Project Description: Tenant Finishes for Penthouse I, a 2664-sq-ft,
2-story condominium unit located on the 7th & 8th stories; Penthouse II,
a 2175-sq-ft, 1-story condominium unit located on the 7th story; and
Penthouse III, a 2,072-sq-ft, 1-story condominium unit located on the
6th story; respectively, of an existing hotel building.
NOTE: The code items listed in this report are not intended to be a
complete listing of all possible code requirements in the 1997 UBC.
It is a guide to selected sections of the code.

SEPARATIONS
The condominiums are required to be separated from other condominium units
or hotel rooms adjacent to them or above or below them by approved one-hour
fire-resistive construction in accordance with Sec. 310.2.2, 197 UBC.
Corridor walls adjacent to condominiums are required to be approved,
1-hour fire-resistive construction in accordance with Sec. 1004.3.4, 197
UBC, including smoke-gasketed 20-minute smoke-and-draft-control door
assemblies in accordance with Sec. 1004.3.4.3.2.1.
Stair enclosures in this 8-story Type II-FR building are required to be
constructed as 2-hour fire-resistive enclosures with 90-minute doors in
accordance with Sec. 1005.3.3, 197 UBC.

FOOTNOTES:
1) EGRESS - Egress windows or doors are not required for sleeping rooms
located at or above the fourth story (Sec. 310.4, UBC) .
2) NOTE: The building official has determined that the number of
required exits from each individual condominium unit may be based upon
an occupant load factor of 300 square feet per occupant. However, two
exits are required from each entire story of the building. The building
official has also determined that the separation distance for the stair
enclosures as proposed is adequate under the circumstances.
3) A mechanical ventilation system may be used in lieu of exterior
openings for ventilation. -- Sec. 1203.3 Such system shall be
capable of providing two air changes per hour.
ROOM DIMENSIONS:
Habitable space shall have a ceiling height of not less than 7 feet
6 inches. Kitchens, halls, bathrooms and toilet compartments may have
a ceiling height of 7 feet measured to the lowest projection. If the
ceiling is sloping, then the minimum height is required in only 1/2
of the area. -- Sec. 310.6.1
Every dwelling unit shall have at least one room which has not less
than 120 square feet of floor area. Other habitable rooms except
kitchens shall have an area of not less than 70 square feet.
-- Sec. 310.6.2
Habitable rooms other than a kitchen shall not be less than 7 feet
in any dimension. -- Sec. 310.6.3
STAIR REQUIREMENTS:
1) A stairway in a dwelling must be at least 36 inches wide.
-- Sec. 1003.3.3.2
2) The maximum rise of a step is 8 inches and the minimum run is 9
inches -- Sec. 1003.3.3.3, Exception 1
3) A handrail is required on one side a stairway 34 to 38 inches above
the nosing if there is 4 or more risers. -- Sec. 1003.3.3.6, Exceptions
4) Provide a guard rail where drop off is greater than 30 inches.
The minimum height is 36 .inches and the maximum opening size is
4 inches. -- Sec. 509.1 & 509.2, Exception 1
5) The minimum headroom is 6 ft.- 8 inches. -- Sec. 1003.3.3.4
6) Enclosed usable space under the stairs is required to be protected
as required for 1 hr. fire-resistive construction. -- Sec. 1003.3.3.9
GLAZING REQUIREMENTS:
All glazing in hazardous locations is required to be of safety
glazing material. -- Sec. 2406.3 & 2406.4
Locations:
1) Glazing in ingress and egress doors except ]alousies.

2) Glazing in fixed and sliding panels of sliding door assemblies
and panels in swinging doors other than wardrobe doors.
3) Glazing in storm doors.
4) Glazing in all unframed swinging doors.
5) Glazing in doors and enclosures for hot tubs, whirlpools, saunas,
steam rooms, bathtubs and showers. Glazing in any portion of a
building wall enclosing these compartments where the bottom exposed
edge of the glazing is less than 60 inches above a standing surface
and drain inlet.
6) Glazing in fixed or operable panels adjacent to a door where the
nearest exposed edge of the glazing is within a 24-inch arc of
either vertical edge of the door in a closed position and where the
bottom exposed edge of the glazing is less than 60 inches above the
walking surface.
7) Glazing in an individual fixed or operable panel, other than those
locations described in items 5 and 6 above, than meets all of the
following conditions:
A. Exposed area of an individual pane greater than 9 square feet.
B. Exposed bottom edge less than 18 inches above the floor.
C. Exposed top edge greater than 36 inches above the floor.
D. One or more walking surfaces within 36 inches horizontally of
the plane of the glazing.
8) Glazing in railings regardless of height above a walking surface.
Included are structural baluster panels and nonstructural in-fill
panels.
9) Glazing in walls and fences used as the barrier for indoor and
outdoor swimming pools and spas when the bottom edges is less than
60 inches above the pool side and the glazing is within 5 feet
of the pool or spa water's edge.
10) Glazing in walls enclosing stairway landings or within 5 feet of
then bottom and top of stairways where the bottom edge is less
than 60 inches above the walking surface.
SMOKE DETECTOR REQUIREMENTS:
1) A smoke detector is required on the ceiling or wall at a point
centrally located in the corridor or area giving access to each
sleeping area. -- Sec. 310.9.1.4
2) A smoke detector is required on the ceiling or wall in each sleeping
area. -- Sec. 310.9.1.4
3) A smoke detector is required on all stories. -- Sec. 310.9.1.4
If the upper level contains sleeping room(s) , a smoke detector is
required in the ceiling of the upper level close to the stairway.
-- Sec. 310.9.1.4
4) Smoke detectors are required to be wired to the building's power
source and shall be equipped with a battery backup. -- Sec. 310.9.1.3
5) Detectors shall sound an alarm audible in all sleeping area of the
dwelling in which they are located. -- Sec. 310.9.1.4
6) Provide a smoke detector in all sleeping rooms and areas having
access to sleeping rooms. -- Sec. 310.9.1.4
7) Provide a smoke detector on all floors that is connected to an
alarm audible in all sleeping areas. -- Sec. 310.9.1.4
SHAFT ENCLOSURES:
1) Gas vents and noncombustible piping installed in walls passing through
3 floors or less do not need to be in 2-hour shafts, provided the
annular space around the vents or piping is filled at each floor or

