Dear Wendy,
I hope this letter finds everyone well for the upcoming fall off season in Vail.
This letter is to confirm my conversation with Stephan Nicolas, General Manager
at The Lodge of Vail, on April 21, 2010, as well as my conversation with you on
September 1, 2010.
My concerns expressed to both of you were the same; we wish and hope the new
Sushi bar, Yama, next to Roxy will be very successful. I believe Yama can be
very positive for the Lodge and for our area of Gore Creek Drive. But at the same
time, I have expressed to both of you, as well as the developer, Charles Viola, that
if there any type of odors coming from Yama and entering Roxy in any manner, I
will find that totally unacceptable, and would expect not only you, but also the
management at the Lodge as well as the Board of Managers to get immediately
involved, acting not only in behalf of Roxy, but also anyone else affected by the
situation. I have been a tenant and an owner for almost twenty years, with Roxy
being there for that same period, and we can not have odors (or for that matter
excessive noise) affect our business. Roxy has already lost business during the
construction process, which we have endured since March of 2010, but going
forward with the finished product, we will not.
