Orion Environmental, Inc. warrants that the findings contained herein have been with
the level of care and skill exercised by experienced and knowledgeable environmental
consultants who are licensed or otherwise trained to perform asbestos inspections
pursuant to the scope of work required on this project.
On September 13, 2005, at the request of Client 05.274, Orion Environmental, Inc.
(OEI) initiated an asbestos inspection of suspect asbestos containing building
materials at 5197 Blackgore Drive Unit A-7 in Vail, Colorado. The purpose of this
inspection was to test suspect asbestos containing material (ACM) that may exist at the
property as part of a real estate transaction.
Mr. Shawn R. Lopez, an OEI asbestos building inspector arrived at the subject property
at approximately 8:OOpm. Mr. Lopez entered the property with a key that was located

in a lockbox on the door. Client 05.274 provided Mr. Lopez with the combination to
the lock box.
The property is one unit of a multi unit residential structure. The date of construction
was unknown to the inspector. The interior walls are wood framed finished with
gypsum board wall coverings. Ceilings consist of unfinished tongue and groove
paneling. The floors of the unit are finished and unfinished wood and decorative tile.
The unfinished wood floors are obscured by carpet and a fibrous sheathing used to
raise the height of the floors. The unit consists of a main floor and a second level loft.
There is a fireplace in the living area of the unit that did not have suspect ACM brick,
caulking, or refractory material. The ceiling of the unit is insulated with foam panels.
At the conclusion of the inspection, Mr. Lopez contacted Client 05.274 to inform him
that the inspection was complete, assured that all lights were off, the entry door was
secure, and the key was placed inside the lockbox, and the lockbox was checked to
assure it was locked.
The Environmental Protection Agency (EPA), Occupational Safety and Health
Administration (OSHA), and State of Colorado Regulations require abatement of ACM
materials prior to initiating renovation or demolition activities that may disturb those
materials by removal, encapsulation, or enclosure.
Bulk samples were collected by OEI of all suspect ACM's that may exist in the subject
unit. The asbestos inspection was conducted in general compliance with the
guidelines of the Environmental Protection Agency (EPA) National Emissions Standards
for Hazardous Air Pollutants (NESHAPS), the Asbestos Hazard Emergency Response
Act (AHERA) and the Occupational Safety and Health Administration (OSHA)
1926.1101. The EPA recognizes material that contains greater than one-percent
asbestos to be regulated asbestos containing material (ACM). Six (6) samples of
suspect ACM were obtained by OEI for analysis on September 13, 2005. Bulk
samples were given unique alphanumeric identification numbers, consisting of three
parts and labeled according to EPA regulations. The first letter "B" designates the
sample as a bulk asbestos sample. The first set of numbers "05.274" identifies the
OEI project number. The second group of numbers represents the sequential sample
acquired for a project. A description of each bulk sample and the sample location
has been included in Appendix A.
Bulk asbestos samples were randomly collected from homogenous areas of suspect
ACM's by Shawn R. Lopez, an EPA/State of Colorado certified asbestos inspector. All
b�lk samples were submitted to Reservoirs Environmental, Inc, (RESI) a third party
independent laboratory located at 2059 Bryant St. in Denver, CO. RESI is accredited
through the National Institute of Standards and Technology (NIST) and participates in
the NIST National Voluntary Lab Accreditation Program (NVLAP) as required by EPA.

Bulk samples were analyzed by Polarized Light Microscopy (PLM) in general
compliance with guidelines established by the US EPA (40 CFR Part 763, Subpart F,
Appendix A). Asbestos concentrations were visually estimated and/or point counted or
analyzed by composite when applicable and reported in percent for each layer of the
sample. Laboratory results can be found in Appendix A.
This report includes the description and location of materials tested and laboratory
analysis results of all acquired bulk samples.
1.1 Project Objective
OEI understands this asbestos survey was requested as part of a real estate
transaction. EPA regulation 40 CFR 61, Subpart M, National Emissions Standard for
Hazardous Air Pollutants (NESHAP), prohibits the release of asbestos fibers into the
atmosphere during renovation or demolition activities. The Asbestos NESHAP rule
requires that suspect regulated asbestos-containing building materials be identified,
classified and quantified prior to planned disturbances, renovation, or demolition
activities.
2.0 Asbestos Field Activities
The survey was conducted by Mr. Shawn R. Lopez, an EPA/AHERA accredited and
State of Colorado certified Asbestos Inspector/Management Planner. The survey was
conducted in genera) conformance with the protocols established by EPA regulation
40 CFR 763, the Asbestos Hazard Emergency Response ACT (AHERA) and State of
Colorado Regulation No.8, Control of Hazardous Air Pollutants, Colorado Air Quality
Control Commission, Section III, Part 6. A summary of survey activities is provided
below.
2.1 Visual Assessment
Floor plans were not provided to OEI preceding the survey. Survey activities began
with visual observation of the sampling site of the interior of the unit to identify
homogenous areas of suspect ACM. A homogenous area consists of building
materials, which appear similar throughout in terms of color, texture and date of
application. Building materials which were not identified as concrete, glass, wood,
masonry, metal or rubber are considered suspect ACM.
2.2 Physical Assessment
A physical assessment of homogenous areas of observed suspect ACM was conducted
to assess the friability and condition of the materials. The EPA defines a friable
material as a material, which can be crumbled, pulverized or reduced to powder by

Based on results of the visual observation, bulk samples of suspect ACM were
collected in general conformance with AHERA protocols. Random samples of suspect
materials were collected in each homogenous area by superimposing a transparent
nine-cell grid over each homogenous area. A calculator with the capability of
generating random numbers between 0-9 was used to determine sample locations.
Accredited building inspectors collected bulk samples using methods as applicable to
reduce the potential for fiber release. Samples were placed in seal able containers
and labeled with unique identification numbers. In some circumstances a material
that seems to be homogenous may yield conflicting laboratory results. A return trip to
identify actual homogenous sampling areas may be necessary.

