Thanks again for the conversation we had earlier. After reviewing of the cit�s debris flow map it is my opinion that the
new concrete pad does not infringe on the debris zone. Please refer to the image below to see the flow map overlaid on a
satellite view of the area in question with a small red star indicating the location of the proposed pad. Also, I have placed a
call into the company that created the siteplan drawing and they mentioned that the "Edge of Runout Zone" shown on
their drawing inaccurately represents what is out there today and suggested erasing it from the drawing.
I believe this resolves this issue, but please let me know if there are any other measures to take and feel free to contact me
via email or phone.

Per our telephone conversation regarding my request for approval of a hot tub at unit 1801, Timber Falls, I am attaching a
page from the manufacturer containing specifications and photographs.
The dimensions on the hot tub are 82" X 82". We request approval to place it next to the building, adjacent to our deck, in
a space that has just under 6' of length to the building's edge. Therefore, the hot tub will extend slightly less than 2 feet
beyond the building's edge. This is the only location that was approved by the other homeowners in the building. The
owners of the unit above ours have the identical wood deck that we have, and they don't want the hot tub in a location
further to the east, as they feel this would put it more or less under the main portion of their deck and would intrude into
their privacy. They are agreeable to the hot tub being at the west end of the deck, however.
You discussed with me yesterday the concern that the hot tub would extend partially into a debris zone. I recognize that
the site plan shows the edge of a"runout zone" that abuts building 18, and our hot tub would extend just under two feet
beyond the west edge of the building, and cross into the runout zone. However, based on the actual topography of the
site, the runout zone does not really abut our building as depicted in the site plan. I don't know when the runout zone was
designated, or what the state of construction was at that time, but the current site layout has a substantial depression
approximately 30-40 feet to the west of our building which would be the actual run out zone from the hillside. Between
that depression and our building is a high earthen berm with a dirt road on top of it that is used for maintenance vehicle
access to the tennis courts, swimming pool and pool building that are to the north of our building, and which also appear
to be in the runout zone, although my site plan does not extend that far.
Our building, and the location of the hot tub, are substantially higher than the depression that serves as the runout zone
and are separated from it by the berm and road. I am not in Vail right now so I can't take pictures and obtain precise
measurements of these features, but I would be happy to do so this weekend, if necessary.
For the above reasons, I request that the DRB approve the request for a hot tub in the location shown in my
application. The cost of the hot tub and its installation, along with the $250 application fee and whatever building permit
fees might be involved, are already pretty much stretching my family's budget for this project. If we have to incur
significant additiional costs in terms of geological or engineering studies, it would probably make the hot tub infeasible to
us.

Quick note: Section i2-2-2 of the Town Code defines what a structure is and states the following:
STRUCTURE: Anything constructed or erected with a fixed location on the ground, but not including poles,
lines, cables, or other transmission or distribution facilities of public utilities, or mailboxes or light fixtures. At
the discretion of the design review board, swimming pools and tennis courts may be exempted from this
definition.
It's just a start, but a relevant one none the less.

I am submitting the following in support of my request for authorization to install a hot tube on a cement slab next to my ground level
condominium which is unit 1801 in the Timber Falls development in East Vail:
1. Application for Design Review - Minor Exterior Alteration, signed by myself and my wife, Carole;
2. Site Plan, showing location of the hot tub;
3. Drawing showing the hot tub and the building in a closer view than the site plan;
4. Joint Property Owner Written Approval Letter, signed by Karl Edgerton, the HOA's authority (property manager).
The original of the application, along with the other documents, will be sent by mail to the attention of Shelley Bellm. I understand
that Karl Edgerton will either mail or hand deliver the original of his signed approval letter to you early this week.
I am emailing these documents today, in the hope that my request can be considered at the October 6 meeting of the Design Review
Board.
I understand that there is a$250 application fee. I can pay that by credit card, if you will advise me whom to contact.
