I hadn't heard from you regarding what you'd like to see in addition to the plan Warren and
I discussed, so I'm sending what he asked for.
First, the light fixture that are mounted on each column around the pool: B-K Brick Star. A
cut-off fixture for the purpose of marking the edge of pool. It'll be mounted just below the
column cap. Please let me know if you need more information on these.
Next, Warren asked about the glass wind break, between the column adjacent to the Bridge
and the next column. The contractor says it's a solid glass from Denver Glass, made
specifically for a wind break. It's height is per code. That's not enough to show in
elevation: it'll just be clear. Let me know about this, as well.

Dear Bill,
Thank you for your comments for the Azcarraga residence on Lot l,Block 7,Bighom
Subdivision,Fifth Addition,4768 East Meadow Drive. In an effort to move the project forward,
I've addressed your concerns and provided you with as much detail as currently available. I
trust you'll find this satisfactory for Design Review Board presentation on August 4t''. Should
you have any additional questions or concerns,don't hesitate to contact me at your convenience.
To clarify what's been submitted to the Town and in which sequence,let me briefly summarize
the process to date as I best understand it: At some point last year,at the direction of the
property manager,Mountain Valley Properties,Larry Deckard adjusted the hazard debris flow
line to the inside line of the 20'Drainage Easement limits. This increased the buildable area
substantially on the Forest Service side of the home. At the direction of the Ownef s
representative and General Contractor,Richard Christy of Evenflow Pools,Land Designs by
Ellison submitted plans and details for landscape improvements for the pool area,dated June 8,
2009 for DRB approval and on June 26�for Permit. After a substantial amount of construction
and discussion with the Owners,Richard directed my office to prepare and submit a Landscape
Improvement Plan,dated June 29�of this year to the Town of Vail. This design addressed
additional landscape features and supplemental features to the original submittal by Ellison.
Since my application is now before you,I've made it my responsibility to address your concems
and to explain where the project is from our perspective. Following are those comments from
your email of July 15�:

S 1. The existing deck has been removed and replaced. The original application shows an ;:
' existing Trex-type deck to be modified for new construction. Modification includes �
i �
� converting it to a heated condition. The new construction consists of a heated stone deck �
� around a pool. What was built included removing the Trex decking and replacing it with i
# a stone condition with heat. This was done for a couple of reasons: ;'
i a. It was the recommendation of the plumbing contractor that the Trex would not �'
; be a viable paving material to heat snow efficiently or effectively. What would ;
�
� have resulted would have been a snowy area immediately outside the exterior
� doors to the pool area,followed by a clear area around the pool. Regardless of �
s
how it could be modified,the Trex is not a good material for its intended use;
S b. The Trex decking material was an aesthetic eyesore for the proposed pool area. �
An extension of the stone to the house made for a much more uniform and
; "intended"appearance to the pool area addition. �'

As such,the Trex was removed,the subsoil was compacted,snowmelt was installed and �
an inspection was called for and performed by the Town officials. Because of this �:
acknowledgement by the Town,and that no work was performed covertly,it was �
- generally assumed that the elimination of the Trex was acceptable and that the project

could continue with no additional submittal or conversation. x`

$ 2. The Pool and Pool Deck configuration are not per plan. True,they're not per plan. The �

submitted design shows the pool roughly parallel with the major portion of the home; �
; the existing(constructed)pool and deck consist of a pool thaYs in character with the €
submitted plan,though the pool deck is expanded and clipped to account for the debris �:
; flow line to the West. No improvements intrude on that debris flow line. The expansion ;;
? of the dec�C space is an Owner request and was in response to the elimination of deck s
space to the North: �

+ The pool length and pool deck were shortened because,as presented,the improvements ;
would have rendered the downstairs egress useless,creating a non-compliant and '`
; dangerous condition should an emergency present itself. The notes on the original plan ;
; for this area describe removal of the existing walls that retain soil on either side of the fi
lower level bedroom window and to extend the deck to match the existing. At the time �
� of this design,the exis�ing Trex deck extended as far as the stone wall,just to the South of �'.

proceeded as described,not only would the egress been compromised by an overhead �.

escape-proof chamber,effectively trapping any escapee using that window from the �

i What was decided to do,instead,was to preserve that egress and associated views by �'
� adjusting the length of the pool and surrounding improvements to no further North than
� the south�rn tie wall of that window,a reduction of pool area by approximately 17'. T'he �
Owner's justification,then,was to expand the deck to the west to pick up what was lost �
to the North. This created the situation we have now,where the deck had to be clipped �:
to honor the debris flow line. �

No submittal was made for this adjustment as it was a necessary adjustment for safety of
the dwelling.
3. The Stairs are not constructed per Plan.The stairway leading from the pool area to
grade are not per plan because of functional and aesthetic considerations:
The proposed stairs are located as they are to avoid conflict with the location of the vault
that houses the pool equipment. This vault is subterranean,but has venting at its top and
makes considerable noise. Being as close to the pool area as it is on plan isn't the best
solution;moving it away from spaces used for recreation is best,which is why it came to
be located as far away as it is.
Because the vault was relocated away from the pool the possibility for the stairs to be
moved to the Western side of the deck became a much better solution. Access to the
Volleyball court is more direct;circulation of the pool deck makes more sense;and the
deck area closest to the house is available for the Bridge as it appears on my Landscape
Improvement Plan.
In addition,the proposed location of the vault would have blocked all views from the
lower level Bedroom to the West,a strongly-held direction from the Owner.
No submittals for the relocation of the vault or stair were made to the Town,though the
Town was called for inspection of the vault where it currendy is. Similar to the removal
of the Trex,under item 1,the assumption was that,since this was all done openly,it
would pose no problem with the approval process.
4. The grading is not completed per plan. This is also true,as the configuration of the pool
deck has been adjusted. Associated grading will be installed in the spirit of the
submitted plans.
5. A Fire Pit was installed without permits. The Fire Pit was an added element to the pool
deck after the submittal of the original plans at the request of the Owner. A permit was
pulled for a gas line for the Fire Pit and an inspection was performed by the Town for
that line. The General Contractor was under the impression that the plumbing contractor
had pursued the raised Pit with a final permit,but one was never submitted. Because it
wasn't inspected for final acceptance,the gas feed was not opened and the Pit is not
functioning.
Construction of the Fire Pit doesn't lend itself to cut sheets from any manufacturer:it's a
stone-veneered vault with crushed glass as a flame bed.

