Dear Mr. Peterson,
The Community Development Department is in receipt of your email dated January 31, 2011, in
which you attached a document describing the business which you wish to operate in Units 201
and 203 of the Concert Hall Plaza Building. Staff has reviewed your correspondence and has
found the following:
• The Concert Hall Plaza Building is zoned Lionshead Mixed Use 1 District and is subject
to the land uses listed within Section 12 -7H -3, Permitted and Conditional Uses: First
Floor or Street Level, Vail Town Code.
• Section 12 -2 -2, Definitions of Words and Terms, Vail Town Code, defines a Health Club
as "A facility where members and nonmembers use equipment or space for the purpose
of physical exercise." This land use is listed as a permitted use in the Commercial Core
3 District and as a conditional use in the Arterial Business District.
• Massage Parlors are listed as a conditional use within the Commercial Core 3 District
and are not defined in the definitions chapter of Title 12, Zoning Code, Vail Town Code.
• Section 12 -2 -2, Definitions of Words and Terms, Vail Town Code, defines a spa as "A
commercial establishment providing services including massage, body or facial
treatments, makeup consultation and application, manicures, pedicures and similar
services, but excluding beauty and barber shops." This land use is not specifically
identified as a permitted or conditional land use in any specific zone district. It has
typically been considered an accessory use "customarily incidental and accessory' to a
lodge which is a permitted use in several zone districts.
• Section 12 -2 -2, Definitions of Words and Terms, Vail Town Code, defines Personal
Services as "A nonmedical commercial business where a service is offered to the
customer and where accessory retail sales of products related to the services may be
provided, including, but not limited to, beauty and barber shops, tailor shops, dry
cleaners, laundromats, repair shops, and similar services." This category is listed as
permitted and conditional uses in multiple zone districts within Title 12, Zoning Code,
Vail Town Code.
• Section 12 -2 -2, Definitions of Words and Terms, Vail Town Code, defines a Professional
Office as "An office for the practice of a profession, such as offices of physicians,
dentists, lawyers, architects, engineers, musicians, teachers, accountants, and others
who through training are qualified to perform services of a professional nature, where
storage, sale, or display of merchandise on the premises occupies less than ten percent

(10%) of the floor area." This category is listed as permitted and conditional uses in
multiple zone districts within Title 12, Zoning Code, Vail Town Code.
The Lionshead Mixed Use 1 District identifies as a permitted use on the first floor or
street level, recreation facilities. The term "recreational facilities" is not defined in Title
12, Zoning Code, Vail Town Code.
The Lionshead Mixed Use 1 District identifies as a conditional use on the first floor or
street level, beauty and barber shops, which is an identified use within the personal
services category.
In conclusion, based upon these facts Staff believes that the yoga studio falls under the
permitted land use of a recreation facility and therefore is allowed on the Concert Hall Plaza first
floor. Staff believes the acupuncture element of your proposal falls into the medical types of
land uses found under the professional office designation. As neither a massage parlor or a
professional office are listed as a permitted or conditional use on the first floor or street level
these proposed land uses cannot be concluded as allowable in the proposed location.
Staff believes you should pursue the yoga studio in Unit 201 and the concept of transactions
and retail in Unit 203. If you have any questions please feel free to contact me by email at

Hello,
I plan on offering hot room yoga, Hot Room hot yoga method, at bay 201 in Lionshead.
Plan 1 Bay 201:
6:00 am Hot RoomYoga Method
9:15 am Hot Room Yoga Method
11:00 am Hot Room Yoga Method
4:30 pm Hot Room Yoga Method
6:15 pm Hot Room Yoga Method
7:45 pm Hot Room Yoga Method
The price will be $15 to $20 per class.
Plan 1 Bay 203:
In bay 203, I plan to offer sweedish massage, couples massage, and acupuncture.
The prices will vary depending on time limit from $40 to $240 per session.
Plan 2 Bay 203:
In bay 203, I plan to due transactions for yoga classes and offer a retail store. In this case
there is no need for any construction in the bay.

After further review and discussion the Planning Team has agreed that your proposed yoga studio fall under the land use
category of "recreational facilities" and is therefore a permitted land use on the first floor or street level. The massage
and acupuncture elements of your proposal we do not believe are permitted or conditional uses on this floor of the
building. Please see the attached letter for more detail.
Please prepare your building permit application package at your earliest convenience.
Thank you for your patience as we reviewed your request.
I included Martin on this email so he is aware of the current situation and will know that to expect your application.
Please remember that the Town has a process for the review of signage for businesses in Town and an application
process. Please contact me when you are prepared to start discussing signage.
