If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works) review and approval,
a Planning Department review or Health Department review, and a review by the Building Department, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multi- family permits will have to follow the above mentioned maximum
requirements. Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

CODE 5 -2 -10: DEPOSITS ON PUBLIC WAYS PROHIBITED
❑ Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or deposit, or cause to
be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any other debris or material upon any
street, sidewalk, alley or public place, or any portion thereof.
❑ Notice; Abatement: The Director of Public Works may notify and require any person who violates or causes another
to violate the provision of subsection A hereof, or who has in the Director's employment a person who violates or
causes another to violate the same, top remove such sand, gravel, rocks, mud, dirt, snow, ice or any other debris or
material within twenty four (24) hours after receipt of said notice by the Director of Public Works. In the event the
person so notified does not comply with the notice within the period of time herein specified, the Director of Public
Works, or other authorized agent, may cause any such sand, gravel, rocks, mud,, dirt, snow, ice, debris or any other
material to be removed from any street or alley at the expense of the notified.
❑ Summons and Penalty: As an alternative to the notice for removal provided in subsection B above, any person
who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of
the Town for said violations, and upon being found guilty of a violation hereunder be punished as provided in Section
1 -4 -1 of this code.
❑ Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the Director of Public
Works as provided in subsection B hereof, and any such person shall, in addition to payment of the expense of removal
incurred by the Director of Public Works, as provided in subsection B hereof, upon being found guilty of a violation
hereunder, be punishable as provided in Section 1 -4 -1 of this Code. (1997 Code: Ordinance 6 (1979).

':- ! 1.0 PURPOSE AND SCOPE OF SERVICES
J The purpose of this project was to conduct an asbestos survey of the Apollo Park Lodge
buildings C and D located at 442 South Frontage Road East, Vail, Colorado, hereinafter
referred to as the site. The survey was conducted in accordance with ATC's written
Proposal Number 35 -06- 0074 -E, dated March 22, 2006. On April 27, 2006, ATC provided
the services in accordance with the referenced agreement, and as outlined below:
Conduct an asbestos survey in the identified buildings, which includes the
following:
1. Review existing asbestos reports for the buildings, if available.
2. Survey the site buildings scheduled for demolition.
3. Identify accessible suspect asbestos - containing materials (ACMs) in the
building interiors, exteriors and roofs using United States Environmental
Protection Agency (EPA) Asbestos Hazard Emergency Response Act
(AHERA) protocols.
4. Collect and analyze bulk samples of suspect friable and non - friable materials
to eliminate suspect materials as asbestos containing.

2.0 GENERAL SITE CONDITIONS
The site is located at 442 South Frontage Road East in Vail, Colorado. The buildings are
I three story wood framed structures with stucco exteriors and concrete foundations that

were constructed in 1978. The buildings consist of approximately 29,800 square feet of
space. Samples collected from the buildings included drywall and associated joint
compound, sheet flooring, ceiling tiles, acoustical ceiling texture, sink undercoating, cove
base adhesive, pipe insulation sealant, stucco, exterior sealant, roofing materials, carpet
mastic, wall texture, ceramic tile adhesive, flange gaskets, and roof tar.

ATC representatives, Mr. Josh Lewis and Mr. Todd Anderson AHERA and Colorado -
certified asbestos building inspector (certification number 2157) conducted the asbestos
survey at buildings C and D located at 442 South Frontage Road East in Vail, Colorado.
Previous ACM survey reports were not made available for review.
The building was visually inspected for the presence of building materials that are suspected
to contain asbestos. Bulk samples of identified suspect ACMs were collected and placed
into individual containers for transport to a National Voluntary Laboratory Accreditation
J Program (NVLAP) /American Industrial Hygiene Association (AIHA)- accredited laboratory
for analysis. Materials visibly identified as non - asbestos (fibrous glass, foam rubber, wood,
etc.) were not sampled. The asbestos survey consisted of three basic procedures: 1)
conducting a visual inspection of the structures; 2) identifying homogeneous areas (HAs) of
suspect surfacing, thermal system insulation, and miscellaneous materials; and 3) sampling
accessible friable and non - friable suspect materials.
3.1 Homogeneous Areas
Prior to collecting any samples, HAs were identified and listed to develop a sampling
strategy. A homogeneous sampling area can be described as one or more area of material
that are similar in appearance and texture and that have the same installation date and
function. The actual number of samples collected from each homogeneous sampling area
may, vary, based on the type of material and the professional judgment of the inspector.
3.2 Hazard Assessment Factors
From the list of suspect homogeneous materials, a physical assessment was performed for
each material on the list. A physical assessment includes evaluating the condition, assessing

