occupancy group. To be considered separate buildings with different
construction types, a fire wall would be required.
� The response to this correction refers to an "imaginary property fine" between
the two occupancy classifications. As described, that "imaginary property line"
� would dissect parking spaces on the open parking garage and divide the
enclosed parking garage below into two areas. Rather, if there is an assumed
� property line, it would be located at the juncture of the two types of
construction. The junction of the two types of construction would be at the
exterior wall of the R-2 units. Per table 705.4, that exterior wall, constructed as
� a fire wall, would require a 3-hour fire rating. In addition, per Section 503.2,
the wall would be located on the property line and would be used for joint
service between the buildings. That would qualify the wall as a party wall, and
� require it to be constructed without openings.

� 29) Section 1013 Exit access, IBC. Plan sheets A1 .2a and A1 .3a show common
path of egress travel being measured incorrectly. That measurement is made in
� a rectilinear manner with travel perpendicular or parallel to walls.
Per Section 903.2.7, IBC, buildings containing a Group R fire area are to be
� provided with an automatic sprinkler system throughout. If an administrative
modification is to be requested, please submit required documentation to the
� Building Official.

31) Section 1017.1 General, and Section 1020 Exit Passageways, and Section
� 1023 Exit discharge, IBC. Plan sheet 2/A2.1 shows the 3-hour fire-rated
vertical exit enclosure exiting into room #122, which is shown on plans sheet
A1 .2a as a 2-hour fire-rated fire command center. Once a given level of exit
� protection is achieved, such level of protection shall not be reduced until arrival
at the exit discharge. Room #122 would require a 3-hour fire rating. In
addition Room #122 would be required to comply with requirements for an exit
� passageway or Section 1023 for exit discharge. Provide details showing
compliance with the above stated exiting requirements.
� If room #122 is to function as an exit passageway it appears that there are
mechanical, plumbing and electrical penetrations which do not comply with
� Section 1020.5 of the IBC. Please clarify.

For the above-referenced project, the building requires R-2, B and S-2 over an enclosed
� S-2. We have met the requirements according to Section 508.2 of the 2003 IBC as
follows:
1. The basement S-2 enclosed parking garage is Type IA construction and is
� separated from the building above with a horizontal assembly having a 3-hr
fire-resistance rating.
2. The elevator, stair and shaft enclosures through the horizontal assembly are 3-
� hr rated.
3. See below.
4. The building below the horizontal assembly is a Group S-2 enclosed parking
garage used for the parking and storage of private motor vehicles.
5. The maximum building height for the IA enclosed parking garage is
unlimited; the maximum allowable building height for the IB, R2, B, M, and
� S2 is l lstories, 160'. The project has 6 stories, 82', which is therefore
allowable.
� Regarding#3 (the S-2 over the enclosed S-2), we have consulted with Mike Perrino,
Code Consultants, Inc, St. Louis, Missouri, and we offer the following references: the
1997 UBC, the 2006 IBC and the notes from the ICC Public Hearing of September 2003
� (See attached):
In the ICC Public Hearing record, please note that under#1, third paragraph, we
find" The code changes do not indicate that the storage occupancies were to be removed
� as a permitted use...In addition, staff has been unable to provide any information as to
why the storage occupancy was no longer specified as a permitted occupancy. Thus, it
appears that during the reclassification of occupancies and reorganization of the code that

The horizontal separation between the IA Enclosed Parking Garage and the areas above

Both 508.2 and 508.3 say the Enclosed Parking Garage "shall be classified as a separate
and distinct building for the purpose of determining the type of construction."
� Therefore, the edges of the IA construction at that level has no relationship to the edges
of any construction type above that level.
� Section 502.1 defines the area of a building as "the area included within surrounding
exterior walls... Areas of the building not provided with surrounding walls shall be
� included in the building area if such areas are included within the horizontal projection of
the roof or floor above."Note that the area is not defined by the parking stripes.
� Refer again to plan 3/A1.2 and section 1/A1.4. The boundary of the IIIB and IB areas are
drawn at the edges of the roof of each of those areas. The imaginary line is at the
midpoint between those edges. The imaginary line is not required to go past the 3-Hr
� horizontal separation because that is a"separate and distinct building" as noted above.
Therefore the only vertical separation required is along the lines of the R-2 units in the
IIIB construction type. From the Fire Separation Distance (Table 602): IIIB, R-
� occupancy, greater than 10' and less than 30' = 1 HR. However, IIIB exterior walls are
required by Table 601 to be 2 HR, so this is the more restrictive. Therefore, we have
provided 2 HR walls.
� Table 704.8 allows 75%unprotected openings @ greater than 15' to 20' with sprinklers.
However, this wall is also a component of the Exterior Egress Balcony(Section 1013.5),
, so the more restrictive requirement is for corridors (Section 1016.1), which requires %2
hour rating with 20 minute openings (Table 715.3).
� We request an Administrative Modification to allow a deluge sprinkler head at each
window in lieu of the 20 minute rating to allow for operable windows at the bedrooms.