6. A Hot Tub was installed without pernuts. Prior to construction,a hot tub was on the �
Trex deck in the exact spot it is currently. The original submittal,as well as the Survey �
should have addressed its existence. The only modification done to it was that it was �
recessed into the stone deck by a foot to make it more user-friendly. �

s 7. The Pool appears to be in use without final inspections. The General Contractor is �'
� scheduled to call for final inspection of the pool late this week at the earliest,or next. �
� 8. Planting. Because the General Contractor was aware that the Owner was thinking of �'
adding landscape elements,the installation of plant material,final grading and �
revegetation were not performed,as they'd be adversely impacted by the construction £

Hey Bill,
I'm sorry about the confusion on everything, and the final inspection on pool it was our insight.Also I was left
with the understanding that American Plumbing had picked up a permit for the fire pit, however he did not.
But he informed me today that he had got all inspections for this prior to deck being poured but not the final.
The fire pit still is not operational to my knowledge,They still have to install the electronic igniter etc..for it to
work, and then they are planning on calling for the final inspection for the pit. We also called for inspections
for all the deck work and bonding for the deck prior to the pour.The hot tub was an existing hot tub they
already had on the deck when we started the project, it is sitting in the exact place we found it we just
lowered into the deck a foot, so I was not aware we needed a permit for an existing hot tub. We finished the
pool around November and as far as my knowledge it still hasn't been used. We have it circulating to keep
clean.The owners are from Mexico and are very difficult to deal with and collect money.They only pay when
they come into town. We waited from November till April to get paid a partial payment on the final for pool
and decks. We still haven't seen payment for any of the landscaping so that is why we have not finished any of
that work. I will call for the final on the pool ASAP.The owners have informed me that they will be arriving this
month to finalize payment, and landscaping payment. In April when they were here they asked us to add more
deck and lighting etc...The changes to the deck layout and wood deck again was my insight, and that is one of
the reasons why I have Ric Fields involved at this point to help with this mistake and the additions from the
owners for another deck area and deck lighting. I sincerely apologize for not getting the changes approved it
was my ignorance that let me believe I didn't need it. I found out afterwards that I did and again that is why
Ric is involved to help. As far as the volleyball court area we were told by the town of Vail to replace the sand
and clean it up.We still are planning on doing this we haven't yet, since we are still planning on using this as a
staging area for materials during the next phase of construction and landscaping. Again I apologize for any
ignorance on my part. Please help me rectify this situation if you can with the promise from me this will never
be an issue again.

Thank you for submitting the proposed light fixture details. I was routed this application on Tuesday, and this �
morning was my first opportunity to visit the site and review the proposed landscape plan changes. The Town f
of Vail Public Works Department is also reviewing this submitted Change to Approved Plans application, and �
their comments will be forwarded to you as soon as that review has been completed. ;

Upon visiting the site, it is apparent that the swimming pool project at 4768 Meadow Drive has not been �
constructed in accordance with the approved plans (609-0153): the existing deck has been removed and �!
replaced, the pool and pool deck configuration are not per plan, the stairs are not constructed per plan, the �
grading is not completed per plan, a fire pit was installed without permits, a hot tub was installed without �
permits, the pool appears to be in use without final inspections, etc. �

I hadn't heard from you regarding what you'd like to see in addition to the plan Warren and
I discussed, so I'm sending what he asked for.
First, the light fixture that are mounted on each column around the pool: B-K Brick
Star. A cut-off fixture for the purpose of marking the edge of pool. It'll be mounted just
below the column cap. Please let me know if you need more information on these.
Next, Warren asked about the glass wind break, between the column adjacent to the Bridge
and the next column. The contractor says it's a solid glass from Denver Glass, made
specifically for a wind break. It's height is per code. That's not enough to show in
elevation: it'll just be clear. Let me know about this, as well.

1. The material sample board was turned in as requested;
2. We will provide our verified calculations of the proposed building heights as measured to existing (natural)
grade for your review and approval next week, well in advance of our submitting for a building permit;
3. We will also submit the Exterior Elevation drawings associated with the basement deduction calculations
for your review and approval next week;
4. The driveway grades do not change from the existing.

Thank you for submitting the proposed light fixture details. I was routed this application on Tuesday, and this
morning was my first opportunity to visit the site and review the proposed landscape plan changes. The Town
of Vail Public Works Department is also reviewing this submitted Change to Approved Plans application, and
their comments will be forwarded to you as soon as that review has been completed.
Upon visiting the site, it is apparent that the swimming pool project at 4768 Meadow Drive has not been
constructed in accordance with the approved plans (609-0153): the existing deck has been removed and
replaced, the pool and pool deck configuration are not per plan, the stairs are not constructed per plan, the
grading is not completed per plan, a fire pit was installed without permits, a hot tub was installed without
permits, the pool appears to be in use without final inspections, etc.
