RE: Loading and Delivery Issues at the Sebastian Hotel, 16 Vail Road/ Parts of Lots O and M, Block 5D, Vail Village Filing 1
Dear Mr. Oprish,
It has come to my attention that there may be an issue we need to discuss with your current loading and delivery operations at the Sebastian Hotel. According to the approved development
plan for the Sebastian Hotel, the project was designed to accommodate truck turnaround maneuvers on site. I was informed that trucks have been backing in and/or backing out of the Sebastian
Hotel loading docks and onto the South Frontage Road. This may be due to use of loading docks for material storage and vehicle parking, or delivery by trucks larger than permitted by
the approved development plan.
As a result, you may be in violation of the following sections of the Vail Town Code:
Section 12-10-9B, Size: (in part) Adequate turning and maneuvering space shall be provided within the lot lines. At the planning and environmental commission's discretion, variations
to the minimum loading berth dimension standards outlined above may be approved or required, subject to the planning and environmental commission finding that such variation is necessary
to prevent negative impacts to the public right of way.
Section 14-5-2I, Backing into the Street/Right of Way: All parking for commercial and multiple-family developments shall be designed to allow a vehicle forward access to any street or
right of way.
Please contact me within ten days of receipt of this letter to discuss next steps for resolution of this potential violation. I look forward to working with you to resolve this issue.