EPA, OSHA, and The State of Colorado regulate any materials that contain greater
than 1 % asbestos.
The EPA National Emissions Standard for Hazardous Air Pollutants (NESHAP)
regulation requires that ACMs be identified prior to demolition and renovation
activities. NESHAP requires that no friable ACMs be disturbed during these
construction activities by removal, encapsulation, or enclosure.
The Colorado Deparfment of Public Health and Environment (CDPHE), Regulation
No. 8, Part B, requires an asbestos inspection following the AHERA protocol be
conducted prior to demolition or remodeling activities that could disturb greater than
160 square feet, 260 linear feet, or the equivalence of a 55 gallon drum of a suspect
ACM.
The October 1 1, 1994, revision to the OSHA Standard requires that suspect ACM in
buildings built prior to 1981 be assumed to be asbestos or an inspection be
conducted by an EPA accredited asbestos building inspector.
In some circumstances, point count analysis is required for bulk samples. Point
counting is a more detailed means of analysis than standard PLM. Federal and State
agencies define ACM as materials containing greater than one percent asbestos. The
NESHAP regulation requires that if standard PLM analysis determines that a sample
contains less than 10% asbestos, the material must be considered asbestos containing
or be point counted. Even if the sample is less than one percent by standard PLM, the
material either has to be assumed to be ACM or point counted. If the point counting
analysis is different than the PLM analysis, the point counting result takes precedence.
If standard PLM analysis determines that a material has no asbestos or that the
material contains greater than 10% asbestos, point counting is not necessary.
The asbestos NESHAP rule (40 CFR Part 61, Subpart M) regulates asbestos fiber
emissions and asbestos waste disposal practices. It also requires the identification and
classification of existing building materials prior to demolition or renovation activities.
Under NESHAP, asbestos containing building materials are classified as either friable,
Category I non-friable, or Category II non-friable ACM. Friable asbestos-containing
materials are any material containing greater than one percent asbestos and that
when dry, can be crumbled, pulverized, or reduced to powder by hand pressure.
Category I non-friable ACM included gaskets, packings, resilient floor coverings, and
asphalt roofing products containing greater than one percent asbestos. Category II
non-friable ACM are any materials other than Category I materials that contain
greater than one percent asbestos.

Friable ACM, Category I and Category II non-friable ACM which is in poor condition
and has become friable or which will be subject to drilling, sanding, grinding, cutting
or abrading and which could be crushed or pulverized during anticipated renovation
or demolition activities are considered regulated ACM (RACM). RACM must be
removed prior to renovation or demolition activities. If the amount of RACM is more
than 260 linear feet, 160 square feet, or will generate more than one cubic meter of
waste, the owner or operator must provide the State of Colorado with written
notification of planned removal activities at least 10 working days prior to the
commencement of asbestos abatement activities. An appropriately accredited and
licensed asbestos abatement contractor must conduct removal of RACM.
The Occupational Safety and Health Administration (OSHA) Asbestos Standard for the
construction industry (29 CFR 1926.1 1 Ol ) regulates workplace exposure to asbestos.
The OSHA standard requires that employee exposure to airborne asbestos fibers be
maintained below 0.1 fibers per cubic centimeter (0.1 f/cc). The OSHA standard
classifies construction and maintenance activities, which could disturb ACM, and
specifies work practices and precautions which employers must follow when engaging
in each class of regulated work. States, which administer their own federally approved
state OSHA programs, may require other precautions.

5.0 ACM MATERIAL BY LOCATION
l. Approximately 4,200 sq. ft. of drywall joint compounds exist throughout the
unit. 3% chrysotile asbestos.
The material was in a good undamaged state at the time of this inspection. The
material is currently encapsulated with paint and other wall coverings.
The appropriate response for this material is to maintain the material in its current
condition, or properly abate the material prior to initiating renovation or demolition
activities. Asbestos abatement should be performed by a State of Colorado licensed
Asbestos Abatement Contractor. All asbestos waste shall be properly disposed of at
an EPA approved landfill.
6.0 Material tested and verified non-ACM
Fibrous floor board obscured by carpet throughout the Unit.
7.0 Conclusions and recommendations
Orion Environmental, Inc. makes the following conclusions and recommendations:
• The Building Owner shall assure that no asbestos containing materials are
disturbed during renovation or demolition of the buildings.
• All asbestos containing material identified should be maintained in its current
condition or properly removed and disposed of by a licensed asbestos abatement
contractor prior to renovation or demolition activities.
• Contact OEI to develop the project design/scope of work/Project Management for
the abatement project and to provide visual inspection/final clearance testing post
abatement.
• Contact OEI to procure bids to complete the abatement work.
• If suspect ACM is discovered and the materials were not discussed in this report,
such material shall not be disturbed until tested and verified to be non-ACM.
8.0 LIMITATIONS
This report was prepared by Orion Environmental, Inc. at the request of and for the
sole benefit of Client 05.274, or any entity controlling, controlled by, or under
common contro) with Client 05.274. This report addresses certain physical
characteristics of the Site with regards to the presence of visible or non-visible asbestos
containing materials. The material in this report reflects the best judgment of Orion
Environmental, Inc. in light of the information that was readily available at the time of
preparation.