ceiling with noncombustible materials.-- Sec. 711.3
2) All other shafts are required to be enclosed in a 2-hour assembly.

OTHER:
1) The only wood that is permitted to be used for backing within interior
walls is approved, fire-retardant-treated wood (Sec. 603.1, UBC, for
Type II-FR noncombustible construction) .
2) Kraft paper backing for insulation is not permitted to be used in Type
II-FR construction (Sec. 707.3, UBC) .
3) Gas-fired logs or fireplaces installed in bedrooms or sleeping rooms
must be specifically listed for installation in a sleeping room and the
installation must follow the manufacturer's instructions for
installation in a sleeping room.
4) Plywood may not be used as backing for masonry veneer installed on
fireplaces in Type II-FR noncombustible construction. Approved cement
board or other materials that meet the UBC definition of
"noncombustible" must be used (Sec. 603.1, UBC) .
5) Clothes dryer ducts that exceed the prescriptive maximum length
requirements of 14' and two 90-degree elbows (Sec. 504.3.2, 197 UMC)
must be designed by a qualified mechanical engineer or otherwise meet
the requirements of Sec. 504.3.2, UMC.
6) Dishwashers must be equipped with approved backflow prevention
devices in accordance with Sec. 807.4, 194 UPC; Sec. 409, 197 IPC
and applicable state laws.

SPECIAL NOTE: LICENSING REQUIREMENTS FOR PLUMBING AND ELECTRICAL
WORK
Per Colorado law (CRS 12-58-101 et seq & 12-23-101 et seq, respectively), persons performing
plumbing or electrical work for hire must be licensed by the State Plumbing or Electrical board,
respectively, and must be working under the supervision of persons licensed by the state to operate a
plumbing or electrical business For plumbing work,this means that the individual must not only be
licensed by the state as a plumber,but must also either hold a Master Plumber's license or be working
under the direct supervision of a Master Plumber. For electrical work, the person doing the work
must not only be licensed, but must also either hold a Master Electrician's license and an Electrical
Contractor's license or be working under the direct supervision of an individual licensed as such The
only applicable exception to these laws is that individuals may perform electrical or plumbing work
within their own home(see CRS 12-58-113(2) and 12-23-111(2), respectively, for details)

