The complaint alleges that the property is being used in violation of the building code adopted by the Town of Vail. Specifically, the use of a loft space as a bedroom that has not been designed for such use would be a violation of the towns building code. A copy of the code section is attached for your reference. In order to use the loft as a bedroom a building permit will be required. The building permit is the instrument used to insure the protection of the life safety and welfare of the occupant(s) for the proposed use.
