This new business is to be located in an existing 245 square foot space within the Arrabelle at Vail Square. The business plan, as understood by the Town of Vail is that the space will be utilized to sell retail items from the various signatures clubs that Vail Resorts has to offer. It is further understood that the space will not be offering or conducting any real estate sales or transactions. Staff has determined that, as proposed, your business will comply with all aspect of the Vail Town Code. The Arrabelle at Vail Square is located within the Lionshead Mixed Use 1 District which permits retail stores and establishments on the first floor or street level. It is expected that the business activity occurring in space P149 will fully comply with Chapter 12 -71-1, Lionshead Mixed Use 1 District, Vail Town Code. In several conversations with you, I believe there is a clear understanding that real estate sales will not be occurring on site, nor any other activity which could be construed as being real estate marketing. If I am incorrect in any of my understandings from either Mr. Mauriello's letter or our conversations, please let me know so I can determine if your proposed business is in compliance with the Town of Vail Zoning Code. The proposed use is retail store /establishment, which is listed as a permitted use on the first floor within the Lionshead Mixed Use — I zone district. The principal use within the 245 sq. ft. space is retail sales of goods, articles, and wares related to club facilities (i.e., club wear) located onsite and elsewhere within the community. In addition to the principle retail use of the space there will also be display of information (photos) related to the clubs located in the community. Title 12, Zoning Regulations, contains no definition of "retail store and establishment" and therefore there are no limitations placed on the percentage of space relating to a retail establishment. Since the majority of the floor area of the proposed location will be devoted to retailing and retail activities, the use is clearly a retail establishment. The use is clearly distinguished from either a professional office or a business office, which are both defined by Title 12. Both of these uses are offices where the "storage, sale, or display of merchandise on the premises occupies less than ten percent (10 %) of the floor area." The proposed retail store will include the storage, sale, and display of merchandise in excess of 50% of the floor area.
