Garage Door, since they have achieved 14' as per allowed per Town code.

Dear George and Tom:
This letter is to advise you and confirm to you that Shaw Construction, as the General
Contractor for Vail Plaza Hotel & Club, has posted a one hundred thousand dollar
($100,000.00) bond for the benefit of the Town of Vail. The bond will be held while a
satisfactory solution and remedy has been completed concerning the entrance /exit door at
the Vail Plaza Hotel & Club loading dock. The bond is posted for the purpose of insuring
that the work is completed by June 30, 2007. If a resolution is not completed by this date
the Town of Vail may call the bond.
Various options to remedy the issue, pending appropriate approvals, are as follows and
will be executed in the order listed:
1.) Verify that a thirteen foot six inch (13'- 6 ") WB -40 truck can enter and clear the
loading and delivery garage. (After relocation of the sprinkler heads. No attempt
has been made to verify non - compliance).
2.) Removal of the horizontal wood trim at the bottom of the door header, which
achieves a thirteen foot eleven inch (13' -11 ") opening.
3.) Rework of steel to achieve a fourteen foot (14') opening — coupled with
adjustments to the door as well as the addition of brush seals.
4.) Apply for a variance from CDOT and the Town of Vail to remove, re -grade and
replace the loading dock drive in order to change the drive slope to a straight
grade from the south edge of the mandated two percent (2 %) cross -slope on the
crosswalk to the trench drain.
We are sure a solution can be achieved by using a combination of the above. Number 2.)
will be completed before December 12, 2007 for verification.

Until the time a viable solution is achieved, the Vail Plaza Hotel will inform all delivery
companies and all merchants within SDD #6 that all deliveries are to be delivered in
vehicles that are no more than twelve foot six inch (12' -6 ") in height and at no time will
delivery vehicles be permitted to load /unload within the Vail Road and or South Frontage
Road right of ways, unless a permit has been obtain from the Town of Vail. In addition,
no vehicle will be permitted to stop /stand or back up within any travel lanes of Vail Road
and or South Frontage Road.
A Violation of this requirement will result in a traffic violation ticket and or the possible
revocation of the Hotel's TCO as determined necessary by the Town of Vail as this
requirement is deemed a condition of the TCO.
