All projects re- quiring design review must receive approval prior to submitting a building permit application. An application for Design Review cannot be accepted until all required information is received by the Community Development Department, as outlined in the submittal requirements. Since you indicated that the Association would need to give an approval letter for you to even begin the process and you also indicated that such approval would not be the final approval required from the HOA for the town, I called verify this since it isn't consistent with out understanding. Martin stated that DRB is the only one that requires Association approval and that the building permit process has no similar Association approval letter process. He also indicated that DRB in this circumstance is a minor element (although necessary) for the full permit process. He said that plans are required for a building permit application and that the application won't be considered or accepted until there are plans with the application (including in a retroactive situation). As I explained previously when the Board has approved anything in the past they always have required the plans and then I submit those out to the any affected adjacent owners as well as the board and then depending upon how simple or complicated the approval is than either a board meeting is set or a unanimous consent is signed. The consent can be done if based upon the review via email etcetera all parties agree to approve without needing a meeting to discuss first_ Conditions for the approval are then made and then recorded against the property depending upon the details of that condition. In this case I believe that a board meeting may not be necessary and a unanimous consent may be possible since the neighboring unit owner doesn't seem to take issue with the concept of you going into the crawl space and the Board noted that they too are "in concept" ok as well. The Board will likely want legal review of the approval conditions and that will likely require legal review. Such a review is likely to be brief and not too expensive. I imagine that it wouldn't be more than an hour of time for counsel as we have done these previously. Since your expansion isn't as big of an architectural review element I also believe that there won't need to be an architect hired on behalf of the HOA so that expense will likely be avoided (most of the expectations impact the exterior so that the applying owner must also pay for the Association to hire an architect to review the plans and give an opinion about how it will impact the building aesthetically and functionally etcetera). In other words all expenses are the owner's responsibility throughout this process but depending upon how smoothly it goes those expenses should be relatively minor from the Association in comparison to many of the other approvals. I will forward you email to the Board so they realize you have begun the process which is what I believe was required by September 15th. You indicated that you told the building official (community development) that you have installed living space into the crawl space and added a window etcetera. Please confirm with me that you are developing the plans for the building permit application etcetera and please give me an estimated date when you will have the plans completed to submit for approval to the HOA so I can indicate that timeline to the Board. I have told them of the crawl space and the window, built for ingress and egress The first step is an application for design review of a minor exterior application. I will take a picture and submit this with the application. I will need from the board, approval in concept, of what has been done. I will get a licensed contractor in my unit to give his stamp of approval that everything was done according to code. In addition, a surveyor will need to be contracted with to survey the extents of the 'crawlspace' as constructed. I will be contacting you to fill out the proper DRB application, provide DRB fees, and provide you with any additional information you need. I know you have photos and loose drawings, but I will check to see what else. The end result will be a crawlspace with a circular stair, the installed window, and a garage that will accommodate 2 cars. Drawings will be created to adequate to provide information for demolition/building permit to the town. The following is a record of discussions regarding the crawlspace and the Garage storage room 1 Drawings shall be prepared for the demolition of the existing lower space to a crawl space. A. Drywall shall be removed as needed to perform the required electrical and, insulation and drywall installation inspections. B. a pre-manufactured circular stair is to access the Crawl Space. The stair shall fit within the existing floor opening. The bottom of the stair shall be reviewed to see if the existing opening will function properly C. insulation, drywall, and electrical shall be corrected and installed to meet code. Note: The Owner and the town is aware of a letter that exists stating the electrical was reviewed by a electrician and an inspector and found to acceptable. 2 Drawings shall be prepared for the demolition of the garage storage room A. Wall construction and interior doors are to be removed to return the garage back into a 2-car garage. B. Drywall shall be removed as needed to perform the required electrical and, insulation and drywall installation inspections. 3 A design review application shall be submitted to the town to finalize the DRB review of the window. 4 A schedule shall be created to submit to the town regarding: DRB submittal/meeting/staff review meeting Building/demolition permit application Demolition to occur within 7 days of building permit issuance.
