Planning is going to need to have the required number of EHU deed restrictions in place prior to the phasing of occupancy for any condos or commercial spaces. This is a requirement of the DIA. Condominium plats shall be submitted in ample time to allow for review, approval, and recording. In conjunction with the condominium plat the Condominium Covenants, Conditions and Restrictions shall be submitted for review allowing for activities to occur in the plaza per the DIA. An Operating Covenant Agreement shall be submitted by the applicant review, approval, and recording prior to any TCOs being granted. This requirement is found in the DIA. In general the applicant should review the approved DIA and implement the items required. I list most above, but my list is not inclusive of all the details. The traffic impact fee will need to be paid. Tom Kassmel can address this further. All Public Improvements as contemplated in the DIA nad approved development plan shall be completed prior to any TCO being issued or a bond put in place. Tom Kassmel can address this to a greater extent. I have placed my phased occupancy binder in the SafeBuilt bucket here in ComDev.
