Re: Correction Notice for Cinebistro
Dear Mr. Poye:
Under the Town of Vail Municipal Code, Title 10, Section 10-1-2: B, adopting the 2009 edition of the
International Fire Code (IFC), and in accordance with IFC Section 109.2, Notice of Violation,you are
hereby ordered to repair, abate, correct or take other corrective action on the following items:
1. The fire alarm system is not currently in compliance with NFPA 72 or the plans and specifications for
the project. Replacement of an inadequate strobe in the theater as noted in the letter from BCER dated
June 21,2010. IFC 104.2

2. Re-inspection of the smoke detector in the egress corridor immediately outside the secondary exit from,���
Theater 1 is required. The smoke detector shall be tested and results recorded. IFC 107.1 '��

3. Fire extinguishers shall be mounted per the plans and specifications submitted for the building permit .�
on or before 12 Noon,July 6, 2010. IFC 901
4. Trash and construction debris shall be cleared from the premises by 12 Noon, July 6, 2010. IFC 304.1 �

5. The manual fire alarm pull station at the secondary exit from Theater 3 shall be relocated at the
prescribed height identified on the permit set of plans. IFC 104.2 �tiL
6. The bulkhead at the top of the stairs to the mezzanine shall be installed on or before 12 Noon,July 6,
2010. IFC 10'7.1
7. Emergency lighting shall be tested to confirm compliance with plans and specifications as identified on
the building permit and IFC Section 1006.3— 1006.4. Third party inspection by an approved special
inspector and certification of compliance is required. A record of readings with appropriate light meter(s)

8. Theater lighting under a fire alarm condition shall be demonstrated on re-inspection. Third party
inspection by an approved special inspector and certification of compliance is required. A record of
readings with appropriate light meter(s) is required. A second test shall be performed during a simulated
primary power failure mode. IFC 1006

9. Clear and unobstructed pedestrian egress shall be provided per the record set of plans for emergency
egress issued for the Solaris building permit. IFC 1004.8
10. An Emergency Plan per IFC Chapter 4 shall be developed by the operator and submitted for review by
the Fire Department. Approval of the plan is required prior to any occupancy by theater or restaurant
employees or the general public.
Pursuant to IFC Section 109.3.1,Abatement of Violation, occupancy of the CineBistro is hereby restricted
to persons directly involved with correcting the foregoing cited violations and completion of work not yet
finished but authorized undear the building permit. Employee training is not permitted until emergency
lighting and �re alarm issues have been repaired and re-inspected.
Unless otherwise stated herein, compliance is required on or before 12 Noon,July 9, 2010.
