A portion the permit was to remove a partial height wall and replace it with a 36” high metal railing. 1/06/2009 The permit received a final inspection by JR 12 / 16/2009 Fire Department writes a letter to the HOA in regards to damage to the boiler flues of the overall building. The building uses common flues. Correspondence with the Fire department had been on going in an effort to resolve this issue with Mr Brown and the HOA. Mr. Brown had given a bid to the HOA to eliminate this hazard. SEPERATE ISSUE BUT RELATED PER MR BROWN DUE TO AN ERRODING RELATIONSHIP WITH THE BUILDING OWNERS. 12/24/2009 Letter dated request the town to indemnify Mr. Brown from liability of work he performed and claims owner did part of the work in suite 4. I informed Mr. Brown that the town cannot accept liability for him as a contractor or actions of the owner. I also told him I could not write a letter indemnifying him from responsibility for the work done in Unit 4.c 5/19/2010 Mechanical permit issued for repair of flues, review done by Chris, to a different contractor than Mr. Brown. 6/29/2010 Work inspected and approved by me Mr. Brown met with Mike and I upset that he did not get the job and questioned the product and method of the repair. He also stated the HOA would not allow him access to personally inspect the work. Mike informed him that the product used has been used several times in the past for the same situation and is functioning fine. I informed him that the installation was found to be in compliance with the code. I received a request to contact a reporter from a local newspaper. Mr Brown claimed, to the reporter, that people were endangered in the building due to the flue repairs done without permits. I researched the project once again and confirmed that additional work had not been done since the mechanical permit had received a final. I forwarded all the background information to the newspaper reporter and made myself available for any additional concerns. 1/14/2011 I wrote a letter, upon the Town attorney’s recommendation, to the owner of unit 4 explaining the use of space not designed as a bedroom would be a building code violation and require a building permit. The permit process would include items to show code compliance such as guardrail requirements, egress, etc. The owner has come into the office and talked to JR and David about clarification of the use of the space upon receipt of the letter and informed them that he would discontinue the use. As explained to Mr. Brown by myself and Mike McGee the town would not seek a search warrant based on the information given. We have not been given access by the owner. Regulating where someone sleeps or how they use a space on a day to day basis in a personal residence is difficult. Example: If a family rents a unit with 2 bedrooms and has some friends of their kids come with them. The kids sleep in sleeping bags in any space available for the week. Does the building and fire department go in and cite the owner for the kids sleeping on the couch or on the floor in the hall? As explained to Mr Brown, the goal of the town is not to insure the safety of its residences and guest. This is not possible. We do try to create a safe environment for our guest and residences thru the enforcing of the building codes. Martin A Haeberle C.B.O.
