Dear Eric,
I am writing to inform you that I have staff denied the application for stairs off an existing patio at the
Rabin Residence, located at Booth Falls Mountain Homes #2. The application was denied because
the stairs are built into a required setback and thus, are in violation of Section 14-10-4, Architectural
Projections, Decks, Balconies, Steps, Bay Windows, Etc, Vail Town Code. Section 14-10-4B
specifically states that “steps that form an exit discharge may project into a required setback area to
the degree necessary to conform with the adopted building code's means of egress standards, at the
discretion of the administrator.” As an administrator of Title 14, Development Standards, Vail Town
Code, I have determined that the stairs are not necessary to conform with the Town of Vail’s adopted
building code, and thus, are not permitted in the setback.
The stairs must be removed immediately with the following conditions:
1. The stairs shall be removed by November 1, 2010.
2. All grade changes must be returned to previous conditions by November 1, 2010.
3. All disturbed areas shall be revegetated and stabilized by November 1, 2010. Should
vegetation not show growth by May 1, 2011, the applicant shall revegetate this area again
until growth occurs.
