial
comment and concern regarding this issue. I trust that I addressed this concern.
