Charley Viola's Original Concerns listed in e-mail correspondence on September 28, 2009: 1. Agreement that can be recorded that states that no change to our garage access will be made without our approval. 2. Agreement that we are not liable for any expenses related to parking lot maintenance or upkeep. 3. Ability to add a sign directing to the LACA garage. 4. Agreement that no vehicles will be parked in the new access to the LACA garage. I view this as important as the valets may be tempted to park cars in this lane when they are busy. The Chalets at the Lodge at Vail, LLC.: 1. Based on the approved plan the modifications agreed to with the ToV do not affect the access or parking for LACA. Please reference the attached and previously provided turning radiuses that clearly show that access has been maintained. 2. The Chalets at the Lodge at Vail, LLC is facilitating the changes for the ToV and as you are aware do not manage the property. We suggest that you discuss any concerns you have about operational issues with the appropriate association /property management group. 3. The revisions to the planting bed, entryway, and road occur on Town of Vail Right of Way, so any proposed signage in those areas we will need to submitted to the ToV for approval. Any signage or way finding info in the other areas should be coordinated with the property management group. If you can let me know exactly what you would like and where you would like it located, I am happy to present this to ToV to get the ball rolling. 4. Similar to Item # 2, The Chalets at the Lodge at Vail, LLC. does not control the operations of the L @V Parking Lot, so please direct this request to the appropriate parties. ( "Vail Associates "), as amended (the "Development Agreement ") Gentlemen: This correspondence is to memorialize the commitment made by you and Tom Kassmel during our meeting yesterday and to confirm the understanding of Vail Associates and the Town with respect to the construction of the Check Point Charlie Facility. As you know, in order to complete the construction of the Check Point Charlie Facility prior to Christmas, Vail Associates need to provide its general contractor with a notice to proceed prior to September 11, 2009. We look forward to working with you to finalize the Check Point Charlie Facility improvements as soon as possible. 1. Approved Plans for Construction The Check Point Charlie Facility will be constructed in accordance with the plans submitted to and approved by the Town of Vail Design Review Board on September 2, 2009 and the Site Plans attached hereto as Exhibit A which illustrates the agreed upon ingress and egress to the Lodge at Vail and Check Point Charlie Facility; subject to construction limitations identified in the process of design. One unisex ADA bathroom will be constructed in the Check Point Charlie Facility in the location set forth on the Plans and approved by the Town Council. 2. Utility Fees In accordance with Section 3 of the Development Agreement, the Town will pay for necessary utilities improvements and infrastructure and utilities services, including service charges, for the restroonl to be constructed as part of the Check Point Charlie Facility. The tap fees alone are currently estimated to be between $21,000 and $41,000 and will be determined by the applicable utility providers. Boiler Addition Although not required pursuant to the Development Agreement, the Town has requested that a boiler be installed in a full height mechanical /boiler room below the Check Point Charlie Facility for the operation of the Town snowmelt system. If the boiler is to be installed, the Town will be responsible for all costs and expenses (including, without limitation, design, construction and operational costs) associated with that boiler. I think the bottom line is that it is actually facilities for the Check Point Charley staff, which everyone I believe can understand and support. Being billed as a public restroom, and trying to slide it in under the radar by the town, I think was a huge mistake and not thought out. Why would the entrance of a "public" restroom face the private sector of the area ? ?? Obviously they want to make it inconspicuous. Personally, I do not believe that the Police staff charged with security of the Town, should have to share the restroom with the public. I think it is a simple matter of security There are already two public restrooms within a minutes walk of Check Point Charley. I think it also creates an added traffic congestion potential, as well as late night security issues for the properties adjacent to it. We discussed the following: 1) Cody is going to get the ADA clearance in the bathroom fixed. We mentioned the addition of a urinal and Cody responded that it would add square footage and that it would likely not fit between all the utilities and meet ADA clearance requirements. Is the urinal a want or a must have? 2) Cody is aware the plan does not show a janitors closet as requested as it was to tight to fit one in between the utilities. They are hoping to add a floor sink to the proposed hose bib in the bathroom and that it will suffice for this request. Thoughts and comments? 