the potential for disturbance, and determining the friability of each material. Friability is a
term used to describe the ease in which a building material inherently lends itself to
disturbance. By definition, t friable t materials are those that can be crumbled or reduced to
powder by hand pressure when dry. Each material on the list was further classified into one
of three categories, which have specific sampling requirements for each category.
Surfacing Materials: Refers to spray - applied or troweled surfaces such as plaster
ceilings and walls, fireproofing, textured paints, textured
plasters, and spray- applied acoustical surfaces:
Thermal System Insulation: Refers to insulation used to inhibit heat gain or loss on pipes,
boilers, tanks, ducts, and various other building components.
Miscellaneous Materials: Refers to friable and non- friable products and materials that
do not fit in any of the above two categories such as resilient
floor covering, baseboards; mastics, adhesives, roofing
material, caulking, glazing, and siding.. This category also
contains wallboard, joint compound and ceiling tile.
All confirmed ACMs were then assessed by their condition as good (intact), fair (damaged),
or poor (significantly damaged) per Title 40 Code of Federal Regulations Part 763.
Material with localized significant damage was also assessed as poor when observed.
3.3 Sampling Strategy
Sample collection depends on the category that the HA falls into and the amount of
material present, as follows:

If the analytical results indicated that all of the samples collected per HA did not contain
asbestos, then the HA (material) would be considered a non -ACM. However, if the
analytical results of one or more of the samples collected per HA indicate that asbestos is
present in quantities of greater than 1 percent asbestos by weight (as defined by EPA), all of
the HA (material) would be treated as an ACM regardless of any other analytical results.
Materials that can visually be determined to be non - asbestos containing (i.e., fibrous glass,
foam rubber, etc.) by the accredited inspector are not required to be sampled.
Miscellaneous materials require adequately representative sampling, which is typically done
by collecting at least three samples per material. Inspectors typically rely on other survey
observations such as the condition, friability, and quantity of material to determine what
would be a sufficient amount of samples to accurately evaluate the presence or absence of
asbestos content.
Actual collection of a bulk asbestos sample involves physically removing a small piece of
material and placing it in a marked, airtight container. Sample containers are marked with a
unique identification number, which is also noted in the field notes.

3.4 Suspect Asbestos - Containing Material
Seventy -nine (79) bulk asbestos samples were collected from the building and one hundred -
sixteen (116) sample layers were analyzed by Polarized Light Microscopy (PLM) based on
the of niber of distinct layers (materials) associated with each bulk sample. For example,
floor tile and associated mastic are collected as one bulk sample but are analyzed as two
distinct materials by the asbestos laboratory, as required by the NVLAP. A summary of
identified, accessible suspect and confirmed ACMs follows:

Additional ACM may be present on site in inaccessible or concealed spaces. These
spaces include, but are not limited to, pipe chases, spaces between wall /ceiling /door (fire
rated doors) /floor cavities, interior of mechanical components such as cooling tower,
interior ducts, beneath foundation pads, etc. If future maintenance /renovation/demolition
activities make these areas accessible, ATC recommends that a thorough assessment of
these spaces be conducted at that time to identify and confirm the presence or absence of
additional ACMs. Until then, all such unidentified materials should be treated as
Presumed ACM (PACM) in accordance with 29 CFR 1926.1101 and 1910.1001.
3.5 Laboratory Analytical Results
Bulk samples were analyzed by ATC's Analytical Laboratory located in Centennial,
Colorado, using PLM according to EPA method 600/M4 -82 -020 or 600/R- 93/116. This
laboratory participates in the NVLAP, a quality, assurance program for PLM, and is
accredited by the National Institute of Standards and Technology (KIST), and The
American Industrial Hygiene Association (AIHA).
Any material that contains greater than 1 percent asbestos is considered an ACM and must
be handled according to OSHA, EPA, and applicable state and local regulations.
For friable materials, when the amount of asbestos in the sample material ' is reported as
"None- Detected" by PLM analysis, no further verification of the sample results by Point
Couri ng Methodology is recommended.
For friable materials, when the amount of asbestos in the sample material is reported as
"Trace Asbestos Detected" or less than 10 percent asbestos by PLM analysis, the client may

either assume the amount to be greater than 1 percent and treat the material as ACM or
require further verification of the amount by Point Counting Methods. If the result obtained
by the Point Counting Method is different from the result obtained by PLM analysis, .the
Point Count Method result will be used.

"Non- Detect" or "Trace Asbestos" by PLM analysis, due to the difficulty in analyzing
"small, thin fibers" associated with vinyl /asphaltic or resinously bound materials, ATC
recommends that these types of materials, which were reported an non -ACMs by PLM, be
analyzed using TEM- Chatfield Method.
Copies of the laboratory's Analytical Report and corresponding chain -of- custody
documents are included in Appendix A. Results are reported in percent asbestos by
volume and indicate the types of asbestos. Other common non - asbestos components may
also be noted on the analytical reports. Inspector and laboratory accreditation are
provided in Appendix B.

under a written Operations and Maintenance (O &M) program, by suitably trained
personnel, until renovation necessitates removal or until the building is demolished.