Units 280, 282, 296, 380, and 396 (marked with an Z on the chart above) will have a

� We have consulted with Mike Perrino, Code Consultants, Inc., St. Louis, Mo. At the ICC
Public Hearing, February 2005, he presented the E74-04/OS document(attached) as an

� The Splash! lift is attached to the pool deck using a company provided square anchor
socket, similar to those used for starting blocks or backstroke flag stanchions.
� The Splash! is virtually maintenance free. The components are made from corrosion-
resistant materials, including powder-coated aluminum (arms), and powder-coated stainless
steel (base, mast, and seat frame). The unique seat of the lift was specifically designed to
� provide the user with the greatest possible safety, comfort and ease of transfer. The hand
control is completely waterproof, and allows either the user or the attendant to control its
operation with ease. The control box and battery are water resistant and should be
� protected from long exposure to the water. A small, waterproof cover is included with each
lift to cover the control box when the system is in use. If the lift is used outdoors, an optional
full cover is available for purchase and is recommended to use to protect the system.

' The following are our responses to the structural portions of The Town of Vail Building
Department comments for the above building, dated June 7, 2007. We have included the
original comment with each response. Our responses are noted with"M&N Response".

Structural Comments:
' 73. The referenced code interpretation paper by S.K. Ghosh indicates that for"building frame
system"to be used, shear walis must have integral beams and cotumns to support 100%
of gravity loads. Precast cores on this job do not appear to contain such detailing. R=4 is
' required based on the provided code interpretation.
M&N Response:
' The reference to Ghosh's paper was made merely to underscore the fact that
the definition of a braced frame system,particularly with regard to the
, percentage of floor area supported by cores, has been worded poorly in both
the ASCE7 and the NEHRP provisions. Even ICC code officials
acknowledge this. Monroe &Newell Engineers Inc. has discussed this code
' interpretation with many knowledgeable engineers in the industry, and in our
opinion,the towers do not qualify as a bearing wall system. However,the
structural design criteria for the new construction has been modified with R=4
1 to result in a base shear coefficient of Cs= 0.044. It is the opinion of Monroe
&Newell Engineers, Inc. that this value of Cs is reasonable for a mid-rise
structure in SDC B. For additional clarity, see updated spreadsheet of
' structural design criteria.

This location provides immediate fire department access to the annunciator, but does not
� obstruct egress width.
2. Staging area for fire apparatus is not approved as shown. Too close to the building and
obstructs exiting. RESPONSE: The proposed staging area has been reviewed for access,
� dimensions and egress. The design team believes that this staging area meets fire code
requirements and does not impede egress. Please see the attached sketch.

� Dear Mr. Kassmel:
The purpose of this letter is to address your comments pertaining to the Lions Square Lodge North
� Redevelopment Building Permit Review, dated June 8, 2007. The following are responses to the
comments.
� Comment#1: The warning sign proposed along the west side (Detail A) may be difficult to place in the
location shown. Please provide additional detail. Please see existing conditions survey,
�` the sign needs to move further north and may be able to be attached to an existing light
pole.
�r The sign will be move further north and located on an existing light pole at the back of
sidewalk. We will provide additional detail on our plan sheets.
� Comment#2: The sign must be placed in a location that it will not be hit by exiting truck traffic. 8'
clearance and 2'+ intrusion onto the drive lane will get hit by trucks that are usually 13.5'
�' in height.

The sign will be mounted on the retaining wall at a minimum height of 13.5' to provide
� acceptable c/earance for trucks.

Comment#4: Sign posts in the Town of Vail Row shall match the standard wood TOV posts. (See
� attached detail)
Plan sheets will be revised to reflect this standard.
� Comment#5: Provide more detail of how the warning lights will be located. (Plan Blow Up) the one at
"' the west entrance conflicts with a doorway and stairway, and the one at the south
entrance conflicts with a narrow walk.
�„ Plan sheets will be revised to include enlargements at the locations where warning lights
are located, in order to provide a better understanding of device placement and to
� mitigate possible intrusions into walkways and driveways.
