Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. The Town of Vail asbestos abatement program is in addition to the State of Colorado's regu-
lations. It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements
at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 30 square feet
All Others: 160 square feet
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified and Vail-registered abate-
ment contractor. An asbestos abatement permit must be approved, and the clearance letter must be submitted to the
Town of Vail before the building permit will be issued

Tips& Facts:
• Even recent construction projects may include asbestos-containing materials, so b�ildings of a�age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

Air Monitoring Description•
Phase Con provided final clearance air monitoring services at the
project site listed above on October 18, 2010. Air samples were
situated inside the enclosure so as to be representaCive of the entire
work space. Air sampies were obtained utilized aggressive sampling
methods to aid in ensuring that any fibrous material left in the
enclosure would be entrained in the air during the sampling period.
Abatement Description•
Abatement of ACM wallboard texture from select areas of the living
room, dining room, kitchen and entry loft. ACM texture may stili be
present in other areas of the unit which were outside of the scope of
work.
Comments and Recommendations•
PCM analysis of the final clearance air samples revealed airborne ffber
levels inside the containment area(s) to be tess than the Colorado
State Maximum Allowable Asbestos Leve! (MAAL) and the EPA
ciearance levei of 0.010 fibers per cubic centimeter of alr; therefore,
the area(s) may be re-occupied under non-abatement conditions.

Customer recognizes aad acknowledges that the product or materials supplied by PWD are cusiom in nature and there is no ready market or vafue other than for the job for which the materials
are manufactured and/or supplisd_ If Cusiomer ai any time fails to pay PWD for the materials supplied,PWD may,at iYs option,suspend all deliveries or terminate the Contract with the
Cusiomer.Such suspension or termination DOES NOT excuse payment for those materials and products already manufactured at the fufl contract price or payment for any component parts
already purchased and obtained by PWD.
Title
Title,ownership and the right to possession of the product or materials furnished or to be furnished by PWD shall remain in PWD until PWD is paid in full. PWD shall have a right to possession
of the product or materials but is not obligated to repossess the materials in the event of non-payment.PWD's righ#to repossess materials is in addition to,and not a limitation upon or a waiver
of PWD's other legal rights including the right to place mechanic's liens against the real property for which materials were suppfied.All risk of loss or damage shall pass to the Customer upon

damage,vandalism or any other loss to the product or materials.Any insurance proceeds woufd be paid over to PWD for the full amount owed to PWD in t he event of any loss.
Dispute Resoluiion.
Direct piscussior,. If a dispute arises out of or relaies to this Agreement,the parties shall endeavor to settle the dispute through direct discussion_

Mediation. Disputes not resolved by direct discussion shall be submitted to mediation pursuant to the Construction Indusiry Mediation Rules of the American Arbitration Association. 7he
parties shall select the mediator within fifteen{15)days of the request for mediation. Engaging in mediation is a condition precedent to any form of binding dispute resolution. This provislon
shall�oi act to delay Supplier filing a mechanEc's lien foreclosure action. The cost of any mediation proceeding shall be shared equally by the parties participaUng.