Subcontractors and employees working within the structures at the site should be made
aware of the locations of the ACMs and the possibility of concealed suspect ACMs that
could be found during renovation/demolition activities. They should be advised not to
disturb the ACMs or PACMs.
Any concealed building materials discovered during maintenance or renovation activities,
which are suspected to contain asbestos, should be sampled and analyzed to confirm the
presence of asbestos prior to the disturbing such materials.
For friable materials, when the amount of asbestos in the sample material is reported as
"Trace Asbestos Detected" or less than 10 percent asbestos by PLM analysis, the client may
either assume the amount to be greater than 1 percent and treat the material as ACM or
require further verification of the amount by Point Counting Methods. If the result obtained
by the Point Counting Method is different from the result obtained by PLM analysis, the
Point Count Method result will be used.
The EPA has not prohibited the manufacture and import of miscellaneous materials, such
as vinyl floorings, mastics, roofing materials, etc. As a result, any future replacement
materials should be checked for the presence of asbestos prior to installation.
The friable regulated ACMs (RACMs) and the Category II Non - friable materials (such as
joint compound, wall texture etc.) that have a propensity to become friable during
renoyation/demolition, identified in the tables above are recommended for removal by
Colorado Department of Public Health and Environment (CDPHE) - licensed personnel in
accordance with applicable regulations, prior to building demolition. Any Person
intending to either abate asbestos - containing materials in any amount greater than the
trigger levels, or demolish a facility shall, on a form supplied by CDPHE, provide a
written notice of the intent to conduct asbestos abatement or demolition. No person shall
commence an abatement project in which the amount of friable asbestos - containing
material exceeds the trigger level in an area of public access without first obtaining a
J permit from CDPHE. Permit fees will be required for asbestos abatement projects.

Non - friable, undamaged ACMs (such as floor tiles, mastics, roofing materials, etc.) are
classified as National Emission Standard for Hazardous Air Pollutants (NESHAP)
Category I, non-friable ACMs by the EPA. In accordance with the NESHAP, as long as
such materials remain in a non - friable state and are not subjected to mechanical drilling,
sanding, abrading, grinding, or sawing during demolition activities, they do not have to be
removed prior to demolition, provided no visible emissions are generated during the
demolition process.
The following recommendations should be followed for demolition projects including
contracting the services of an environmental consultant to monitor /document that the
demolition contractor activities comply with the CDPHE, OSHA, EPA, NESHAP and
applicable local city and county requirements.
• The non - friable ACMs shall not be subjected to abrasion, grinding, sanding or any
other processes during renovation/demolition, which will render these non - friable
materials, friable.
• When demolition by toppling occurs, adequate wetting shall be employed to suppress
the dust and reasonable enclosures for dust emission control (as compatible with the
- 1 building character) shall be employed.
Non - friable ACM debris dislodged during demolition can be disposed off site in a
sanitary landfill that accepts asbestos - containing demolition/construction debris
wastes within the framework of local /state regulations. Please verify with the local
landfills about their policies on accepting such wastes prior to planning the

demolition work.
• Non- friable ACM debris mixed with demolition debris shall neither be used as fill
material on -site nor shall it be sold/given away to others for the same use.

The results, findings, conclusions, and recommendations expressed in the report are based
only on conditions that were noted during the ATC inspection of buildings C & D located
at 442 South Frontage Road East, Vail, Colorado. Buildings A & B were not included in
this survey.
ATC's selection of sample locations and frequency of sampling was based on ATC's
observations and the assumption that like materials in the same area are homogeneous in
content.
The report is designed to aid the building owner, architect, construction manager, general
contractors, and potential asbestos abatement contractors in locating ACM. Under no
circumstances is the report to. be utilized as a bidding document or as a project
specification document since it does not have all the components required to serve as
an Asbestos Project Design document or an Abatement Workplan.

PLM samples were analyzed utilizing the Environmental Protection Agency's Test Method: Method for the Determination
of Asbestos in Building Materials (EPA 600/R-93/116. July, 1993), Reporting Limit <1% Asbestos. Additional treatment
and tests may be required to accurately define composition (i.e. ashing, extractions, acetone treatment, andTEM). Unused
portions of samples are archived for one year unless client reques handling.
Asbestos content of mastic/adhesive is separated from total percent asbestos and other materials.
Laboratory Equipment
Laboratory analysis was accomplished utilizing an Olympus BH-2 polarized light microscope. The microscope is
equipped with dispersion staining lenses.
Ouality Control
A IU Associates, Inc. is accredited by NVLAP Bulk Asbestos Sample Quality Assurance Program (Lab Code 10203 1)
and AIHA (Lab Code 10 1536). ATC participates in the NVLAP and AIHA Bulk Asbestos Sample Quality Assurance
Programs and maintains an in-house QC/QA program for bulk samples whereby 10% of all submitted samples are
reanalyzed and documented in a Quality Control Manual. ATC also participates in a quarterly round robin QC/QA
program for bulk samples with several accredited laboratories throughout the United States. Current and past QC/QA
program results are available in the laboratory for inspection.