3) Cody mentioned that he was requested to get some preliminary information on the addition of a boiler for snow melt south of Checkpoint Charlie. Cody has some preliminary data that it will cost between $100,000 to $125,000 based on R &H Mechanical making some broad assumptions. They need us (the Town) to decide on this issue to heat the several thousand square feet to the south of Checkpoint Charlie. If we decide yes it will push the schedule back and the Town will have to find this funding. They need us (the Town) to make a decision on this? 4) Cody is inquiring as to who the contact and billing should be listed on the gas service application? 5) Cody is also curious as to whether or not the construction use tax will be waived as it is a Town project? Please confirm that all other Town of Vail fees will be waived? 6) Cody is additionally inquiring as to the status of any DRB applications. I informed him that I thought this step was completed and if not it would be likely we would staff approved. I informed him to proceed forward with his plans for submitting a permit as early as the end of this week. So Cody would like to know if he should proceed forward with submitting a building permit with some small revisions by the end of the week as planned as well as answers to the above questions. At present the setback of the building to the gas line meets the needs of the utility company, however we will review this condition. 2. We will review the drivelane, however the drive lane dimensions and look and were directed by the PW department and we would prefer not to change this at this stage in the game. 3. As we discussed we will look into some form of a janitors cupboard, but as you know we are very constrained in the size of the building. We will review the bathrooms to ensure they meet the ADA requirements. We will include the changing table into the bathrooms. We will add snow clips to the roof design. 7. We will hire Mark Stell (arborist) to provide a before and after report on the tree in the circle on Gore Creek Drive. 8. We will look into the alternate option of constructing a larger crawls space for the future installation of a boiler by the town. 9. The DIA does reference two (2) bathrooms, however at the time that the civil plans were engineered for this portion of the project, it was determined by all parties including the town, that two bathrooms would not fit. At that point all parties agreed that a uni -sex bathroom would be acceptable and the civil plans that accompany the building permit and the DIA show that. "Jarvie" Worcester VR From: Glenn Palmer AEI, 970 - 926- 3373ph. 970 - 926- 3390(fax) Date: Feb 3, 2009 Re: Vail Front Door Check Point Charlie work. The following was discussed: 1. As a minimum, ERWSD needs 5 feet clear, away from the Sewer MH lid, to allow access for the flush truck, and not on top of any water valves (the water line was recently moved so we should verify per Feb 4 field visit). It appears that the building might need to move a bit towards the center of the island to move off the MH (where the tree is located), unless the Check PT Charlie porch is deleted. 2. The existing sewer is approx 20 feet deep (very deep), so there is realistically no good location where the new building could be placed and avoid all conflicts with possible sewer or water main repairs. Therefore, consider providing features that would allow the building to be moved, slid or lifted. Possible considerations: a. A crawl space would allow access under the structure to shut them off (if it needed to be moved). b. Thinner or removable /paneled rock fascia to reduce rock weight, or panels to allow it's removal, or delete rock. c. Having the building on a skid structure, or hooks in the top for a crane to lift. d. Providing minimal 4 foot deep footings, that when the building was removed, the foundations could be easily demo'd 3. ERWSD said that the building could be placed approximately as shown (move off the MH cover, item #1), but that needed, they would remove whatever can't be lifted/pulled out of the way for possible repair work. 4. The water meter and PRV could be in the building, or crawl space (if reasonably accessible). I don't know if the building has a mechanical/water entry room or not. The existing nearby irrigation meter could be "paperwork tied" to the Check Point new water meter /account for billing purposes. 5. The sewer should connect to the sewer main ( they do not like services connecting to manholes), and should connect to the main at the 2:00 or 10:00 position. 6. Tap Fees: ERWSD said the building would be considered a commercial application, and would be based on the smallest (3/4" meter size tap fee rate) even though the small amount of fixtures probably requires a smaller meter size (for which there is no tap fee given). The water service and actual tap would be 1" minimum. It is possible to request a variance for tap fees. 7. I checked with Holy Cross to make sure it is ok to connect to the existing (nearby) transformer (which we assume the existing building is connected to): they are checking. Other items: February 4, 2009 I asked if there were any outstanding water or sewer acceptance, inspection or repair items for the Front Door: They said that items noted last fall had all been addressed, and (now just waiting for the formal acceptance application: the bill of sale is the last item needed, and is in process).
