This issue is specifically regulated by Chapters 5-3, Air Pollution Controls, and 5-8, Open Burning, Vail Town Code. Pursuant to Section 5-3-3, Fireplaces and Fuel Burning Devices Restricted, Vail Town Code: "There shall be no wood burning fireplace and no solid fuel burning device, other than a certified solid fuel burning device, constructed or installed within any dwelling unit, accommodation unit, employee housing unit or common area within the town." Pursuant to Section 5-3-4, Permitted Devices, Vail Town Code: "Certified solid fuel burning devices, gas appliances, and gas log fireplaces shall be permitted to be installed or constructed in dwelling units, accommodation units, restricted dwelling units or common areas subject to the following provisions: ... D. Common Area:Any common area shall contain not more than one certified solid fuel burning device, or one gas log fireplace." Since the pool area is defined by the Town Code as a common area of the Four Seasons, there shall be no wood burning fireplace and no solid fuel burning device constructed or installed at the pool area. However, one (1) certified solid fuel burning devices, gas appliances, and gas log fireplaces may be allowed as an alternative to the proposed wood burning fireplace. Pursuant to Section 5-8-1, Restrictions; Exceptions, Vail Town Code: "No person shall burn, nor permit to be burned, any trash, paper, rubbish, wastepaper, wood, weeds, brush, plants or other flammable or combustible material, nor kindle or maintain any bonfire on any open premises owned or controlled by such person or in any public street, alley, park property or other land adjacent to such premises except under the following conditions: A. The burning is for the noncommercial cooking of food for human beings. 8. When the burning is a smokeless flare or a safety flare used to indicate some danger to the public. C. Training conducted by the Vail Fire Department." Since the proposed pool area fireplace does not meet the exemptions prescribed by the Town Code, no person shall be permitted to burn wood or maintain a bonfire on the Four Seasons premises.
