Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. The Town of Vail asbestos abatement program is in addition to the State of Colorado's regu-
lations. It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements
at the contact info listed below.
When is asbestos testing required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:_
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units,and fractional fee units. -
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified and Vail-registered abate-
ment contractor. An asbestos abatement permit must be approved, and the clearance letter must be submitted to the
Town of Vail before the building permit will be issued.
Project Checklist

Tips&Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of any age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA.Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

INTRODUCTION:
On February 19th, 2010 an inspection/survey was conducted and 5
bulk samples were collected from:
Eagle Point
1500 Matterhorn Circle
Units: 201, 205, 207, 210, and 211
Vail, CO.

The purpose of the inspection/survey was to locate and sample
suspected Asbestos containing materials that might be present in the above
units that are planned for renovation.
The inspection was made, and the samples were collected by John R.
Peterman, an A.H.E.RA. and State of Colorado Certified Asbestos
Inspector. Great care was taken during the inspection and sampling to be as
accurate as possible. It should be noted that minimal damage was done to
the existing building structures during the inspection so there is no
documentation for unseen conditions or stored items_
All samples were analyzed by DCM Science Lab in Wheatridge, CO.
This laboratory is deemed "Proficient" in the E.P.A.Quality Assurance (QA)
program for the determination of asbestos in bulk materials, and is
accredited by the American Hygiene Association (AHA).
SAMPLING PROTOCOL:
A random sampling scheme was used to sample the suspect materials that
were discovered. If during any future demolition or renovation work,
suspect material is discovered that hasn't been sampled and would be
disturbed, work should be halted until the material has been tested.

UNIT DESCRIPTIONS:
The Eagle Point is a multi-unit condo complex that is planned for selective
renovation in several units. The units to be renovated are homogeneous in
construction. Random units were selected from the designated units for
testing purposes. The interior walls are covered in sheetrock with a heavy
texture, and the ceilings in the renovation areas are covered in sheetrock like
the walls, and spray-on acoustic texture. The floors are covered in carpet,
and in ceramic tiles. This is the third set of testing that has been done at
Eagle Point. The previous two reports are dated 6/29/07 and 8/21/09.

CONCLUSIONS & RECOMMENDATIONS:
Laboratory analysis, of the composite sheetrock samples, indicates that
Asbestos was detected in two out of the six bulk samples taken. However,
the Asbestos content, of the positive samples, is less than the Regulatory
Limit (Greater than I%Asbestos). The Asbestos content was verified by the
required Point Count Analysis.