APPROVAL OF PLANS AND SPECIFICATIONS DOES NOT PERMIT THE VIOLATION OF
ANY PART OF THE TOWN OF VAIL BUILDING CODES OR ANY OTHER ORDINANCE
OR LAW OF THE TOWN OF VAIL
1 Foundations supporting wood shall extend at least 6"above the adjacent finished grade(UBC Sec 1806 1)
2 All lumber in contact with concrete or masonry or within 6" of finished grade shall be treated wood or
redwood (UBC Sec. 2306.4)
3 Frost depth to the bottom of the foundation footings must be as prescribed on the engineered plans If not
noted, the frost depth to the bottom of the footings must be a minimum of 48 inches below finished grade
(UBC 1806 1)
4 Wood joists closer than 18"or wood girders closer than 12"to exposed ground within a crawl space are to
be treated lumber or wood of natural resistance to decay(UBC Sec 2306 3) Wood used inthe construction
of structures and located nearer than 6" to earth shall be of treated wood or wood of natural resistance to
decay(UBC Sec 2306 3).
5 Wood girders,that are not treated or of redwood,entering concrete or masonry walls must maintain a'/2"air
space(UBC Sec. 2306.6)
6 Under floor vents shall have a net area of not less than 1 sq.ft for each 150 sq ft of under floor area(UBC
Sec. 2306 7)
7 Accessible under floor areas shall be provided with a minimum 18" x 24" unobstructed access opening
(UBC Sec 2306 3) Where equipment is located in an under floor area the access opening shall be of a
height and width sufficient to allow the removal of the largest piece of equipment,but not less than 30"x 22"
(UMC Sec 307 4)
8. Provisions shall be made for the control and drainage of surface water around buildings. All building pads
will be graded 2% away from buildings(UBC Sec 1804.7& 1806 5 5)
9. Dampproofing or waterproofing of foundations retaining earth and enclosing interior spaces below grade is
required (UBC Sec 1402 4)
10. Bond beam required in block foundation walls.
11 Foundation plates or sills shall be bolted to the foundation wall as prescribed on the engineered plans Ifnot
noted,bolted with not less than'/2-inch diameter steel bolts embedded at least 7 inches into the concrete or
masonry and spaced not more than 6 feet apart There shall be a minimum of 2 bolts for each piece with one
bolt located within 12 inches of each end of each piece (UBC Sec 1806 6)
12 Garage floor surface shall be of approved noncombustible materials or asphaltic paving material(UBC Sec.
312.5)
13 All lumber,plywood,fiberboard and structural glued laminated timber must be identified by a grade mark or
certificate of inspection issued by an approved agency(UBC Sec 2304.1)
14. All trusses and/or rafters are to be tied to exterior walls with approved hurricane anchors (UBC
Sec 1605 2 3) Rafters & ceiling joists exceeding 2" x 6" (3 to 1 ratio) & trusses shall be
supported laterally at points of bearing by solid blocking to prevent rotation&lateral displacement
(Sec. 2320 12 8) Trusses shall be marked showing the truss manufacturer, design loads and
spacing (UBC Sec 2321 4)
15. Trusses shall be designed and fabricated in accordance with ANSI/TPI 1-1995(UBC 2321 1)or a
design and details by an engineer must be furnished. Prior to rough framing inspection a truss
engineering report detailing the bearing points,bracing requirements,load design and spacing must
be on site and attached to the "APPROVED PLANS"

16 Ridge beam shall not be less in depth than the end cut of the rafters, and shall be at least 1"nominal
thickness(UBC Sec 2320 12 3)
17.Provide attic vapor barrier and ventilation equal to 1 sq. ft. per 300 sq. ft. of attic area and rafter
spaces (UBC Sec 1505 3 except#2 )
18.Provide a minimum 22"x 30" attic access opening with 30" clear headroom in the least dimension
as required by UBC Sec 1505 1
19. All roofing to be installed per manufacturer's listing Roofs shall be sloped a minimum of 1 unit
vertical in 48 units horizontal for drainage (UBC Sec 1506.1)
20 The interior of the building must be separated from foam plastic insulation by an approved thermal
barrier having an index of 15. Within an attic or crawlspace foam plastics shall be protected from
ignition by 1 '/2"mineral fiber insulation, 1/4"plywood,hardboard,gypsum wallboard,corrosion-
resistant sheet metal having a base thickness not less than .016" at any point, or other approved
material installed in such a manner that the foam plastic is not exposed(UBC Sec 2602 4)

26. BASEMENTS SHALL BE PROVIDED WITH AT LEAST ONE ESCAPE OR RESCUE
WINDOW WINDOW WELLS AT ESCAPE OR RESCUE WINDOWS SHALL COMPLYWITH

where a story or basement is split into two or more levels, the smoke detector shall be installed on the

level When sleeping rooms are on an upper level,the detector shall be placed on the ceiling of the upper
level in close proximity to the stairway In addition, if the ceiling height of a room open to the hallway
serving bedrooms exceeds that of the hallway by 24" or more, smoke detectors shall be installed in the
hallway and the adjacent room. Detectors shall be audible in all sleeping areas of the dwelling unit(UBC
Sec 310 9 1.4) Smoke Detectors shall receive their primary source from the building wiring and shall be
equipped with a battery backup (UBC Sec. 310 9 1 3)
29 Where the valuation of an addition or repair to an existing structure exceeds $1000 00 or when one or
more sleeping rooms are added or created in existing dwellings,the entire structure shall be provided with
smoke detectors as required for a new structure(UBC Sec. 310 9.1.2). Smoke detectors may be solely
battery operated when installed in existing buildings ([IBC Sec. 310.9.1.3)

dead bolts and security chains may be used provided such devices are operable from the inside without the
use of a key or tool and are mounted at a height not to exceed 48" above the finished floor(UBC Sec

32. TAIRWAY MINIMUM HEADROOM REQUIREMENT IS 6'-8" (UBC Sec. 1003.3.3.4).
33 or private residential stairs, maximum riser height is 8", minimum tread run is 9", and minimum stair
width is 36" (UBC Sec. 1003 3.3.3 &.2). For winding stairways the 9"tread must be provided at a point
not more than 12" from the side where the treads are narrower, but in no case shall any width of run be
less than 6" at any point (UBC Sec. 1003.3.3.3)
