Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. The Town of Vail asbestos abatement program is in addition to the State of Colorado's regu-
lations. It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements
at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 30 square feet
All Others: 160 square feet
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified and Vail-registered abate-
ment contractor. An asbestos abatement permit must be approved, and the clearance letter must be submitted to the
Town of Vail before the building permit will be issued

Tips&Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of a�age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take efFect." - CDPHE

SECTION 1
INTRODUCTION
Family Environmental Compliance Services, Inc. (Family Environmental) was contracted
by King Soopers, P.O. Box 5567 Denver, Colorado to perform an asbestos inspection, of
the employee residential units at the City Market Store #442 located at 2109 North
Frontage Road West Vail, CO 81657. The physical inspection was for the 2101 North
Frontage Road West apartment units A-F Vail, CO 81657. The inspection was carried out
on June 11, 2010.
The apartments are built above the City Market at 2109 North Frontage Road West Vail,
CO 81657. The apartments were built in 1997 using wood frame construction. Six
apartment units were inspected, two 2 bedroom apartments and four 1 bedroom
apartments. The purpose of this asbestos inspection was to document the specific
building materials that may contain asbestos prior to any repairs or renovations.
SECTION 2
ASBESTOS INSPECTION
This asbestos inspection was conducted according to the United States Environmental
Protection Agency (EPA)procedures published in 40 Code of Federal Regulations (CFR)
Part 763, Subpart E—Asbestos-containing Materials in Schools. These inspection
protocols specify requirements for the inspector(Section 763.85), laboratory(Section
763.87), and number of samples collected during an inspection (Section 763.86).
Appendix A contains a copy of the certification of the inspector that surveyed store #13.
This inspection involved identification and sampling of all affected suspect asbestos
containing material (ACM) in all accessible areas located throughout the apartments.
The City Market Store #442 was not involved during this inspection. The scope of this
asbestos inspection was limited to materials that would be disturbed during mold
remediation. Suspected materials include everything besides wood, ceramic, carpet, glass,
metal and vinyl. Sampling procedures were performed in accordance with AHERA
protocols. Random samples of suspect materials were collected in each homogeneous
area. An appropriately attired inspector collected all bulk samples using wet methods, as
applicable to reduce the potential for fiber release. Samples were placed in sealable
containers and labeled with unique sample numbers using an indelible marker.
2.1 ASBESTOS CONTAINING MATERIALS
ACM is defined as any material containing greater than 1% asbestos. All sample testing
is required to be performed by an accredited laboratory. ACM is categorized as either
non-friable or friable asbestos. Non-friable asbestos is any material that cannot be
crumbled, pulverized or reduced to a powder by hand pressure when dry. Friable
asbestos can be crumbled, pulverized, or reduced to a powder by hand pressure when dry.
The EPA and the Occupational Safety and Health Administration (OSHA) maintain a
comprehensive list of suspect ACM frequently found during inspections. Family
Environmental identified several of these suspect materials in the building. Appendix B
contains a table that lists the type of materials sampled as well as the laboratory results.
2.2 SUSPECT ASBESTOS CONTAINING MATERIALS
Certain building materials are commonly known to have asbestos levels greater than 1%
so are therefore considered suspect ACM. The following suspect friable materials were
observed during the inspection:

The following suspect non-friable materials were observed during the inspection:
• Tape Joint Compound
• Carpet Adhesive
• Cove-Base/Glue
• Insulation
2.3 ASBESTOS CONTAINING MATERIALS
No asbestos containing materials were identified from the samples taken at
Apartments A-F 2101 North Frontage Road West Vail, CO 81657. Many of the
materials sampled and identified as suspect ACM were homogenous throughout the
apartments. A homogeneous area is defined as any area in which materials appear to be
similar throughout in terms of colar, texture, and date of application. Samples were
collected from each homogenous area. I
2.4 RECOMMENDATIONS
Bulk samples were submitted under chain of custody procedures to River North
Environmental Testing (RNET) of Denver, Colorado, for analysis by polarized light
microscopy(PLM) with dispersion staining techniques per EPA methodology(40 CFR
763, Subpart F). PLM visual estimation was used in obtaining the percentage of asbestos
in bulk samples. RNET is accredited under the National Voluntary Laboratory
Accreditation Program NVLAP (200448-0). Appendix C contains these analytical
results.
There are no U.S. EPA or OSHA regulations mandating the removal of asbestos
containing material (ACM) from occupied commercial or residential buildings unless the
ACM becomes impacted by renovation or demolition activities. A certified abatement
contractor must abate asbestos containing building materials (ACBM) before any
renovation or demolition activities affecting and/or disturbing this material can take
place.
Family Environmental did not identify any asbestos containing building materials within
the store. Since no ACM was detected in the samples taken, no further action is required
regarding the disturbance of building materials during repair or remodeling.
Family Environmental recommends that you please work safely and if you encounter any
other suspect building materials not listed in this report, then please contact Family
Environmental for additional sampling.
* This was not a complete inspection of the building. If any further renovation to the
interior/exterior or complete demolition should occur, the materials to be affected
by the work should be inspected by a Colorado State certified building inspector.
2.5 GENERAL COMMENTS
This asbestos survey was conducted in a manner consistent with the level of care and
skill ordinarily exercised by members of the profession currently practicing under similar
conditions in the same locale. The results, findings, expressed in this report are based on
conditions observed during our inspection of the building. The information contained in
this report is relevant to the date on which this inspection was performed, and should not
be relied upon to represent conditions at a later date. This report has been prepared on
behalf of and exclusively for use by King Soopers. Contractors or consultants reviewing
this report must draw their own conclusions regarding the existence or potential existence

CONCLUSION
Family Environmental has performed this asbestos inspection for the properties located at
2101 North Frontage Road West Apartments A-F Vail, CO 81657. Testing confirmed
the absence of ACM at locations sampled. Since all samples taken tested negative for
ACM there is no further action required regarding repair or renovation activities.
