Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. The Town of Vail asbestos abatement program is in addition to the State of Colorado's regu-
lations. It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements
at the contact info listed below.
When is asbestos testing required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others(commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling:any dwelling unit that is used primarily for a single family, including
multi-family/condominium units,and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified and Vail-registered abate-
ment contractor. An asbestos abatement permit must be approved, and the clearance letter must be submitted to the
Town of Vail before the building permit will be issued.

• The"1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

Dear Vail Fire Department,
In preparation for renovations of the kitchens and baths at Eagle Point Resort, asbestos sampling and testing were
begun in June of 2007 for the units being renovated. In all, 25 units have been sampled and tested, and in only one of
those units,#104 a single sample was found (out of six) to be in excess of the regulatory limit.
That one sample was taken from the ceiling of the 2"d bedroom closet,for which the surface area (12 sq. ft.) is less than
the reporting requirement of a surface area of 32 sq. ft.
During the sampling of the closet ceiling the integrity of the ceiling texture was noted to be in good condition. In
addition,the sampling showed that the color of the closet ceiling was pink and not white as with the other ceilings in the
unit. This suggests that this closet ceiling may have been repaired or modified at one point.
Four more ceiling samples were then tested in unit 104 near the kitchen and bath areas to determine the extent of
asbestos in the ceiling and/or isolate the area containing an excess of regulatory limits relative to the area being
remodeled in the unit. All of the four samples were under the regulatory limit. The positive sample is not typical of the
asbestos testing results found in the remainder of the complex.
At no point in the renovations of the kitchen and baths will the 2"d bedroom closet be disturbed and no acoustic
(popcorn)ceiling in the unit will be disturbed in the process. During the remodel the disturbance of drywall is limited to:
a. The drywall behind the ceramic tile in the bathrooms .
b. Minor 2"x 4" holes cut in the kitchen walls (qty 2-4)to run electrical wires
To ensure that the integrity of the closet ceiling is maintained, the closet doors will be sealed with 4 mil plastic sheeting
and "Do Not Enter" placards placed on the sheeting.

INTRODUCTION:
On March 26th, 2010 an inspection/survey was conducted and 4 bulk
samples were collected from:
Eagle Point -

Unit#104
Vail, CO.
The purpose of the inspection/survey was to locate and sample
suspected Asbestos containing materials that might be present in the above
units that is planned for renovation.
The inspection was made, and the samples were collected by John R.
Peterman, an A.H.E.R.A. and State of Colorado Certified Asbestos
Inspector. Great care was taken during the inspection and sampling to be as
accurate as possible. It should be noted that minimal damage was done to
the existing building structures during the inspection so there is no
documentation for unseen conditions or stored items.
All samples were analyzed by DCM Science Lab in Wheatridge, CO.
This laboratory is deemed "Proficient" in the E.P.A.Quality Assurance (QA)
program for the determination of asbestos in bulk materials, and is
accredited by the American Hygiene Association (AHA).
SAMPLING PROTOCOL:
A random sampling scheme was used to sample the suspect materials that
were discovered_ If during any future demolition or renovation work,
suspect material is discovered that hasn't been sampled and would be
idisturbed, work should be halted until the material has been tested.

UNIT DESCRIPTION:
Unit #104 was first tested on February 19th, 2010 and one out of two
samples of the spray-on ceiling texture was found to contain Asbestos in
excess of the Regulatory Limit. At the request of the client, additional
samples were collected from the renovation area ceilings. The purpose of
this testing was to try and isolate the areas that contain Asbestos from the
areas that do not contain Asbestos.
CONCLUSIONS & RECOMMENDATIONS:
Laboratory analysis of the spray-on ceiling texture samples indicate that
Asbestos was detected in two out of four bulk samples. However, the
Asbestos content of the positive samples is less than the Regulatory Limit
(Greater than I% Asbestos). The Asbestos content was verified by the
required Point Count Analysis. Two samples collected previously from this
unit showed no Asbestos detected and one sample in a back closet contained
Asbestos in excess of the Regulatory Limit. This sample is of different
composition than the other five samples collected in this unit. 'fie area of`
the positive sample will not be disturbed during the renovation work. The
five samples that are negative or less than the Regulatory Limit were
collected from the areas that will be disturbed by the renovation process.

UNIT DESCRIPTION:
The Eagle Point is a multi-unit condo complex that is planned for selective
renovation. The unit to be renovated is homogeneous in construction. The
interior walls are covered in sheetrock with a heavy texture, and the ceilings
in the renovation areas are covered in sheetrock like the walls, and spray-on
acoustic texture. The floors are covered in carpet, and in ceramic tiles. This
is the third set of testing that has been done at Eagle Point. The previous
two reports are dated 6/29/07 and 8/21/09.
CONCLUSIONS & RECOMMENDATIONS:
Laboratory analysis indicates that one out of two bulk samples, of the spray-
on ceiling texture, Room #104, contains Asbestos that is in excess of the
Regulatory Limit. The other contains no Asbestos. Additional samples may
be required to try to isolate the Asbestos containing areas of ceiling texture.

BULK SAMPLE ANALYSIS PROCEDURES: Page 3 of
DCM Science Laboratory, Inc. analyzes bulk asbestos samples following procedures developed by the
McCrone Research Institute and in compliance with guidelines established by the Environmental Protection
Agency(EPA-600/R-93/116, July, 1993).
Bulk samples are prepared for analysis using a 1 OX-80X stereo microscope in a hepa filter hood which provides
a contamination-free environment. The sample is then analyzed by polarized light microscopy(PLM)at 100X.
When the sample consists of more than one layer, each layer is prepared and analyzed separately. Fiber and
matrix materials are identified by the characterization of optical properties including color and pleochroism,
form, cleavage, relief, birefringence, extinction, orientation, twinning, interference figure and other distinguishing
features. Dispersion staining is also used to further aid in mineral identification. All percentages of asbestos,
other fibers and non-fibrous constituents are calculated from the values obtained from analyses using the
stereo and PLM microscopes. In-house and NIST standards as well:as a chart prepared by R.D. Terry and
G.V. Chilinger for"The Journal of Sedimentary Petrology", (Volume 24, pp. 229-234, 1955) provide a guide for
estimating percentages. All samples are archived for six months unless other arrangements are made by the
client.
